In order to prove its personal situation, the economic operator should provide the following documents:

— statement that it was not sentenced in the last 5 years with an effective court judgment for committing a criminal offence referred to in Article 88 paragraph 1 of the Law on Public Procurement,

— certificate that it is not subject to bankruptcy procedure issued by a competent authority,

— certificate that it is not subject to liquidation procedure issued by a competent authority,

— certificate for paid taxes, contributions and other public duties by a competent authority in the country where that economic operator is registered,

— certificate from the legal entities penal registry that it has not been imposed a side sanction –…

… prohibition to participate in public competitions, public procurement contract award procedures and public- private partnership award procedures,

… temporary or permanent prohibition to perform certain professional activity,

— statement of certification that it has not been sanctioned for misdemeanor with an effective court judgment, resulting in prohibition for pursuing an occupation, professional activity or duty, i.e. temporary prohibition to perform certain professional activity

document for registered activity: as a requirement for establishing the ability to perform a professional business activity, the Contracting Authority requests from each economic operator to submit evidence proving that it is registered as a natural person or a legal entity for performing the business activity related to the subject matter of the public procurement or evidence that it belongs to an adequate professional association in compliance with the legislation of the country of registration. For the purposes of establishing the ability of economic operators to perform certain professional business activity, the Contracting Authority also requests evidence issued by a competent body proving that it meets the special conditions for performing the activity prescribed by law, which refer to the subject matter of the public procurement, i.e. License B for carrying out construction works.

Technical or professional ability of the economic operator:

— with a description of the technical staff and technical bodies that are to participate in the performing of the public procurement, especially those responsible for quality control, and, in case of public procurement of works, those that are to be involved in the carrying out of the works, regardless of whether they are employed by the economic operator or not: In order to qualify as capable of executing the respective public procurement contract in terms of its technical staff, the economic operator must have at least ten employees available, 4 of whom must be engineers, namely:

(a) civil engineer with B certification for engineer for carrying out construction works issued by the chamber of certified architects and certified engineers of the Republic of Macedonia;

(b) architect with B certification for engineer for carrying out construction works issued by the chamber of certified architects and certified engineers of the Republic of Macedonia;

(c) mechanical engineer with B certification for engineer for carrying out construction works issued by the chamber of certified architects and certified engineers of the Republic of Macedonia;

(d) electrical engineer with B Certification for engineer for carrying out construction works issued by the chamber of certified architects and certified engineers of the Republic of Macedonia.

— with a list of works carried out within the last 5 years, with certificates of satisfactory performance for the most important works. With the aim of ensuring an adequate level of competition, if necessary, the Contracting Authority may take into account evidence of works carried out more than 5 years ago, which would be specified in the tender documentation: In order to qualify as capable of executing the respective public procurement contract in terms of its technical and professional eligibility, the economic operator must have concluded at least 3 contracts within the past 5 years with similar content and value as the required ones.
