2.2 Personal condition

2.2.1 The contracting authority shall exclude any economic operator from the proceedings for awarding a public contract in the following cases:

— it has been rendered a verdict for participation in a criminal organisation, corruption, fraud or money laundering in the last 5 years,

— it has been sentenced with a minor penalty: ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership,

— it has been sentenced with a minor penalty for temporary or permanent prohibition to perform a specific activity,

— it is in bankruptcy or liquidation proceedings,

— it has unpaid taxes and other public charges, unless the economic operator is authorised to make deferred payment of taxes, contributions and other public duties in accordance with relevant regulations and if he is regular payer,

— prohibition sanction to perform professional activity or duty is pronounced to the economic operator, i.e. temporary prohibition for performing professional activity; and

— it provides false information or fails to submit the information requested by the contracting authority.

2.2.2 In order to prove its personal condition, the economic operator shall submit the following documents:

— A declaration by the economic operator that he was not rendered a verdict for participation in a criminal organisation, corruption, fraud or money laundering in the last 5 years,

— confirmation that there are no bankruptcy proceedings undertaken by the competent authority,

— confirmation that there is no liquidation procedure undertaken by the competent authority,

— receipt for paid taxes, contributions and other public duties by the competent authority of the country where the economic operator is established,

— certificate from the Registry of penalties for crimes committed by legal persons that minor penalty…

… - ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership - has not been imposed,

… for temporary or permanent prohibition of a specific activity has not been imposed,

— confirmation that the final sentence has not been imposed as a crime sanction that prohibits performing professional activity or duty, i.e. temporary prohibition for performing specific activity.

2.2.3 The statement in indent 1 of subsection 2.2.2 shall be prepared and signed by the economic operator and it does not have to be certified by a competent authority.

2.2.4 The confirmations that there are no bankruptcy proceedings and liquidation proceedings, as well as the certificates from the Register of penalties for criminal acts in indents 5 and 6 of subsection 2.2.2, shall be issued by competent authorities in the country in which the economic operator is established. In the Republic of Macedonia, the body responsible for issuing these certificates is the Central Registry of the Republic of Macedonia.

2.2.5 The receipt for paid taxes, contributions and other charges shall be issued by a competent authority of the country in which the economic operator is established. In the Republic of Macedonia, the authority to issue such certificates is the Public Revenue Office.

2.2.6 The receipt in indent 7 of subsection 2.2.2 shall be issued by the competent authority in the country in which the economic operator is established. In the Republic of Macedonia, the authority to issue this certificate is the Central Registry of the Republic of Macedonia.

2.2.7 The documents referred to in sub- item 2.2.2 must not be older than six (6) months from the deadline for submission of bids, and they shall be submitted in an original and copy certified by the economic operator.

2.2.8 If the country in which the economic operator is registered does not issue the documents referred to in sub-item 2.2.2 or if they do not encompass all the cases mentioned above, the economic operator may submit a statement certified by a competent authority

2.3 Capability to perform professional activity

2.3.1 In order to prove the ability for performing of its professional activity, the economic operator should submit a document for its registered activity as a proof that it is registered as a physical or legal entity for performance related to the subject of the contract for public procurement, or a proof that it belongs to an appropriate professional association in accordance with the regulations of the country where it is registered.

2.3.2. In order to prove its ability for performing professional activity, the economic operator shall submit the following documents:

— Document for registered activity as a proof that it is registered as a physical or legal entity for performance related to the subject of the contract for public procurement, or a proof that it belongs to an appropriate professional association in accordance with the regulations of the country where it is registered.

Техничка и професионална способност:

— Technical ability to use the system for electronic (non-cash) payment; and

— to have available, i.e. to ensure a minimum of one petrol station on the territory of the city of Skopje, and a minimum of one petrol station in the area of each of the following municipalities: Ohrid, Bitola, Gevgelija, Stip, Kumanovo, Veles, Tetovo, Prilep, Strumica, Kocani, Berovo, Valandovo, Vinica, Negotino, Gostivar, Delchevo, Kavadarci, Kriva Palanka, Krusevo, Struga, Sveti Nikole, Probishtip, Radovish, Resen, Demir Hisar, Makedonski Brod, Kratovo, Debar and Kicevo, in which the contracting authority has regional offices.

Минимално ниво(а) на стандарди:

— A statement for use of the system for electronic payment; and

— statement for availability, i.e.provision of minimum one petrol station on the territory of the city of Skopje, and minimum one petrol station in the area of each of the following municipalities: Ohrid, Bitola, Gevgelija, Stip, Kumanovo, Veles, Tetovo, Prilep, Strumica, Kocani, Berovo, Valandovo, Vinica, Negotino, Gostivar, Delchevo, Kavadarci, Kriva Palanka, Krusevo, Struga, Sveti Nikole, Probishtip, Radovish, Resen, Demir Hisar, Makedonski Brod, Kratovo, Debar and Kicevo,

— a list of petrol stations, with the number and the location for the city of Skopje and the municipalities referred to in indent 2 of this paragraph.

2.4.3 The documents stated in item 2.4.2. shall be prepared and electronically signed by the economic operator and they do not need to be certified by the competent authority.

2.4.4 The technical and professional ability of the economic operator can be supported by another entity, regardless of legal relations between the economic operator and that entity, except in the section of the reference list and the previously concluded contracts. If the economic operator proves its technical and professional capability referring to the support from another entity, it is obliged to prove the support with valid proof that the entity shall put at the disposal of the economic operator the adequate technical and professional resources. Final judgement for participation in criminal organisation, corruption, fraud or money laundering may not be rendered against the entity that provides the technical or professional support.

2.4.5 If the economic operators submit an offer as a group of economic operators, the technical and professional ability is demonstrated by taking into consideration the resources of all the members of the group. If the group of economic operators acts with the technical or professional support by a third entity or third entities, the technical and professional capability is determined in accordance with the above stated.
