The contracting authority shall use e-Auction as the final stage of the open procedure. The subject matter of the e-Auction is the total price including all costs and discounts and import duties, excluding VAT. The starting price of the e-Auction is the lowest price from the acceptable bids submitted in the initial phase of the procedure. The invitations for participation in the auction shall be delivered in electronic format via the Electronic Public Procurement System, upon complete evaluation of the initial bids, to all economic operators that submitted acceptable bids in the first phase of the procedure and are registered in the Electronic Public Procurement System. The invitation for participation in the auction shall be sent electronically to the mailbox of the user profile in the Electronic Public Procurement System, to the person that submits a bid for the adequate procedure electronically. The invitation for participation in the auction shall contain the following data: the starting price of the auction, that is, the lowest price from the initially submitted offers, the date and time of commencement and completion of the auction, the interval within which the negative bidding will be conducted (minimum and maximum difference in the offered prices). If only one bid or one acceptable bid is submitted, the contracting authority shall invite the single bidder to submit the final price via the Electronic Public Procurement System. The invitation for submission of the final price shall contain the following data: identification of the part of the bid that will be the subject matter of the final price submission, information that will be made available prior to the final price submission, and the time frame for the final price submission. The single bidder shall submit the final price in the specified time only once; if the bidder fails to submit the final price, the initially offered price shall be deemed final.

In order to prove its personal situation, the economic operator should provide the following documents:

— statement by the economic operator that it was not sentenced in the last 5 years with an effective court decision for participation in criminal organisation, corruption, fraud or money laundering,

— certificate that it is not subject to bankruptcy procedure issued by a competent authority,

— certificate that it is not subject to liquidation procedure issued by a competent authority,

— certificate for paid taxes, contributions and other public duties by the competent authority in the country where that economic operator is registered,

— certificate from the Legal Entities Penal Registry that it has not been imposed a side sanction –…

… prohibition to participate in public competitions, public procurement contract award procedures and public-private partnership award procedures,

… temporary or permanent prohibition to perform a certain professional activity,

— certificate that it has not been sanctioned for misdemeanor with an effective court decision, resulting in prohibition for pursuing an occupation, professional activity or duty, i.e. temporary prohibition to perform a certain professional activity.

Evidence issued by a competent body proving that it meets the special conditions for performing the activity prescribed by the law on construction, which refer to the subject matter of the contract. The economic operator must own License B for carrying out construction works.

Documents on the technical or professional ability of the economic operator:

— employment document (M1/M2 form, work contract or engagement contract),

— list of main deliveries of the bidders completed in the last 5 years (type of building, description, project size) providing certificates for the fulfilled obligations issued by the recipients.

Minimum qualification requirements on the technical and professional state of the economic operator:

In order to qualify as capable of executing the respective public procurement contract in terms of its technical capability, the economic operator must have at least 10 employees available, 4 of whom must be engineers, namely:

(a) Civil Engineer with B Certification for engineer for carrying out construction works issued by the Chamber of Certified Architects and Certified Engineers of the Republic of Macedonia,

(b) Architect with B Certification for engineer for carrying out construction works issued by the Chamber of Certified Architects and Certified Engineers of the Republic of Macedonia,

(c) Mechanical Engineer with B Certification for engineer for carrying out construction works issued by the Chamber of Certified Architects and Certified Engineers of the Republic of Macedonia,

(d) Electrical Engineer with B Certification for engineer for carrying out construction works issued by the Chamber of Certified Architects and Certified Engineers of the Republic of Macedonia.
