The Contracting Authority reserves the right not later than 6 days before the deadline for submission of bids on its own initiative or on the basis of requests for clarification by the bidders to amend or supplement the Tender documentation, and immediately inform all economic operators that have obtained the documentation. In the case of amendments to the tender documentation, the Contracting Authority shall extend the deadline for submission of bids for at least 6 days. In the case of a change and an amendment to the tender documents published on the ESPP and the extension of the deadline, the Contracting Authority is obliged to publish the amendment made by ESPP, after which all Economic operators that have taken Tender documentation by the time of the amendment will receive automatic Electronic notification that an amendment to the specific listing has been published.

The Contracting Authority shall exclude from the procedure for awarding a public procurement contract any economic operator:

— to whom in the last 5 years a final verdict has been pronounced for participation in a criminal organization, corruption, fraud or money laundering,

— to which a minor penalty has been imposed ban on participation in public call procedures, awarding public procurement contracts and public-private partnership contracts,

— to which a minor penalty has been pronounced temporary or permanent prohibition for carrying out a particular activity,

— is in a bankruptcy or liquidation procedure,

— who has unpaid taxes, contributions and other public duties, unless the economic operator has been granted deferred payment of taxes, contributions or other public fees in accordance with the special regulations and regularly pays them,

— to whom a misdemeanor sanction has been pronounced a ban on performing a profession, activity or duty, that is, a temporary ban on performing a particular activity; and,

— who gives false data or fails to submit the data requested by the Contracting Authority.

In order to prove the ability to perform professional activity, the economic operator should submit a document for registered activity as evidence that it is registered as a natural or legal person for performing the activity related to the subject of the public procurement contract or evidence that it belongs to a suitable professional association in accordance with the regulations of the country where it is registered.

The same is proved by:

— Copy of the Document for registered activity — DRD Form.

2.3.2 Evidence issued by a competent body for fulfilling the special conditions for performing the activity prescribed in accordance with the law that relate to the subject of the contract.

— Permit / Decision from the competent state body for performing insurance activities, with specified classes of insurance.

Техничка и професионална способност:

To qualify as capable of carrying out the relevant public procurement contract in terms of its technical or professional capability, the economic operator must meet the following minimum requirements:

— have a license from the relevant regulatory body (Insurance supervision agency), according to the classes, that is, the insurance tariffs according to which the appropriate insurance coverage will be provided, according to the subject of the public procurement, that is, to have a license for issuing aviation, and insurance of pilots from an accident,

— have a reinsurance cover from a reinsurance company with a minimum credit rating of BBB or BB + determined by Standard and Poor's or equivalent from another rating agency (for example: Moody's, Fitch Group, AM Best).

Минимално ниво(а) на стандарди:

The economic operator shall prove the fulfillment of the minimum requirements of subsection 2.4.1 by submitting:

— Statement by the responsible person of the economic operator that they have the appropriate permit specified in item 2.4.1, condition 1,

— A reinsurance confirmation from a reinsurance company with a minimum rating of BBB or BB + determined by standard and poor or equivalent by another rating agency (for example: Moody's, Fitch Group, AM Best) stating: the subject of insurance, airplanes with the registration number, the number of the open procedure, with the signature and stamp of the re-insurer or the reinsurer if there are more reinsurers.

2.5.3 Documents in item 2.4.2, line 1 are prepared and electronically signed by the economic operator and they are not obliged to be certified by a competent authority.

2.5.4 Technical and professional capacity of the Economic operator may be supported by another entity regardless of the legal relations between the Economic operator and that entity except for the list and previously signed agreements. If the economic operator proves its technical and professional ability invoking the support of another entity, it is obliged to prove the support with valid evidence that the entity will make available to the economic operator the technical and professional resources. The entity which provides Technical support a verdict for participation in a criminal organization, corruption, fraud or money laundering should not be rendered.

2.5.5 If economic operators submit a bid as a group of Economic operators, their technical and professional capacity shall be established by considering the resources of all members of the group. If the group of economic operators participates with technical and professional support from a third entity or third entities, the technical and professional capability is determined according to the above mentioned.
