This procedure shall be conducted by using electronic means of the Electronic System for Public Procurement (ESPP) (https://www.e-nabavki.gov.mk). More detailed information regarding the use of electronic means: In order to be able to participate in the electronic auction, it is necessary to register at the ESPP and to provide digital certificate. The economic operator shall register at the ESPP by filing the registration form which makes an integral part of the ESPP, after which, the ESPP shall automatically process the data from the registration form, shall generate a code and submit such code to the registered electronic mail of the economic operator. In order to prove the personal situation, the economic operator shall also submit accompanying documentation offering proof of the following:

— Statement of the economic operator that no effective court judgment has been rendered in the past 5 years against him for participation in criminal organisation, corruption, fraud or money laundering;

— Certificate that no bankruptcy procedure has been initialized by competent authorities;

— Certificate that no liquidation procedure has been initialized by competent authorities;

— Certificate for paid taxes, contributions and other public duties, issued by a competent authority from the country where the economic operator has been established.

— Certificate by the Register of penalties for committed criminal acts by legal entities that regarding the bidder no secondary penalty —…

— Certificate that no misdemeanor sanction — interdiction on carrying out a profession, activity or responsibility, i.e. temporary interdiction to carry out particular activity, has been imposed with an effective court judgment.

In order to prove its capacity to exercise professional activity, the economic operator shall submit a document of registered business activity as a proof that it has been registered as physical or legal entity for exercising the business activity related to the subject of the public procurement contract or a proof that it belongs to a respective professional association pursuant to the regulations in the country it has been registered in.

Техничка и професионална способност:

The economic operator shall prove the fulfilment of the minimum requirements by submitting of a list of main deliveries of metal equipment to the bidders or candidates, carried out in the last three years, including values, dates, buyers (contracting authorities or economic operators), with value no less than 200 000 EUR in MKD counter value (excluding VAT) by providing a certificate of completed deliveries issued by the recipients, or, if such certificates can not be provided due to reasons beyond the control of the economic operator, with his statement for completed deliveries — certified statement of the economic operator, that is, the authorized person of the economic operator that he / she has production facilities — machinery and tools for manufacturing of metal equipment.

Минимално ниво(а) на стандарди:

In order to qualify as capable for carrying out the relevant public procurement contract from an aspect of its technical and professional capability, the economic operator must fulfil the following minimum conditions: In the last three years the economic operator has carried out contracts for delivery of metal equipment, the value of which is not less than 200 000 EUR in MKD counter value (VAT excluded) — To have production facilities at his disposal — machinery and tools for manufacturing of metal equipment.

Потребни депозити и гаранции:

The selected most favourable Bidder needs to provide the provision of a good performance guarantee in amount of 10 % of the contract value (including VAT).

The guarantee shall be submitted in the form of a bank guarantee in writing. The guarantee should be submitted in original form. Copies shall not be accepted.

The guarantee for the good performance shall be valid until completion of the contract. The Contracting Authority, having selected the most favourable Bidder, shall additionally establish the guarantee validity period.

The bank guarantee for the good performance guarantee shall be in MKD.

The guarantee for the good performance must be issued by a bank.

The most favourable Bidder shall submit the good performance guarantee within three (5) days of signing the contract.

The good performance guarantee shall be submitted within the established period, as follows: by mail or in person to the contact person from the tender documentation.

Payment under the good performance guarantee shall be collected if the selected most favourable Bidder fails to meet any of the obligations of the public procurement contract within the maturity date, by informing the selected most favourable Bidder in writing regarding the same. If payment is collected under the good performance guarantee, the Contracting Authority shall announce a negative reference to the ESPP. The selected most favourable Bidder may initiate proceedings in front of a competent court for payment of the bank guarantee for contract quality performance and publishing of negative reference through the Electronic System for Public Procurement.

If the public procurement contract has been fully implemented in accordance with what has been agreed, the bank guarantee for good performance guarantee shall be returned by the Contracting Authority to the selected most favourable Bidder within 14 days of the full contract implementation.

The good performance guarantee shall be returned by the selected most favourable Bidder by mail, in person at the economic operator's business seat or in person at the Contracting Authority's business seat.

The payment shall be carried upon each delivered and installed quantity of goods, received by the investor and upon received invoice within 20 days.

Any economic operator having legal interest in obtaining the public procurement contract and who has suffered or can suffer damages of potential breach of provisions of the Law on Public Procurement, can ask for legal protection against decisions, actions and failure to take actions by the Contracting Authority in the procedure for awarding of public procurement contract, in accordance with the requirements and the procedure provided under the Public Procurement Act. The right to an appeal during the procedure ending with an electronic auction regarding the establishment of the capacity of the Bidders and the complete evaluation of the original tenders shall be performed after the adoption of the decision for selection of the best Bidder or upon annulment of the procedure.
