The Contracting Authority reserves the right not later than 6 days before the deadline for submission of bids on its own initiative or on the basis of requests for clarification by the bidders to amend or supplement the tender. Documentation, and immediately inform all economic operators that have obtained the documentation in the case of amendments to the tender documentation, the Contracting Authority shall extend the deadline for submission of bids for at least 6 days. In the case of a change and an amendment to the tender documents published on the ESPP and the extension of the deadline, the Contracting Authority is obliged to publish the amendment made by ESPP, after which all economic operators that have taken tender documentation by the time of the amendment will receive automatic electronic notification that an amendment to the specific listing has been published.

2.2.1 The Contracting Authority shall exclude from the procedure for awarding a public procurement contract by any economic operator:

— to whom in the last 5 years a final verdict has been pronounced for participation in a criminal organization, corruption, fraud or money laundering,

— to which a minor penalty has been imposed ban on participation in public call procedures, awarding public procurement contracts and public-private partnership contracts,

— to which a minor penalty has been pronounced temporary or permanent prohibition of carrying out a particular activity,

— who is in a bankruptcy or liquidation procedure,

— who has unpaid taxes, contributions and other public duties, unless the economic operator has been granted deferred payment of taxes, contributions or other public fees in accordance with the special regulations and regularly pays them,

— to whom a misdemeanor sanction has been pronounced a ban to performing a profession, activity or duty, that is a temporary ban to performing a particular activity; and,

— who gives false data or fails to submit the data requested by the Contracting Authority.

2.2.2 Information and formalities necessary for evaluating if the requirements are met: To prove its personal situation, the economic operator shall submit the following documents:

— Statement by the economic operator that in the last 5 years has not been announced verdict for participation in,

— criminal organization, corruption, fraud or money laundering,

— Confirmation that there is no bankruptcy procedure by the competent authority,

— Confirmation that there is no bankruptcy liquidation procedure by the competent authority,

— Confirmation of paid taxes, contributions and other public duties by the competent authority of the country.

Where the economic operator is established;

— Certificate from the registry of penalties for committed crimes that the company has not been imposed minor penalty…

… ban on participation in public tender procedures, in the award of public procurement contracts and in public-private partnerships,

… for temporary or permanent prohibition of professional activity,

— Confirmation that with a final sentence it has not been imposed a sanction ban on performing profession, activity or duty, or a prohibition to perform certain activity.

3.2.1 In order to prove the ability to perform a professional activity, the economic operator should submit a document for registered activity as evidence that he is registered as a natural or legal person for performing the activity related to the subject of the public procurement contract or evidence that he belongs to appropriate professional association in accordance with the regulations of the country where it is registered.

The same is proved by:

— Copy of a Registered Business Document.

3.2.2 Evidence issued by a competent authority for fulfilling the special conditions for performing the activity prescribed in accordance with the law that relate to the subject of the contract

License for carrying out energy activity, trade in crude oil, oil derivatives, biofuels and fuels intended for transport issued by the energy regulatory commission of the Republic of Macedonia.

2.4.1 In order to qualify as capable of carrying out the relevant public procurement contract in terms of its technical or professional capability, the economic operator must fulfill the following minimum requirements:

— Experience in successfully executed contracts related to the subject of procurement in the last 3 years.

2.4.2 The economic operator shall prove the fulfillment of the minimum requirements of sub-section 2.4.1 by submitting:

— List of successfully executed contracts related to the subject of procurement in the last three years, with values of the contracts, dates of concluding, buyers (contracting authorities or economic operators), by providing a certificate for performed deliveries issued by the recipients or if such certificates can not to be provided for reasons beyond the control of the economic operator, only with his declaration of performed deliveries.
