2.2 Personal status
2.2.1 The contracting authority shall exclude from the procedure for awarding a public procurement contract any economic operator who:
— within the last five years has had effective sentence for participation in a criminal organization, corruption, fraud or money laundering;
— has imposed a penalty on participation in public bidding procedures, awarding public procurement contracts and contracts for public private partnership;
— it has imposed a temporary or permanent ban on performing certain activities;
— is in bankruptcy or liquidation proceedings;
— failed to pay taxes and other public charges, unless the economic operator has been granted deferred payment of taxes;
— has a misdemeanor sanction for prohibition to perform a profession, activity or duty, or prohibition to perform certain activity
— Gives false information or fails to provide information requested by the contracting authority.
2.2.2 To prove its personal status the economic operator shall submit the following documents:
— statement of the economic operator that no effective verdict has been issued against the economic operator within the past five years for participation in a crime organization, corruption, fraud or money laundering
— confirmation stating that no bankruptcy procedure has been initiated by a competent body
— confirmation stating that no liquidation procedure has been initiated by a competent body
— certificate of paid taxes, benefits and other public duties issued by a competent body in the country where the economic operator is registered
— confirmation from the Register of penalties for committed criminal offenses of legal entities proving that no secondary penalty —…

— confirmation stating that no misdemeanour sanction — ban on the performance of the profession, activity or duty, i.e. temporary ban on the performance of a particular activity has been pronounced with an effective verdict
2.2.3 The statement mentioned in paragraph 1 item 2.2.2 is prepared and signed by the economic operator and it does not have to be certified by a competent authority.
2.2.4 Confirmations stating that no bankruptcy and liquidation procedure has been initiated, as well as the certificates from the Registry of penalties for committed criminal offenses of legal entities proving that no penalty mentioned in paragraphs 5 and 6 of item 2.2.2 are issued by competent authorities in the country where it is registered. In Macedonia the competent authority for issuing such certificates is the Central Registry of the Republic of Macedonia.

2.2.5 The confirmation of paid taxes and other charges is being issued by the competent authority in the country where it is registered. Macedonian competent authority to issue such certificates it the Public Revenue Office.
2.2.6 The confirmation mentioned in paragraph 7 item 2.2.2 is being issued by the competent authority in the country where it is registered. In Macedonia the competent authority for issuing such certificates is the Central Registry of Macedonia.
2.2.7 The documents mentioned in item 2.2.2 must not be older than six months from the deadline for submission of bids.
The Commission will accept documents for determining the personal status issued after the public opening of tenders, but not later than the date of the decision for selecting the best offer.
2.2.8 If the country in which the economic operator is registered does not issue the documents mentioned in item 2.2.2, or if they do not cover all the above cases, the economic operator may submit a statement certified by a competent authority.

2.4 Technical or professional capability
2.4.1 To qualify as capable of performing the contract for public procurement in terms of its technical or professional capability, the economic operator must meet the following minimum requirements:
— To have a Decision authorizing the placing of the vaccine at Macedonian market or temporary or final approval for parallel import issued by the Ministry of Health / Medicines Agency;
— The conditions for safe keeping, storage, transportation and handling of vaccines respecting the Rules for maintenance of the barrage and the conditions about the space, equipment and the working staff for obtaining the approval for working in wholesale of pharmaceuticals ‘Official gazette’ number 151/08.

2.4.2 The economic operator proves the fulfillment of minimum requirements of item 2.4.1 by submitting:
— an authorization Decision for placing a medicine at Macedonian market or final approval for parallel import or a temporary approval for parallel import by the law on medicines issued by the Ministry of Health / Medicines Agency.
— A statement signed and certified by the economic operator for fulfilling the conditions for safe keeping, storage, transportation and handling of vaccines respecting the Rules for maintenance of the barrage and the conditions about the space, equipment and the working staff for obtaining the approval for working in wholesale of pharmaceuticals ‘Official gazette’ number 151/08.
