In order to prove its personal condition the economic operator is obliged to submit the following documents:

— Statement of the economic operator that in the past five years it was not rendered a final judgment for participation in criminal organization, corruption, fraud or money laundering,

— Confirmation by a competent organ that a…

… bankruptcy procedure was not opened,

… liquidation procedure was not opened,

— Confirmation for paid taxes, contributions and other public duties by a competent organ in the country where the economic operator was registered,

— Certificate from the Registry of penalties for crimes committed by legal persons that minor penalty ban on participation in public tender procedures, awarding contracts and agreements for public-private partnership has not been imposed on him,

— certificate from the Registry of penalties for crimes committed by legal persons that a minor penalty for temporary or permanent prohibition of a specific activity has not been imposed over him,

— confirmation that a final judgment - prohibition of professional activity or duty, i.e. temporary prohibition for performing professional activity has not been imposed over him.

Capacity for performing professional activity of economic operator:

Document for registered activity

1.In order to prove its capacity for performing professional activity, the economic operator should submit a document for registered activity as an evidence that is registered as natural or legal entity for performing the activity related to the public procurement subject or an evidence that is a member of a relevant professional association in accordance to the regulations of the country where it is registered. Evidence issued by a competent organ for meeting the special conditions for performing the activity prescribed by law, related to the contract subject. The bidder shall obligatory own and submit a license for performing energy activity, wholesale of oil and oil derivatives issued by the Energy Regulatory Commission of the Republic of Macedonia.

Necessary documents to prove the economic condition of the economic operator:

1. Statement of the wholesale turnover of the company (data from the income statement issued by a competent organ, i.e. revised income statement), and where relevant, from the turnover in the field covered by the public procurement contract, at most for the last three financial years for which such data are available, depending on the date when the company was established or started operation and depending on the availability of such data.

2. If the balance sheet and income statement were subject to commercial audit, the economic operator may submit those as evidence that it meets the minimum condition for determining the economic and financial condition, without having them additionally certified by a competent organ.

3. If the balance sheet and income statement were not subject to commercial audit, the economic operator shall submit them certified, i.e. issued by a competent organ, as an evidence that it meets the minimum condition for determining the economic and financial condition. The competent organ in the Republic of Macedonia is the Central Register of the Republic of Macedonia.

4. The economic and financial condition of the economic operator may be supported by another entity, regardless of the legal relations between them, except when it comes to the data if the income statement. If the economic operator proves its economic and financial condition referring to a support of another entity, it is obliged to prove the support by a valid evidence that the other entity will put at its disposal the relevant financial means. The subject providing such financial support must not be pronounced with a final verdict for participation in a criminal organization, corruption, fraud or money laundry.

5. If economic operators submit bid as group of economic operators, the economic and financial condition is proved by taking into account the resources of all members of the group. If the group of economic operators participates with financial support by a third subject, the economic and financial condition is determined in accordance to the above stated.

Минимално ниво(а) на стандарди:

To have a realized income not less than the estimated value of the procurement in at least 1 of the last 3 years. If the economic operator performs it activity in a period of less than 3 years, the minimum condition for determining the economic and financial condition is that the economic operator has met the condition of paragraph 1 in the years for which there are available data.

Техничка и професионална способност:

List of successfully realized contracts related to procurement subject in the last 3 years, with contract values, dates of conclusion, buyers (contracting organs or economic operators), by providing a confirmations for made deliveries issued by the beneficiaries, or if such confirmations may not be obtained, due to reasons out of control of the economic provided, only its statement for deliveries made.
