In the excise warehouse/reservoirs on the territory of the Republic of Macedonia, determined with a written order of the Directorate of Compulsory Reserves of Oil and Oil Derivatives as the Contracting Authority.

1) For proving personal status, economic operator should provide the following documents:

— statement by the economic operator that in the previous 5 years, an effective court decision for participation in criminal organization, corruption, fraud or money laundering, has not been announced,

— a Certificate that it is not subject to bankruptcy procedure issued by a competent authority,

— a Certificate that it is not subject to liquidation procedure issued by a competent authority,

— a Certificate for paid taxes, contributions and other public duties by the competent authority in the country where that economic operator is established,

— a Certificate from the Register of penalties for criminal acts committed by legal entities that a secondary penalty…

… ban on participation in procedures for public announcement, the award of public supply contracts and public-private partnership, has not been imposed,

… temporary or permanent prohibition of certain activities has not been imposed and,

— a Certificate that a sanction for misdemeanor with an effective court decision, resulting in prohibition for pursuing professional activity or duty, i.e. temporary prohibition for performing professional activity, it is not being announced.

Professional registration.

To qualify as capable of performing the contract in terms of the ability to perform professional activity, the economic operator should submit a document for registered activity as an evidence that it is registered as a legal entity for performing the activity related to the subject of the contract or evidence that they belong to a professional association in accordance with the regulations of the country where it is registered.

The economic operators must meet the special conditions for the activity prescribed under law pertaining to the subject of the contract - the Energy Law ("Official Gazette" No. 96/18) and the Law on Compulsory Reserves of Oil and Oil Derivatives ("Official Gazette the Republic of Macedonia" No. 84/08, 35/11, 84/12, 43/14 and 83/18).

In order to demonstrate ability to perform professional activities, the economic operators need to submit the following documents:

1) Domestic economic operators should submit:

— document for registered activity (Form DRD) as evidence that they are registered as a legal entity for performing the activity related to the subject of the contract, issued by the Central Registry of the Republic of Macedonia,

— valid license to perform energy activity - wholesale of oil derivative Euro Diesel BS issued by the Energy Regulatory Commission of the Republic of Macedonia,

— valid license for performing energy storage activity of the oil derivative Euro Diesel BS issued by the Energy Regulatory Commission of the Republic of Macedonia.

2) Foreign entities — economic operators should submit:

— document for registered activity as evidence that they are registered as a legal entity for performing the activity related to the subject of the contract or an evidence that they belong to a professional association, issued by a competent authority in accordance with the regulations of the country where it is registered,

— valid license or other appropriate document for performing energy activity —…

… wholesale with oil derivative Euro Diesel BS issued by a competent authority in accordance with the regulations of the country where they are established,

… storage of oil derivative Euro Diesel BS issued by a competent authority in accordance with the regulations of the country where they are registered".

Економска и финансиска состојба:

The economic operator proves the fulfillment of the minimum requirement about its economic and financial ability by submitting one or more of the following documents:

— report on the income statement certified by a competent authority, i.e. audited income statement or extracts from the balance of success, where publication of the balance sheet is required under the law of the country in which the economic operator is established for the last financial year,

— statement of the total turnover (data from the income statement issued by a competent authority, i.e. audited income statement) and, where appropriate, of turnover in the area covered by the contract for the last financial year for which they are available such information depending on the date on which the company was founded or started work and depending on the availability of such information".

If the income statement was subject to commercial audit, the economic operator may submit it as evidence that it meets the minimum requirement for determining the economic and financial ability without being certified by a competent authority.

If the income statement was not subject to commercial audit, the economic operator shall submit the same certified or issued by a competent authority as evidence that it meets the minimum requirement for determining the economic and financial ability. The competent authority in the Republic of Macedonia is the Central Registry of the Republic of Macedonia.

Минимално ниво(а) на стандарди:

The economic operator must meet the following minimum requirements in order to qualify as capable of performing the contract for public procurement in terms of its economic and financial ability:

— to have achieved revenue totaling 20 000 000,00 MKD in the last financial year".

If the economic operator performs the business activity in a period less than 3 years, a minimum requirement for determining its economic and financial ability is the economic operator to have achieved above requirement in the years in which data exists.

Техничка и професионална способност:

The economic operator proves the fulfillment of the minimum requirements about its technical capacity by submitting:

— copies of car licenses or contracts for rented tanker trucks and/or railway tank wagons which have been concluded for a period not shorter than the period of validity of the bid that should contain data from car licenses for leased tanker trucks and / or railway tank wagons,

— copies of at least three (3) concluded contracts for delivery of oil derivatives in the last 3 years, with individual value not less than 1 500 000,00 MKD, with provided certificates for deliveries issued by the recipients or, if such certificates cannot be provided for reasons beyond the control of the economic operator, only with his statement for performed deliveries,

— the economic operator must submit valid evidence that on the territory of the Republic of Macedonia possesses own and/or leased reservoir capacities for oil derivative Euro Diesel BS, subject of the procurement, for each lot / lots its bid refers to and for which holds a valid excise license issued the Customs Administration of the Republic of Macedonia. In the case of own reservoir capacities adequate evidence is a valid license for performing energy storage activity for the oil derivative Euro diesel BS issued by the Energy Regulatory Commission of the Republic of Macedonia. In the case of leased excise reservoir capacities, acceptable evidence is a lease contract valid for at least 5 years. For foreign entities - economic operators acceptable evidence is a contract for ensured storage warehouse on the territory of Macedonia signed with the holder of a valid excise license issued by the Customs Administration of the Republic of Macedonia and a valid license for performing energy storage activity of the oil derivative Euro Diesel BS, issued by ERC of Republic of Macedonia.

The economic operator must meet the following minimum requirements in order to qualify as capable of performing the contract for public procurement in terms of its technical or professional ability:

— To have at least 5 (five) owned or leased technically correct tank trucks and / or railway tank wagons for transportation of light oil derivatives, which must meet the conditions laid down by the regulations on safety of vehicles and special technical - exploitation conditions prescribed for transport of oil derivatives and should possess relevant documents determined according to the current legislation in the Republic of Macedonia (Law on the carriage of dangerous goods by road and rail traffic "Official Gazette of the Republic Macedonia "No. 92/07, 147/08, 161/09, 127/10, 17/11, 54/11, 13/13, 163/13, 38/14, 166/14, 116/15, 193 / 15, 31/16 and 64/18),

— Minimum three (3) concluded contracts for delivery of liquid fuels in the last 3 years, with individual value not less than 1 500 000,00 MKD,

— The economic operator must provide own and / or rented excise reservoir capacity for the respective oil derivative Euro Diesel BS on the territory of the Republic of Macedonia, for as many Lots, its bid refers to.

Извршување на договорот

1) Statement about the steadiness of the bid;

2) Performance guarantee (5 % of the total contract value).

In order to sign the contract with the selected most favorable economic operator, the successful bidder shall be required to provide a contract performance bank guarantee in the amount of 5 % of the contract value;

3) Statement for independent bid.

A group of economic operators shall have the right to submit a bid without an obligation to form any legally appropriate association. The Contracting Authority shall not require the group of bidders to be associated in an appropriate legal form if the group is selected as the carrier of the procurement.

Any interested person can attend the public bid opening on 3.12.2018 (at 11:00 A.M. local time). Only the authorized representatives of the bidders can participate in the procedure of the public bid opening by providing their comments in the minutes of the bid opening,
