2.2.1) The Contracting Authority shall exclude any economic operator from the proceedings for awarding a public contract in the following cases:

— it has been rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering in the last 5 years,

— it is in bankruptcy or liquidation proceedings,

— it has unpaid taxes and other public charges, unless the economic operator is authorized to make deferred payment of taxes, contributions and other public duties in accordance with relevant regulations and if he is regular payer,

— it has been sentenced with a minor penalty: ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership,

— it has been sentenced with a minor penalty for temporary or permanent prohibition to perform a specific activity,

— prohibition sanction to perform professional activity or duty is pronounced to the economic operator, i.e. temporary prohibition for performing professional activity and

— it provides false information or fails to submit the information requested by the Contracting Authority.

2.2.2) In order to prove its personal condition, the economic operator shall submit the following documents:

— a declaration by the economic operator that he was not rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering in the last 5 years,

— confirmation that there are no bankruptcy proceedings undertaken by the competent authority,

— confirmation that there is no liquidation procedure undertaken by the competent authority,

— receipt for paid taxes, contributions and other public duties by the competent authority of the country where the economic operator is established,

— certificate from the registry of penalties for crimes committed by legal persons that minor penalty…

… — ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership — has not been imposed,

… for temporary or permanent prohibition of a specific activity has not been imposed,

— confirmation that the final sentence has not been imposed as a crime sanction that prohibits performing professional activity or duty, i.e. temporary prohibition for performing specific activity.

2.3.1) In order to prove the ability to perform a professional activity, the economic operator should submit a document for registered activity as evidence that it is registered as a natural or legal person for performing the activity related to the subject of the public procurement contract or evidence that it belongs to an appropriate professional association in accordance with the regulations of the country where it is registered.

According to Article 148 paragraph 2 of the PPL in determining the ability to perform professional activity of the economic operators, the Contracting Authority also requires evidence issued by a competent authority to fulfill the conditions for performing the activity prescribed in accordance with the law that relate to the subject of the contract, that is, License B for a contractor of second category construction.

2.3.2) To prove the ability to perform a professional activity, the economic operator shall submit the following documents:

— a document for registered activity as evidence that it is registered as a natural or legal person for performing the activity related to the subject of the public procurement contract or evidence that it belongs to an appropriate professional association in accordance with the regulations of the country where it is registered, as well as License B for contractor of second category construction.

Економска и финансиска состојба:

2.4) Economic and financial situation

2.4.1) In order to qualify as capable of carrying out the relevant public procurement contract in terms of its economic and financial standing, the economic operator must meet the following minimum requirements:

to have a minimum annual turnover of 75 000 000 MKD in each of the last three years and a positive balance of success in the last 3 years.

2.4.2) If the economic operator performs the activity for a period of less than 3 years, the minimum condition for determining the economic and financial condition is that the economic operator has fulfilled the requirement in sub-section 2.4.1 in the years for which data exist.

2.4.3) The economic operator shall prove the fulfillment of the minimum requirement of sub-section 2.4.1 or 2.4.2 by submitting the report on the balance sheet certified by a competent authority, is revised balance sheet or excerpts from the balance sheet report in cases when the publication of the balance sheet is prescribed by law in the country where the economic operator is registered, an extract from the overall turnover of the enterprise (data from the profit and loss account issued by a competent authority, is revised profit and loss account) and, where appropriate, from the turnover in the area covered by the public procurement contract, mostly for the last 3 financial years for which such information is available, depending on the date on which the enterprise was established or started operating and depending on the availability of such information.

2.4.4) If the balance sheets and successes have been subject to commercial revision, the economic operator may submit them as evidence that they meet the minimum condition for determining the economic and financial situation without being further certified by a competent authority;

2.4.5) If the balance sheet and the profit and loss statements were not subject to commercial revision, the economic operator shall submit the same certified or issued by a competent authority as evidence that it meets the minimum condition for determining the economic and financial situation. The competent authority in the Republic of Macedonia is the Central Registry of the Republic of Macedonia;

2.4.6) The economic and financial capability of the economic operator may be supported by another entity, regardless of the legal relations between the economic operator and that entity, except in the case of the data from the profit and loss account. If the economic operator proves its economic and financial capacity, referring to the support of another entity, it is obliged to prove the support with valid evidence that that entity will make available the appropriate financial means to the economic operator. Against the entity providing the financial support, a final judgment for participation in a criminal organization, corruption, fraud or money laundering must not be pronounced;

2.4.7) If economic operators submit a bid as a group of economic operators, the economic and financial standing is proven by taking into account the resources of all members of the group. If the group of economic operators acts with financial support from a third entity, the economic and financial standing is determined in accordance with the aforementioned.

2.5.1) In order to qualify as capable of carrying out the relevant public procurement contract in terms of its technical or professional capability, the economic operator must meet the following minimum requirements:

— at least 2 (two) realized contracts for derived pump stations (performed mechanical installations and electrical installations of pumping stations for irrigation, drainage, water supply, waste fecal waters and atmospheric waters) in the last 5 (five) years of which min:

— one signed and realized contract for a pumped station with a capacity of min.…

— The economic operator shall have employed or engaged at least 3 (three) engineers with an Authorization B for a performance engineer, as follows: at least -1 (one) engineer for performance in the field of “mechanical engineering”, 1 (one) engineer for construction from the field “electrical engineering" and 1 (one) construction engineer from the “construction" field:

— the economic operator must have employed or engaged at least 1 (one) professional for safety at work with certificate for passed professional exam,

— to have an employed or engaged licensed welder for steel elements with a thickness of the element of minimum 10 mm

Минимално ниво(а) на стандарди:

2.5.2) The economic operator shall prove the fulfillment of the minimum requirements of sub-item 2.5.1 by submitting:

— report list of works performed in the last 5 years with submission of certificates for satisfactory performance of the most important works, certificates including the value, time and location of performance of the works the capacity of the pumping station and allegations whether the works are performed in accordance with the rules of business and whether they are properly completed,

— the economic operator should submit a statement for…

… the engaged technical personnel, regardless of whether they directly belong to the economic operator with attachments of authorizations B for 3 (three) civil engineering engineers for performance, of which at least 1 (one) construction engineer in the area of mechanical engineering, 1 (one) engineering engineer in the field of electrical engineering and 1 (one) construction engineer in the field of construction,

… an engaged expert for safety at work, regardless of whether it directly belongs to the economic operator with an attachment — Certificate for passed professional exam,

— the economic operator shall enclose a statement that he has employed or engaged at least 1 (one) expert for a licensed welder for steel elements with a thickness of elements of minimum 10 mm with attached certificate (certificate, certificate) for the capacity of a welder issued by an authorized legal entity,

— reporting on the elements of the contract that the economic operator intends to give to the subcontractor.

2.5.3) The statements and all documents prepared by the economic operator shall be prepared and electronically signed by the economic operator itself and they must not be certified by a competent authority.

2.5.4) The technical and professional capability of the economic operator may be supported by another entity, regardless of the legal relationships between the economic operator and that entity, except in the part of the reference list and the previously concluded contracts. If the economic operator proves its technical and professional capability by referring to the support of another entity, it is obliged to prove the support with valid evidence that that entity will make available the relevant technical and professional resources to the economic operator. Against the entity providing technical or professional support, a final judgment for participation in a criminal organization, corruption, fraud or money laundering must not be pronounced.

2.5.5) If economic operators submit a bid as a group of economic operators, the technical and professional capability is proven by taking into account the resources of all members of the group. If the group of economic operators performs technical or professional support from a third entity or third parties, the technical and professional capability shall be determined in accordance with the foregoing.
