In order to prove its personal situation, the economic operator should provide the following documents.
Statement by the economic operator than it has not been sentenced, in the last 5 years, with effective court decision for participation in criminal organization, corruption, fraud or money laundering.
— certificate that it is not subject to bankruptcy procedure issued by competent authority,
— certificate that it is not subject to liquidation procedure issued by competent authority,
— certificate for paid taxes, contributions and other public duties by the competent authority in the country where that economic operator is established.
— certificate from the Legal Entities penal registry that it is not being imposed a side sanction – prohibition to participate in public competitions, contract award procedures and PPP award procedures.
— certificate from the Legal entities penal registry that it is not being imposed a side sanction — temporary or permanent prohibition to perform certain professional activity.
— certificate that it is not being sanctioned for misdemeanor with an effective court decision, resulting in prohibition for pursuing professional activity or duty, i.e. temporary prohibition for performing professional activity.

Document for registered activity.
In order to prove the ability to perform a professional activity, the economic operator should deliver a document for registered activity as an evidence that it is registered as a natural or legal entity for performing the activity related to the subject of the contract for public procurement or an evidence that it belongs to a respective professional association pursuant to the regulations of the country where it is registered. The economic operators obliged to deliver a valid license for performance of energetic activity, trade or supply of electricity issued by the Energy Regulatory Commission of the Republic of Macedonia.

Copy of the EIC code issued by AD MEPSO — Skopje, as a performer of energy-related activity transfer of electricity.
Copy of the certificate that it is registered as a participant in the electricity market.
— Copy of the contract for the balance responsibility in accordance with the rules on electricity market,
— List of main deliveries of the suppliers and candidates performed in the past 3 years giving the values, dates, buyers (contracting authorities and economic operators) and confirmation letters for the supplied services issued by the contracting party; in case those certificates can not be obtained due to reasons on which the economic operator can not have control, the operator shall give a statement for the supplied services.

Minimum qualification requirements on the technical and professional ability of the economic operator:
Possess a valid EIC code issued by AD MEPSO — Skopje, as a performer of energy-related activity, transfer of electricity, to be a registered participant in the electricity market pursuant to the rules on an electricity market, possess contract on balanced responsibility in accordance with the Law on electricity market, provide minimum 1 confirmation letter for the supplied services issued by the contracting party in the last 3 years, for supplied services.

Извршување на договорот
Потребни депозити и гаранции:
Bid guarantee 3 %.
Performance guarantee: 15 %.
Главни услови за финансирање и аранжмани за плаќање и/или упатување на релевантните одредби што ги уредуваат:
— Within the duration of the contract (12 months) the economic operator is bound to deliver an invoice in the amount of 1/12 of the total price to the Contracting Authority, not later than 8 days after the expiry of every current month,
— The economic operator is bound to calculate all the costs in the price offered per MWH, including the costs for balancing, i.e. take over the responsibility for balancing, all the discounts, import duties etc.
The payment for the consumer electricity shall be paid upon performed measuring for each measuring location, which is to be done by the Distribution system operator, and the measuring locations are listed pre name in the technical specification. The compensation for the use of the electricity market and the purchase of the privileged electricity producers shall be stated separately in the monthly invoice.

The following manner of payment is stipulated: within 30 days from the last day of delivery in the month.
The manner of payment is compulsory. Every bid that contains manner of payment different than the one.
Determined in this point, shall be considered unacceptable and as such it will be rejected by the commission on public procurement.
