The subject of the contract is divisible. The economic operator may submit tender for 1, several or all parts of the subject of the public procurement contract. The economic operator may not divide the integral elements of the individual part. For each individual part of the subject of the contract, a separate electronic auction will be conducted through the electronic system for public procurement (https://e-nabavki.gov.mk). Subject of the electronic auction shall be the total price including all the costs and discounts, without VAT for the subject of the public procurement contract. The price of the tender shall also include import duties, if any, and they shall be separately expressed, as well.

The contractor is obligated to deliver the subject of the contract successively depending on the needs of the Contracting Authority, after a prior receipt of the order in writing, verified by an authorized person (via fax or email) as follows: for lots: 1, 2, 3, 4 and 5 within 1 (one) day, after a prior receipt of the order in writing.

The compulsory place of delivery for the Lots 1, 2, 3, 4 and 5 is St. 16 Makedonska brigada No 18, Skopje (asphalt base of PE ‘Streets and Roads’ within the area of the plant ‘Mines and Ironworks’ — Skopje).

The manner, deadline and the place of delivery shall be binding. Each tender containing manner, deadline and place of delivery different from the ones determined in the technical specification shall be considered unacceptable and as such shall be rejected by the Public Procurement Committee.

Способност за вршење на стручната дејност:

4 No modifications to the tender, with the exception of correction of arithmetical errors, shall be requested, offered or allowed by the Committee or by the economic operator..

In case of group of economic operators, all members of the group shall individually prove that there are no reasons for exclusion from the procedure, as well as to prove their capability for performing professional activity. The Contracting Authority shall exclude any economic operator from the procedure for awarding a public procurement contract if:

— an effective court decision for participation in criminal organization, corruption, tax and contributions evasion, terrorism or other offences related to terrorist activities, money laundering and financing terrorism, and exploitation of the child labor and human trafficking was rendered in the past 5 years,

— it has unpaid taxes, contributions or other public fees, unless the economic operator is approved delayed payment of taxes, contributions or other public fees, in accordance with the special regulations and provided that it pays them on regular basis,

— it is under a bankruptcy or liquidation procedure,

— it has been imposed a secondary sentence prohibition on participation in open call procedures. Awarding public procurement contracts and contracts for public private partnership,

— it has been imposed a secondary sentence temporary or permanent prohibition on performing a certain activity,

— it is being pronounced a misdemeanor sanction prohibition on practicing profession, performing activity or duty, i.e. temporary prohibition for performing a particular activity, or

— it presents false information or does not submit the information required by the Contracting Authority,

— it is on the list of issued negative references until the final deadline for submission of the tenders or applications for participation.

For the purpose of proving its personal status, the economic operator shall submit the following documents:

— statement from the economic operator that no effective court decision for participation in criminal organization, corruption, tax and contributions evasion, terrorism or other offences related to terrorist activities, money laundering and financing terrorism, and exploitation of the child labor and human trafficking was rendered in the past 5 years,

— receipt on settled taxes, contributions and other public fees by the competent body from the country where the economic operator is registered; unless the economic operator is approved delayed payment of taxes, contributions or other public fees, in accordance with the special regulations and provided that it pays them on regular basis,

— statement by the competent authority that no…

… bankruptcy procedure has been initiated,

… liquidation procedure has been initiated,

— statement from the register of penalties for crimes committed by legal persons stating that no minor penalty…

… has been pronounced for participation in invitation to tender procedures, awarding of a public procurement contracts or private-public partnership contract,

… — temporary or permanent interdiction on carrying out particular business activity has been pronounced,

— statement that no misdemeanour sanction — interdiction on carrying out profession, action or responsibility, i.e. temporary interdiction on carrying out particular business activity, has been pronounced with an effective court decision,

— the list of issued negative references is checked by the Contracting Authority and the same is generated by the ESPP.

Економска и финансиска состојба:

The following payment terms have been envisaged: bank transfer (payment order) payment within 60 (sixty) days counting from the next day from receiving the invoice at the archives of PE ‘Streets and Roads’ — Skopje, with seat on the following address: St. Kole Nedelkovski No 38, 1000 Skopje, Republic of North Macedonia.

Such payment terms and conditions shall be binding. Each tender containing payment terms and conditions different from the one established in this item shall be considered unacceptable and as such it shall be rejected by the Public Procurement Committee.

Техничка и професионална способност:

All statements for proving the technical capability submitted and prepared by the economic operator are electronically signed by the economic operator itself and they shall not be verified by a competent authority.

The technical and professional capacity of the economic operator can be supported by another entity, regardless of the legal connections between the economic operator and that entity, except in the part of the reference list and the previously concluded contracts.

If the economic operator proves its technical and professional capacity by referring to the support of the aforesaid another entity, the economic operator shall validate that support with a valid evidence — Contract on business and technical cooperation stating that the entity shall make available to the economic operator the adequate technical and professional resources.

The Contracting Authority shall check if the subject whose capability is used by the economic operator fulfills the necessary conditions for qualitative selection and if there are reasons for its exclusion.

If the economic operators submit a tender as a group of economic operators, the technical and professional capability shall be proved by taking into consideration the resources of all the members of the group. If the group of economic operators acts by the technical or professional support of a third entity or third entities, the technical and professional capability shall be established in accordance with the aforementioned in item.

Минимално ниво(а) на стандарди:

In order to qualify as competent for execution of the respective public procurement contract from the aspect of standard on environmental management, the economic operator shall meet the following standards:

— standard on environmental management: ISO 14001: 2015 or equivalent.
