Способност за вршење на стручната дејност:
Any bidder shall be excluded from the procedure if it(he):
In the last 5 years has been rendered a final decision for participation in a criminal organization, corruption, fraud or money laundering;
— is in the process of bankruptcy or liquidation proceedings,
— has unpaid taxes, contributions and other duties except if the bidder is granted payment of taxes, contributions and other duties in accordance with special regulations,
— has been sentenced sanction — ban on performing profession, activity or duty, i.e. temporary prohibition for performing certain activities,
— has been sentenced additional punishment — ban on participation in procedures for public announcement, the award of public supply contracts and public private partnership,
— has been sentenced additional temporary or permanent prohibition to perform certain activities; and,
— gives false information or does not submit the data required by the public partner.
In order to prove the personal condition, the economic operator should submit the following documents:
— Statement by the economic operator that it has not been announced, in the last 5 years efective court decision for participation in a criminal organization, corruption, fraud or money laundering,
— confirmation that there is no bankruptcy proceedings by the competent authority,
— confirmation that there is no procedure for liquidation by a competent authority,
— certificate for paid taxes, contributions and other public duties by the competent authority,
— confirmation that it was not sentenced the sanction – ban to perform professional activity or duty, i.e. temporary prohibition for performing certain activity,
— the Contracting Authority shall require from each economic operator to deliver a document for registered activity in order to prove it is registered as a natural person or legal entity to pursue the activity related to the subject-matter of the public procurement contract or a proof that it belongs to a professional association in accordance with the regulations of the country where registered.
