Краток опис:

The public procurement contract shall be awarded by applying an open procedure ending with electronic auction as the last phase in the procedure.Specific methods for public procurement contract award. This procedure shall end with awarding of a framework agreement. The framework agreement shall be concluded for a duration of 1 (one) year. The framework agreement shall be concluded with 5 (five) tenderers, at the most, who shall meet the requirements prescribed with the tender documentation as follows:

— with 5 (five) best ranked tenderers, at the most, (lowest total prices for the contract subject) following the final evaluation after the opening of the initial tenders.

The total value of all separate contracts resulting from the framework agreement shall not exceed the value envisaged for the framework agreement.for each separate public procurement contract (phase), the contracting authority shall submit a request through the EPPS for submission of tenders to all economic operators who are a party to the framework agreement;

— the contracting authority shall define an appropriate deadline for the tenders which shall not be shorter than eight working days, whilst taking into account the contract subject and the time required to prepare and submit the tenders,

— the tenders shall be submitted through the EPPS, and the contracting authority shall open them within the defined deadline,

— following the tender opening within the defined timeframe, e-auction shall be conducted, followed by selection of the most advantageous tender based on the selection criterion lowest price.

Способност за вршење на стручната дејност:

— document for registered activity establishing that the operator is registered as a natural person or a legal entity to perform the activity related to the public procurement contract subject or proof of membership to an appropriate professional association in accordance with the regulations of the country of registration of the respective economic operator,

— license (B) for execution of buildings of the second (II) category issued by the competent authority of the country pursuant with the law on construction. The competent authority in the Republic of North Macedonia is the Ministry of Transport and Communications. Note: The provisions of the Law on Construction (Official Gazette of the Republic of Macedonia No 130/2009, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14, 115/14, 149/14, 187/14, 44/15, 129/15, 217/15,226/15, 30/16, 31/16, 39/16, 71/16,132/2016,35/2018, 64/2018 and 168/2018) shall apply for issuance, withdrawal, validity of licenses, license of a foreign legal entity.

Standards for quality systems: ISO 9001:2015 or equivalent

— proof for possession of a valid certificate for implemented and maintained quality system: ISO 9001:2015 or equivalent,

— environmental management standards: ISO 14001:2015 or equivalent,

— proof for possession of a valid certificate for implemented and maintained quality system: ISO 14001:2015 or equivalent.

Економска и финансиска состојба:

To prove the personal standing, the economic operator shall submit the following documents

— statement indicating that no legally valid judgment for committed criminal act referred to in Article 88 paragraph 1 of the PPL has been pronounced against them in the last 5 years,

— confirmation that there is no open bankruptcy procedure by a competent authority,

— confirmation that there is no open liquidation procedure by a competent authority,

— confirmation of paid taxes, contributions and other public dues issued by a competent authority in the country of registration of the economic operator,

— confirmation from the registry of penalties for committed criminal acts of the legal entities that…

… the economic operator was not pronounced with a second penalty prohibiting the participation in the public call procedures, the public procurement contract award procedures and the public private partnership contract procedures,

… he/she was not pronounced with a second penalty for temporary or permanent prohibiting for performing certain activity,

— confirmation that there is no legally effective judgment imposing a misdemeanor sanction involving prohibition to perform a profession, activity or duty, or temporary prohibition to perform a specific activity, imposed against…

Техничка и професионална способност:

Technical or professional capability of the economic operator

— including a list of works executed during the last 5 years, by submission of a certificate for satisfactory performance of the most important works. For the purposes of securing an appropriate competition level, the contracting authority may, if required, take into account the evidence for executed works more than 5 years ago, as indicated in the tender documentation. To qualify as capable for performing the public procurement contract in subject, in terms of its technical or professional capability, the economic operator shall comply with the following minimal requirements:

— during the last 5 (five) years, they have concluded and realized contracts for construction or reconstruction of streets with execution of asphalt works of minimum 60 000 m

2.6.2. The economic operator shall prove its compliance with the minimal requirements referred to in sub-item 2.6.1. with description of the technical personnel and the technical authorities participating in the realization of the public procurement, as well as of those persons who shall be included in the execution of works regardless whether they are employed with the economic operator, by submitting the following:

— list of executed works, as evidence that during the last 5 (five) years, the economic operator has concluded and realized contracts for construction or reconstruction of streets with execution of asphalt works of minimum 60 000 m

Note: if the commission shall doubt the credibility of the data indicated in the list and the certificate for executed works, it shall reserve the right to request from the economic operator to provide the contracts, construction logbooks for the indicated executed works.
