2.2 Personal status:

2.2.1 The Contracting Authority shall exclude from the procedure for awarding a public procurement contract any economic operator who:

— within the last 5 years has had effective sentence for participation in a criminal organization, corruption, fraud or money laundering,

— has imposed a penalty on participation in public bidding procedures, awarding public procurement contracts and contracts for public private partnership,

— it has imposed a temporary or permanent ban on performing certain activities,

— is in bankruptcy or liquidation proceedings,

— failed to pay taxes and other public charges, unless the economic operator has been granted deferred payment of taxes,

— has a misdemeanor sanction for prohibition to perform a profession, activity or duty, or prohibition to perform certain activity,

— Gives false information or fails to provide information requested by the Contracting Authority.

2.2.2 To prove its personal status the economic operator shall submit the following documents:

— statement of the economic operator that no effective verdict has been issued against the economic operator within the past 5 years for participation in a crime organization, corruption, fraud or money laundering,

— confirmation stating that no bankruptcy procedure has been initiated by a competent body,

— confirmation stating that no liquidation procedure has been initiated by a competent body,

— certificate of paid taxes, benefits and other public duties issued by a competent body in the country where the economic operator is registered,

— confirmation from the Register of penalties for committed criminal offenses of legal entities proving that no secondary penalty —…

… ban on participating in open call procedures, awarding public procurement contracts and contracts on public — private partnership has been pronounced,

… temporary or permanent ban on performing particular activity has been pronounced,

— confirmation stating that no misdemeanour sanction — ban on the performance of the profession, activity or duty, i.e. temporary ban on the performance of a particular activity has been pronounced with an effective verdict.

2.2.3 The statement mentioned in paragraph 1 item 2.2.2 is prepared and signed by the economic operator and it does not have to be certified by a competent authority.

2.2.4 Confirmations stating that no bankruptcy and liquidation procedure has been initiated, as well as the certificates from the Registry of penalties for committed criminal offenses of legal entities proving that no penalty mentioned in paragraphs 5 and 6 of item 2.2.2 are issued by competent authorities in the country where it is registered. In Macedonia the competent authority for issuing such certificates is the Central Registry of the Republic of Macedonia.

2.2.5 The confirmation of paid taxes and other charges is being issued by the competent authority in the country where it is registered. Macedonian competent authority to issue such certificates it the Public revenue office.

2.2.6 The confirmation mentioned in paragraph 7 item 2.2.2 is being issued by the competent authority in the country where it is registered. In Macedonia the competent authority for issuing such certificates is the Central Registry of Macedonia.

2.2.7 The documents mentioned in item 2.2.2 must not be older than 6 months from the deadline for submission of bids.

The Commission will accept documents for determining the personal status issued after the public opening of tenders, but not later than the date of the decision for selecting the best offer.

2.2.8 If the country in which the economic operator is registered does not issue the documents mentioned in item 2.2.2, or if they do not cover all the above cases, the economic operator may submit a statement certified by a competent authority.

2.3 Capability to perform professional activity 2.3.1 To prove the capability to perform professional activity, the economic operator should submit a document for registered activity as a proof that it is registered as a legal entity for performing the activity related to the subject of the public procurement contract or evidence that belongs to a professional association in accordance with the regulations of the country where it is registered.

2.4 Technical or professional capability.

2.4.1 To qualify as capable of performing the contract for public procurement in terms of its technical or professional capability, the economic operator must meet the following minimum requirements:

— to ensure conditions for safe keeping, storing, transportation and handling the vaccines, according the Regulations regarding the subject of the request and the closer conditions on the space, equipment and staff for issuing authorization for obtaining a wholesale license for medicines (“Official Gazette of the Republic of Macedonia” N 151/08).

2.3.2 To prove the specific conditions for conducting activities prescribed under the law and regulations regarding the subject of the request and the closer conditions on the space, equipment and staff for issuing authorization for obtaining a wholesale license for medicines “Official Gazette of the Republic of Macedonia” N 151/08, and which concern the subject of the contract, the economic operator must submit a Document/ Decision of the Macedonian Agency for medicines and medical devices for performing activity – wholesale of medicines.

2.4.2 The economic operator proves the fulfillment of minimum requirements of item 2.4.1 by submitting:

— A statement that it fulfills the conditions for safe keeping, storing, transportation and handling the vaccines, according the Regulations regarding the subject of the request and the closer conditions on the space, equipment and staff for issuing authorization for obtaining a wholesale license for medicines (“Official Gazette of the Republic of Macedonia” N 151/08).
