2.3 Capacity to perform a professional activity

2.3.1 In order to prove the ability to perform professional activity, the economic operator should submit a document for registered activity as evidence that it is registered as a natural or legal person for performing the activity related to the subject of the public procurement contract or proof that it belongs to a suitable professional association in accordance with the regulations of the country where it is registered and a Current Status.

2.3.2 A proof issued by a competent authority for fulfilling the special conditions for performing the activity prescribed in accordance with the law that refer to the subject of the contract:

— a copy of "A" license for a contractor for construction of first class buildings (the economic operator registered abroad proves the fulfillment of this requirement with a certificate issued by the Ministry of transport and communications of the Republic of Macedonia).

2.4 Economic and financial capacity

2.4.1 In order to qualify as capable to execute the subject Public procurement agreement from the aspect of its economic and financial capacity, the economic operator shall fulfill the following minimal conditions:

— to have realized a positive financial working in the last 3 years (2015, 2016 and 2017),

— to have realized a total annual income in the last 3 years (2015, 2016 and 2017) of minimum 950 000 000.00 MKD.

2.4.2 If the economic operator has been performing the activity for a period of less than 3 years, the minimum condition for determining the economic and financial capacity is that the economic operator has fulfilled the condition referred to in sub-Article 2.4.1 in the years for which data exist.

2.4.3 The Economic operator proves the fulfillment of the minimal condition from sub-Article 2.4.1 by submitting:

— A report from the Balance sheet verified by a competent authority, that is Revised balance sheet or excerpts from the Balance sheet in cases when the publishing of the Balance sheet is regulated by law in the country where the economic operator is registered,

— Statement of the total turnover of the enterprise (data from the Balance sheet issued by a competent authority, i.e. Revised balance sheet) and, where appropriate, of the turnover in the area covered by the Public procurement agreement and the maximum of the last 3 financial years for which such data are available depending on the date on which the company was set up or commenced its operation and depending on the availability of such information.

2.4.4 If the Balance Sheet and the Profit and Loss Account were subject to a commercial audit, the economic operator may submit them as proof that it fulfils the minimum condition for determining the economic and financial capacity without being further certified by a competent authority.

2.4.5 If the Balance sheet and the profit and loss account were not subject to a commercial audit, the economic operator shall submit them certified or issued by a competent authority as proof that it fulfils the minimum condition for determining the economic and financial capacity. The competent authority in the Republic of Macedonia is the central registry of the Republic of Macedonia.

2.4.6 The economic and financial capacity of the economic operator may be supported by another entity, regardless of the legal relations between the economic operator and that entity, except in the case of data from the profit and loss account. If the economic operator proves its economic and financial capacity based on the support from another entity, it is obliged to prove the support with a valid proof that that entity will make the proper financial means available to the economic operator. The entity providing the financial support must not be imposed a final judgment for participation in a criminal organization, corruption, fraud or money laundering.

2.4.7 If the economic operators submit a bid as a group of economic operators, the economic and financial capacity is proven by taking into consideration the resources of all group members. If the group of economic operators acts with the financial support from a third entity, the economic and financial capacity is proven according to the aforementioned.

Техничка и професионална способност:

2.5 Technical or professional capacity

2.5.1 In order to qualify as capable to execute the subject Public Procurement Agreement from the aspect of its technical or professional capacity, the economic operator shall fulfill the following minimal conditions:

— To have at least one hundred (100) employees out of which:

—— Minimum 2 Civil engineers with Certificate "A" for performance engineer;

—— Minimum 1 Electrical engineer with Certificate “B”.

—— Minimum 1 Geometer;

—— Minimum 4 Construction technicians;

—— Minimum 4 Machinists and.

—— Minimum 4 drivers of heavy vehicles.

— To have the following equipment:

—— Possess an asphalt base – minimum capacity of 150 t/n with A integrated permit on the territory of the Republic of Macedonia;

—— Minimum 1 grader;

—— Minimum 3 rollers;

—— Minimum 3 excavators;

—— Finisher;

—— Machine for scraping/ scratching of asphalt.

—— An asphalt base with minimum capacity of 60 m3/h with B integrated permit on the territory of the Republic of Macedonia;

—— Minimum 8 tipper trucks of which at least five loads exceeding 20 tons;

—— Minimum 5 heavy vehicles;

—— Minimum 3 trenchers;

—— machine for cutting asphalt and.

—— emulsion nozzle.

2.5.2 The Economic operator proves the fulfillment of the minimal condition from sub-Article 2.5.1 by submitting:

— Statement on the technical staff and technical bodies in accordance with item 2.5.1 regardless of whether they belong directly to the economic operator,

— A list of all employees issued by the Employment agency not older than 15 (fifteen) days from the date of the bid submission,

— Copy of certificate "A" for the performance engineers,

— Copy of certificate “B” for the electrical engineer,

— Copy of diploma for the geometer,

— Copy of diploma for the construction technicians,

— Valid documents for disposing with machinists and drivers of heavy vehicles and a copy of M1/M2 for the same,

— A description of the technical equipment and capacity of the economic operator, measures to ensure quality and its equipment and capacity for testing and research,

— Statement on the disposal of the equipment referred to in sub-Article 2.5.1 for the entire duration of the contract,

— Proof of possession of an asphalt base or a contract with a legal entity that possesses an asphalt base for disposal with the asphalt base for the entire duration of the contract,

— Report on the elements of the Agreement which the economic operator intends to subcontract to third parties.

2.5.3 The technical and professional capacity of the economic operator may be supported by another entity, regardless of the legal relations between the economic operator and that entity, except in the part of the reference list and the previously concluded contracts. If the economic operator proves its technical and professional capacity based on the support from another entity, it is obliged to prove the support with a valid proof that that entity will make the proper technical and professional resources available to the economic operator. The entity providing the technical and professional support must not be imposed a final judgment for participation in a criminal organization, corruption, fraud or money laundering.

2.5.4 If the economic operators submit a bid as a group of economic operators, the technical and professional capacity is proven by taking into consideration the resources of all group members. If the group of economic operators acts with the technical and professional support from a third entity, the technical and professional capacity is proven according to the aforementioned.
