Public Call for Submission of the Applications for Granting of Financial Support to Domestic and Foreign Airlines

Pursuant to Article 38-a of the Law on Aviation (Official Gazette of the Republic of Macedonia No. 14/06, 24/07, 103/08, 67/10, 24/12, 80/12, 155/12, 42/14, 97/15, 152/15, 27/16, 31/16 and 64/18) and Articles 9 and 13 of the Decree on the method, the detailed criteria for awarding financial support to domestic and foreign air carriers and the necessary documentation to be submitted by the users of the financial support ("Official Gazette of the Republic of Macedonia" No. 205/18), the Commission for the implementation of the procedure for awarding financial support announces.

Public call.

For submitting a request for awarding financial support.

1) Financial support provider is the Government of the Republic of Macedonia, through the Ministry of Transport and Communications;

2) Subject of the procedure is awarding financial support to domestic and foreign air carriers;

3) Awarding of the financial support is done through a public call, as a procedure for conducting a public call for awarding financial support;

4) The validity period of the request letter is 30 days from the day of public opening of the requests;

5) The documentation for a request for participation in the procedure for awarding financial support can be obtained every working day from 10:00 to 15:00 local time, at the Ministry of Transport and Communications on ul. Dame Gruev 6, 1000 Skopje, Republic of Macedonia, in the course of duration of this call;

6) The deadline for submission of the request for participation in the procedure for awarding financial support is 21.12.2018 (Friday) until 12:00 local time, in the archive of the Ministry of Transport and Communications;

7) The language in which the documentation for a request for participation in the procedure for awarding financial support is to be submitted is the Macedonian or English language with a certified translation into the Macedonian language (by Swarn translator);

8) The public opening will be held on 21.12.2018 (Friday) at 12:00 local time at the location indicated in the documentation for a request. Persons authorized to participate in the public opening are those who will be authorized by the applicants;

9) The evidence and documentation that the applicant needs to prove its personal situation, professional activity, economic and financial standing and technical or professional ability are given in the documentation for a request;

10) The financial support will be awarded on the basis of the following criteria:

— the applicant for the financial support is required to have a certificate for fulfillment of the safety requirements to perform public air transport (Air Operator Certificate-AOC),

— the applicant for the financial support is required to have transported, i.e to have served at least 10 million passengers in 2017,

— the applicant for the financial support should have realized profit of at least 25 000 000,00 (twenty five million) EUR in 2017

— the applicant for the financial support is required to submit a notarized statement that it will meet the requirements referred to in Article 21 of the Regulation on the method, the detailed criteria for awarding financial support to domestic and foreign air carriers and the necessary documentation that should be provided by the beneficiaries of the financial support ("Official Gazette of the Republic of Macedonia" No. 205 /18), and

— the applicant for the financial support to realize the requirements given in the documentation for a request.

11) The beneficiary of the financial support should fulfill the following obligations:

— not later than 26.3.2019, to establish and/or maintain a base of at least one airplane (aircraft) at one of the airports in the Republic of Macedonia for the period for which the financial support is awarded,

— not later than 26

— to start operating at least 4 new destinations from the airport "St. Apostle Paul " — Ohrid, the first 2 by 26.3.2019, and the rest within a year from the date of conclusion of the Agreement and to serve them for the period for which the financial support is awarded,

— the offered new destinations for "International Airport Skopje" must not coincide with the offered new destinations for the airport "St. Apostle Paul " — Ohrid,

— any new destination introduced from the airport "International Airport Skopje" and from the airport "St. Apostle Paul "- Ohrid for the period for which the financial support that is the subject of the financial support to be continuously served at least twice a week in any of the IATA seasons according to a predetermined flight schedule from its introduction to the end of the period for which the financial support is awarded, except for the week in which the New Year and the religious holidays, Catholic and Orthodox Christmas, fall,

— any new destination introduced for the period for which the financial support is awarded, subject to a financial support, and which will be operated from the airport "International Airport Skopje", if not served by regular air services in the last two IATA seasons from/to the "International Airport Skopje",

— any new destination introduced for the period for which the financial support is awarded, subject to a financial support, and which will be operated from the airport "St. Apostle Paul " — Ohrid, if not served by regular air services in the last two IATA seasons from/to the airport "St. Apostle Paul " — Ohrid,

— the beneficiary of the financial support to develop a plan for promotion and marketing. The plan for promotion and marketing may be subject to changes after indications given by the provider of the financial support,

— the Beneficiary of the financial support shall submit a report concerning its operations to the Ministry of Transport and Communications every 6 months.

12) The financial support provider shall allocate:

(1) One-time financial support amounting to 40 000,00 EUR, equivalent value in denars, for each new destination introduced for the period for which the financial support is awarded from the airport "International Airport Skopje" and the airport "St. Apostle Paul"- Ohrid;

(2) Financial support shall be awarded for each new destination introduced from the airport "International Airport Skopje" within the period for which the financial support is awarded, amounting to:

— 9 EUR in equivalent value in denars per a passenger at departure in the first year of the Financial Support Agreement,

— 8 EUR in equivalent value in denars per a passenger at departure in the second year of the Financial Support Agreement and

— 7 EUR in equivalent value in denars per a passenger at departure in the third year of the Financial Support Agreement

(3) Financial support shall be awarded for each new destination introduced from the airport "St. Apostle Paul" - Ohrid within the period for which the financial support is awarded, amounting to:

— 13 EUR in equivalent value in denars per a passenger at departure in the first year of the Financial Support Agreement,

— 12 EUR in equivalent value in denars per a passenger at departure in the second year of the Financial Support Agreement, and

— 11 EUR in equivalent value in denars per a passenger at departure in the third year of the Financial Support Agreement.

Note: The one-time financial support will not be paid for a new destination that has been a substitute for a new destination for which the one-time financial support has already been paid.

13) The financial support will be awarded to the applicant who will offer largest number of new destinations that have not been served for the airport "International Airport Skopje" by regular air transport services in the last 2 IATA seasons and for the airport "St. Apostle Paul "- Ohrid have not served by regular air transport services in the last two IATA seasons.

In case two or more applicants offer the same number of destinations they will operate from/to the airports "International Airport Skopje" and "St. Apostle Paul "- Ohrid, the financial support will be awarded to the applicant who will offer a larger number of weekly frequencies to the destinations they will operate from/to the airports of "International Airport Skopje" and "St. Apostle Paul "- Ohrid.

In case two or more applicants offer the same number of weekly frequencies to the destinations they will operate from/to the airports of "International Airport Skopje" and "St. Apostle Paul " — Ohrid, the financial support will be awarded to the applicant in accordance with the principle of priority when submitting the request for awarding financial support.

14) The financial support shall be awarded until the funds established in the Program for determination of funds necessary for awarding financial support for encouraging and developing of the air transport in the Republic of Macedonia to domestic and foreign carriers for the period from 2019 to 2022 ("Official Gazette of the Republic of Macedonia" No. 205/18);

15) Within ten working days from the day of the public opening, the Commission for carrying out the procedure for awarding financial support shall evaluate the requests for awarding financial support;

16) The day of announcing the public call in the Official Gazette of the Republic of Macedonia shall be considered as the day of commencement of the procedure for granting financial support.

The financial support shall be awarded until the funds established in the Program for determination of funds necessary for awarding financial support for encouraging and developing of the air transport in the Republic of Macedonia to domestic and foreign carriers for the period from 2019 to 2022 ("Official Gazette of the Republic of Macedonia" No. 205/18).
