Information and formalities necessary for evaluating if the requirements are met:

— statement by the economic operator that it has not been announced, in the last 5 years, effective court decision for participation in criminal organization, corruption, fraud or money laundering;

— certificate that it is not subject to bankruptcy procedure issued by competent authority,

— certificate that it is not subject to liquidation procedure issued by competent authority,

— certificate for paid taxes, contributions and other public duties by the competent authority in the country where that economic operator is established,

— certificate from the Register of penalties for committed criminal acts of legal entities that a minor penalty…

… ban on participation in procedures for public announcements, awarding of public procurement contracts and contracts for public private partnership has not been imposed,

… temporary or permanent ban on performing certain activity has not been imposed,

— certificate that it has not been announced any sanctions for misdemeanor with an effective court decision,resulting in prohibition for pursuing professional activity or duty, i.e. in a temporary prohibition for performing professional activity.

Capacity for performing a professional activity

To prove his capacity for performing a professional activity, the economic operator is required to submit a Business Registration Certificate (BRC) or similar document as a proof that he is registered either as a natural or legal entity for performing a professional activity related to the subject of the public procurement contract, or a proof that he belongs to a respective professional association as per the legislation of the country he is registered in.

Other requirements:

— Tenderer (Bidder) is required to possess Certificate A for construction of first (I) category structures as per the Construction Law in force (Official Gazette of Republic of Macedonia nº 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14, 115/14, 149/14, 187/14, 44/15, 129/15, 217/15, 226/15, 30/16, 31/16, 39/16, 71/16, 103/16, and 132/16) or, for foreign economic operators, a Certificate issued by the authority responsible for operations in the area of spatial planning/management according to Article 42 of the Construction Law (Official Gazette of Republic of Macedonia nº 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14, 115/14, 149/14, 187/14, 44/15, 129/15, 217/15, 226/15, 30/16, 31/16, 39/16, 71/16, 103/16, and 132/16) (applies to each member of the group in case the tender is submitted by a group of economic operators – JV).

The economic operator shall prove that he meets the requirements of Capacity for performing a professional activity by submitting the following:

— Copy of a business registration document,

— Copy of the Certificate A for construction of first (I) category structures as per the Construction Law in force (Official Gazette of Republic of Macedonia nº 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14, 115/14, 149/14, 187/14, 44/15, 129/15, 217/15, 226/15, 30/16, 31/16, 39/16, 71/16, 103/16, and 132/16) or, for foreign economic operators, a Certificate issued by the authority responsible for operations in the area of spatial planning/management according to Article 42 of the Construction Law (Official Gazette of Republic of Macedonia nº 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14, 115/14, 149/14, 187/14, 44/15, 129/15, 217/15, 226/15, 30/16, 31/16, 39/16, 71/16, 103/16, and 132/16)

Економска и финансиска состојба:

Economic and financial status.

To qualify as capable of implementing the respective public procurement contract in terms of his economic and financial situation, the economic operator must meet the following requirements:

— Total annual income of 500,000.00 EUR in the last three years (aggregate amount for 2015, 2016 and 2017).

The economic operator shall prove that he meets the requirements for Economic and financial status by furnishing the following:

— Copy of balance sheet report and data on income statements for 2015, 2016, and 2017, certified by a competent authority, i.e. audited balance sheets or abstracts of the report on balance sheets, where balance sheet publication is required under the law of the country where the economic operator is registered,

— For foreign tenderers, in case balance sheet reports and data on income statements for 2015, 2016, and 2017 are not published, copies should be furnished of auditors’ reports of the Foreign Tenderer, which shall be positive and shall be issued by a reputable foreign institution registered to provide audit services,

— Audit reports should contain data about the overall economic operation of the Foreign Tenderer, from which the requested income for the last three years can be seen.

Technical or professional competence

To qualify as competent in implementing the public procurement contract in terms of his technical or professional competence, the economic operator must meet the following requirements:

— Minimum one (1) completed contract for developed, reviewed, and approved (accepted) design for construction, or reconstruction, or rehabilitation of minimum 5km of state roads (motorways, expressways, national or regional roads) in the last 3 (three) years, of a value of minimum 10 000 000,00 MKD,

— Notification on contract items that the economic operator intends to subcontract to third parties, if any.

Key Personnel:

— Chief Design Engineers: one (1) Bachelor of Civil Engineering – BS CE possessing Certificate A for developing civil engineering design documents, with minimum 5 (five) years of work experience as a design engineer, and 3 (three) years of work experience as a road design engineer; and one (1) Bachelor of Architectural Engineering – BAE possessing Certificate A for developing urban plans, i.e. a planner, signatory of planning documentation, with minimum 5 (five) years of work experience as a planner, and 3 (three) years of work experience as a road planner,

— Road Alignment Design Engineer: one (1) Bachelor of Civil Engineering – BS CE possessing Certificate A for developing civil engineering design documents, with minimum 5 (five) years of work experience as a design engineer, and 3 (three) years of work experience as a road design engineer,

— Design Engineer for Road Facilities: one (1) Bachelor of Civil Engineering – BS CE possessing Certificate A for developing civil engineering design documents, with minimum 5 (five) years of work experience as a design engineer, and 3 (three) years of work experience as a design engineer on designs of road facilities,

— Design Engineer of Geotechnics: Bachelor of Engineering possessing Certificate A for developing design documents in geotechnics, with minimum 5 (five) years of work experience in civil engineering and 3 (three) years as a Design Engineer on projects involving geotechnics,

— Geodetic Engineer possessing an Authorization in Geodesy with minimum 4 (four) years of work experience in civil engineering field,

— Expert in Strategic environmental assessment (SEA) and in Environmental impact assessment (EIA) possessing a Diploma in the field of Environmental Engineering, Ecology, Engineering, technical-technological sciences, or other appropriate diploma in natural sciences related to the environment protection, with:

General experience:

Minimum 3 (three) years of work experience in the field of the environment protection and improvement;

Specific experience:

(1) Certificate of passed professional exam for obtaining the status of an Expert in Strategic environmental assessment (SEA) and in Environmental impact assessment (EIA) of projects, issued by the Ministry of Environment and Physical Planning (MOEPP) of RM, and listed on the List of Experts in Environmental impact assessment of projects, kept by the MOEPP of RM;

(2) Minimum one (1) developed and approved Strategic environmental assessment (SEA) and Environmental impact assessment (EIA) Study or Report for a project in the transport sector (construction, reconstruction or rehabilitation of state roads — motorways, expressways, national or regional roads, or of railways) in the last 5 (five) years, on which the expert worked as an EIA Expert:

— Note: In case a foreign expert is proposed, either a confirmation/certificate from expert’s home country shall be submitted, or a statement that this matter in his/her home country is regulated in a different manner. Also, for foreign physical and legal entities, provisions apply of the Construction Law (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14, 115/14, 149/14, 187/14, 44/15, 129/15, 217/15, 226/15, 30/16, 31/16, 39/16, 71/16, 103/16 and 132/16) and of the Environment Protection Law (Official Gazette of RM no. 53/2005, 81/2005, 24/2007, 159/2008, 83/2009, 48/2010, 124/2010, 51/2011, 123/2012, 93/13, and all its amendments and supplements).

Equipment:

— Adequate technical equipment with hardware and software required for development of the design documents in an electronic form,

— Geodetic instruments and equipment (appropriate equipment for surveying, double frequency GPS unit, 2 (two) total stations, off-road vehicle).

The economic operator shall prove that he meets the requirements of Technical and professional competence by submitting the following:

— Copy of the Contract and a proof of the project completion, as well as written confirmation of performed services issued by the beneficiary,

— Notification about contract items that the economic operator intends to subcontract to third parties.

— For Chief Design Engineers: copies of the diplomas; for the BS CE — copy of Certificate A for developing civil engineering design documents, for the BAE – copy of the Certificate A for developing urban plans, i.e. for a planner and signatory of planning documentation, issued by competent national authorities, as per the Construction Law in force (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14, 115/14, 149/14, 187/14, 44/15, 129/15, 217/15, 226/15, 30/16, 31/16, 39/16, 71/16, 103/16 and 132/16), completed short biography forms (provided in tender documents) for the proposed experts, and copies of employment evidence or respective proof of engagement as per the Procurement Law in force,

— For Road Alignment Design Engineer: copies of the diploma and of Certificate A for developing design documents in civil engineering issued by competent national authorities, as per the Construction Law in force (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14, 115/14, 149/14, 187/14, 44/15, 129/15, 217/15, 226/15, 30/16, 31/16, 39/16, 71/16, 103/16 and 132/16), completed short biography form (provided in tender documents) for the proposed expert, and copies of employment evidence or respective proof of engagement as per the Procurement Law in force,

— For Road Facilities Design Engineer: copies of the diploma and of Certificate A for developing design documents in civil engineering issued by competent national authorities, as per the Construction Law in force (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14, 115/14, 149/14, 187/14, 44/15, 129/15, 217/15, 226/15, 30/16, 31/16, 39/16, 71/16, 103/16 and 132/16), completed short biography form (provided in tender documents) for the proposed expert, and copies of employment evidence or respective proof of engagement as per the Procurement Law in force,

— For Design Engineer of Geotechnics: copies of the diploma and of Certificate A for developing design documents in geotechnics issued by competent national authorities, as per the Construction Law in force (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14, 115/14, 149/14, 187/14, 44/15, 129/15, 217/15, 226/15, 30/16, 31/16, 39/16, 71/16, 103/16 and 132/16), completed short biography form (provided in tender documents) for the proposed experts, and copies of employment evidence or respective proof of engagement as per the Procurement Law in force,

— For Geodetic Engineer: copies of the diploma and of Certificate in geodesy, completed short biography forms (provided in tender documents) for the proposed expert, and copies of employment evidence or respective proof of engagement as per the Procurement Law in force,

— For Expert in Strategic Environmental Assessment (SEA) and Environmental Impact Assessment (EIA):

— Copy(ies) of the diploma/s);

— Completed short biography forms (provided in tender documents) for the proposed expert, and copies of employment evidence or respective proof of engagement as per the Procurement Law in force;

— Copy of the Certificate of an Expert in Strategic environmental assessment (SEA) and in Environmental impact assessment (EIA) of projects, issued by the Ministry of Environment and Physical Planning (MOEPP) of RM;

— Copy of a confirmation about the expert being engaged in developing a Strategic environmental assessment study/report, or a Decision on approving the Study or Report by a competent authority.

— statement about being technically equipped with hardware and software required for development of the design documents in an electronic form,

— statement about possessing geodetic instruments and equipment.
