— certificate that it is not subject to liquidation procedure issued by competent authority,

— certificate for paid taxes, contributions and other public duties by the competent authority in the country where that economic operator is established,

— certificate from the register of penalties for committed criminal acts of legal entities that a minor penalty ban on participation in procedures for public announcements, awarding of public procurement contracts and contracts for public private partnership has not been imposed,

— certificate from the Register of penalties for committed criminal acts of legal entities that a minor penalty temporary or permanent ban on performing certain activity has not been

imposed,

— certificate that it has not been announced any sanctions for misdemeanor with an effective court decision, resulting in prohibition for pursuing professional activity or duty, i.e. in a temporary prohibition for performing professional activity.

— copy of a Business Registration Certificate (BRC),

— certificate A for designing first category structures as per the construction law in force (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14, 115/14, 149/14, 187/14, 44/15, 129/15, 217/15, 226/15, 30/16, 31/16, 39/16, 71/16, 103/16, 132/16 and 35/18) or, for foreign economic operators, a Certificate issued by the authority responsible for operations in the area of spatial planning/management according to Article 42 of the construction law (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14, 115/14, 149/14, 187/14, 44/15, 129/15, 217/15, 226/15, 30/16, 31/16, 39/16, 71/16, 103/16, 132/16 and 35/18) (applies to each member of the group in case the bid is submitted by a group of economic operators – JV).

Економска и финансиска состојба:

— total revenues of 5 000 000,00 MKD in the last 3 years (2015, 2016 and 2017).

The economic operator shall prove that he meets the requirements for economic and financial status by furnishing the following:

— copy of balance sheet report and data of 2015, 2016 and 2017 income statements, verified by a competent authority, i.e. audited balance sheets or abstracts of the report on balance sheets, where balance sheet publication is required under the law of the country where the economic operator is registered,

— in cases of foreign tenderers: if balance sheet report and income statement were not issued for 2015, 2016 and 2017 and verified by a competent authority, the requirement is to furnish copies of auditors’ reports of the foreign tenderer, which shall be positive and shall be issued by a reputable foreign institution registered to provide audit services.

Auditor reports should contain data about the overall economic operation of the foreign tenderer, from which the required income amount for the last 3 years can be seen.

Техничка и професионална способност:

— minimum 1 (one) contract on developed, reviewed and approved design for construction or reconstruction with rehabilitation of minimum 5 km of state roads (motorways, expressways, national or regional roads) in the last 3 (three) years, with a minimum value of 5 000 000,00 MKD,

— notification on contract items, if any, that the economic operator intends to subcontract to third parties.

Key Staff:

— chief design engineers: one Bachelor of Civil Engineering – BS CE possessing Certificate A for developing civil engineering design documents, with minimum 5 (five) years of work experience as a design engineer, and 3 (three) years of work experience as a road design engineer and one Bachelor of Architectural Engineering – BAE possessing Certificate A for developing urban plans, i.e. a planner, signatory of planning documentation, with minimum 5 (five) years of work experience as a planner, and 3 (three) years of work experience as a road planner,

— road alignment design engineer: one Bachelor of Civil Engineering – BS CE possessing certificate A for developing civil engineering design documents, with minimum 5 (five) years of work experience as a design engineer, and 3 (three) years of work experience as a road design engineer,

— civil or transport/traffic engineer: one bachelor of civil or transport/traffic engineering possessing certificate A for developing design documents in transport/traffic engineering, with minimum 4 (four) years of work experience as a design engineer, and 2 (two) years of work experience as a road design engineer,

— geodetic engineer possessing certificate in Geodesy with minimum 4 (four) years of work experience in civil engineering field,

— Expert in Environmental Impact Assessment (EIA) possessing a Diploma (minimum VII1 grade, or 240 credits according to ECTS) in the field of Environmental Engineering, Ecology, Energetics, Architecture, Engineering, technical-technological sciences, or other respective diploma in natural sciences, with:

General experience:

Minimum 3 (three) years of work experience (from the date of tender announcement) in the field of the environment and nature protection and improvement.

Specific experience:

(1) Minimum one (1) developed and approved Environmental Impact Assessment (EIA) Report for a transport sector project for construction or reconstruction or rehabilitation of state roads motorways, expressways, national or regional roads, or for construction or reconstruction or rehabilitation of infrastructure projects in the railways sector, or for construction or reconstruction or rehabilitation of other line infrastructure projects (gas pipelines, oil pipelines or power lines) in the last eight (8) years (from the tender announcement date), on which he/she worked as a responsible expert (signatory) of the EIA Report; or minimum one (1) developed and approved Environmental Impact Assessment (EIA) Study for a transport sector project for construction or reconstruction of state roads motorways, expressways, national or regional roads, or for construction or reconstruction of infrastructure projects in the railways sector, or for construction or reconstruction of other line infrastructure projects (gas pipelines, oil pipelines or power lines) in the last eight (8) years (from the tender announcement date), on which he/she worked as a responsible expert (signatory) of the Environmental Impact Assessment (EIA) Study.

(2) Minimum one (1) developed “document” on environmental and social impact assessment for a project in construction or reconstruction of state roads motorways, expressways, national or regional roads, or in construction or reconstruction or rehabilitation of infrastructure projects in the railways sector, or in construction or reconstruction or rehabilitation of other line infrastructure projects (gas pipelines, oil pipelines or power lines) in the last eight (8) years (from the tender announcement date), on which he/she worked as an expert on the “document” (signatory) according to requirements of the international financial institutions – IFIs (such as the World Bank, the EBRD or the EIB). The term “document” here shall refer exclusively to the following:

— Environmental and Social impact Assessment Study (ESIA) or

— Environmental and Social Action Plan (ESAP) or

— Biodiversity Management Plan (BMP) or

— Critical Habitat Assessment (CHA) or

— Environmental and Social Aassessment Report (ESAR).

Expert in social impacts: Diploma (minimum VII1 grade, or 240 credits according to ECTS) in the field of social sciences, sociology, social issues and politics, or a respective diploma related to social aspects in project implementation, with:

Minimum 3 (three) years of work experience (from the tender announcement date) in the field of the social aspects related to projects, inclusion of affected parties, communication and implementation of public opinion survey, socio-economic research, implementation of grievances mechanism, etc.

1) Participation as an expert in social impacts assessment on minimum one (1) project in construction or reconstruction of state roads motorways, expressways, national or regional roads, or in construction or reconstruction of infrastructure projects in the railways sector, or in construction or reconstruction of other line infrastructure projects (gas pipelines, oil pipelines or power lines) in the last eight (8) years (from the tender announcement date), as part of the process (team) of the Environmental Impact Assessment (EIA);

2) Minimum one (1) developed “document” on social impact assessment for a transport sector project of construction or reconstruction of state roads motorways, expressways, national or regional roads, or for construction or reconstruction of infrastructure projects in the railways sector, or for construction or reconstruction of other line infrastructure projects (gas pipelines, oil pipelines or power lines) in the last eight (8) years (from the tender announcement date), on which he/she worked as an expert (signatory) on the “document” according to requirements of the international financial institutions – IFIs (such as the World Bank, the EBRD or the EIB). The term “document” here shall refer exclusively to the following:

— Land Acquisition and Resettlement Framework (LARF) or

— Resettlement Policy Framework (RPF) or

— Resettlement Action Plan (RAP) or

— Land Acquisition Plan (LAP) or

— Stakeholder Engagement Plan (SEP).

Equipment:

— adequate technical equipment with hardware and software required for development of the design documents in an electronic form,

— geodetic instruments and equipment (appropriate equipment for surveying, double frequency GPS unit, 2 (two) total stations, off-road vehicle).

The economic operator shall prove that he meets the requirements of technical and professional competence by submitting the following:

— copy of the Contract and a proof that the project was completed and reviewed, as well as written confirmation by recipients of the service performed (performance certificate),

— notification on contract items that the economic operator intends to subcontract to third parties.

Key personnel:

— for chief design engineers: copies of the diploma; for the BS CE — copy of Certificate A for developing civil engineering design documents, for the BAE – copy of the certificate A for developing urban plans, i.e. for a planner and signatory of planning documentation, issued by competent national authorities, as per the Construction law in force (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14, 115/14, 149/14, 187/14, 44/15, 129/15, 217/15, 226/15, 30/16, 31/16, 39/16, 71/16, 103/16, 132/16 and 35/18), completed short biography forms (provided in tender documents) for the proposed experts, and copies of employment evidence or respective proof of engagement as per the Procurement Law in force,

— for road alignment design engineer: copies of the diploma and of Certificate A for developing design documents in civil engineering issued by competent national authorities, as per the Construction Law in force (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14, 115/14, 149/14, 187/14, 44/15, 129/15, 217/15, 226/15, 30/16, 31/16, 39/16, 71/16, 103/16, 132/16 and 35/18), completed short biography form (provided in tender documents) for the proposed expert, and copies of employment evidence or respective proof of work engagement as per the procurement law in force,

— for civil engineering or transport/traffic engineer: copies of the diploma and of certificate a for developing design documents in transport/traffic engineering issued by competent national authorities, as per the construction law in force (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14, 115/14, 149/14, 187/14, 44/15, 129/15, 217/15, 226/15, 30/16, 31/16, 39/16, 71/16, 103/16, 132/16 and 35/18), M1/M2 employment forms, and completed short biography forms (provided in tender documents) for the proposed expert,

— for geodetic engineer: copies of the diploma and of certificate in geodesy, completed short biography form (provided in tender documents) for the proposed expert, and copies of employment evidence or respective proof of engagement as per the procurement law in force,

— for expert in environmental impact assessment:

—— copy(ies) of the diploma/s),

—— completed short biography form (provided in tender documents) for the proposed experts, and copies of employment evidence or respective proof of engagement as per the Procurement Law in force,

—— copy of a decision approving the EIA Report, issued by a competent authority (where the title of the relevant project and the name of the responsible EIA expert are visible). If the expert’s name is not stated in the Decision, a copy is required to be submitted of a certificate confirming that the expert was a responsible person (signatory) for the EIA Report, issued by an employer, a Contracting Authority, or an investor; a copy of a section of the EIA Report, i.e. extract of the first, last and the page stating the responsible person (signatory) and the project title (identical to the title stated in the decision and certificate) or

—— copy of a Decision approving the EIA Study, issued by a competent authority (where the title of the relevant project and the name of the responsible EIA expert are visible). If the expert’s name is not stated in the decision, a copy is required to be submitted of a certificate confirming that the expert was a responsible person (signatory) for the EIA study, issued by an employer, a Contracting Authority, or an investor; a copy of a section of the EIA Report, i.e. extract of the first, last and the page stating the responsible person (signatory) and the project title (identical to the title stated in the decision and certificate);

—— copy of a certificate that the expert has developed minimum 1 (one) “document” on environmental and social impact assessment for construction or reconstruction of state roads motorways, expressways, national or regional roads, or for construction or reconstruction of infrastructure projects in the railways sector, or for other line infrastructure projects (gas pipelines, oil pipelines or power lines) in the last eight (8) years, on which he/she worked as an expert according to requirements of the international financial institutions – IFIs (such as the World Bank, the EBRD or the EIB). The Certificate should be supported by an extract of the “document” presenting the project title and the expert’s name.

— for Expert in Social Impacts:

—— copy(ies) of the diploma/s);

—— completed short biography forms (provided in tender documents) for the proposed expert, and copies of employment evidence or respective proof of engagement as per the Procurement Law in force,

—— copy of a certificate about the expert being engaged as a social impact expert, as part of the procedure on a project’s environmental impact assessment, issued by an employer, a Contracting authority, or an investor. The certificate should be supported by an extract of the “document” presenting the project title and the expert’s name,

—— copy of a confirmation that the expert has developed minimum 1 (one) “document” on social impact assessment for a project on construction or reconstruction of state roads motorways, expressways, national or regional roads, or on construction or reconstruction of infrastructure projects in the railways sector, or on construction or reconstruction of other line infrastructure projects (gas pipelines, oil pipelines or power lines) in the last eight (8) years (from the tender announcement date), on which he/she worked as an expert on the “document” according to requirements of the international financial institutions – IFIs (such as the World Bank, the EBRD or the EIB). The Certificate should be supported by an extract of the “document” presenting the project title and the expert’s name.

— statement about technical equipment with hardware and software required for development of the design documents in an electronic form,

— statement about possessing geodetic instruments and equipment.
