1) The public procurement contract subject shall be goods “Liquid fuels”. The contract subject cannot be divided. The tenderer shall include all composing lots in its tender. Otherwise, the tender shall be considered as non-acceptable. This procedure shall end with conclusion of a framework agreement and awarding of a special public procurement contract. The public procurement contract shall be awarded through an electronic auction which shall produce new downward corrected prices. The electronic auction subject shall be the total price including all costs and discounts and import duties, VAT excluded. The initial electronic auction price shall be the lowest price of the acceptable tenders submitted in the initial phase of the procedure. All tenderers who have submitted acceptable tenders shall be, at the same invited to submit new prices on the tender lot which is subject to the electronic auction.

Place of delivery of goods or execution of services, or location for execution of works: Diesel fuel and extra light fuel oil within 3 (three) days at the following location: Asphalt Base of the Public Enterprise (PE) Ulici i Patishta (Streets and Roads) – Skopje. Engine gasoline, diesel fuel and liquefied petroleum gas immediately following the receipt of a written order by email, fax, or with submission of an order at the very gas station. The economic operator shall be obliged to equally secure the same conditions to all private gas stations. Fuel filling shall be executed directly at the gas station of the economic operator.

— The economic operator should also submit: License for performing energy activity - trade in crude oil, oil derivatives, biofuels and transport fuels - wholesale trade with Eurodiesel BS (D-ЕV) issued by the Energy Regulatory Commission of the Republic of Macedonia, and License for performing energy activity – trade in crude oil, oil derivatives, biofuels and transport fuels - wholesale trade with Extra light fuel oil for households (EL-1), issued by the Energy Regulatory Commission of the Republic of Macedonia.

The Contracting Authority shall check whether the entity, whose capability is used by the economic operator, meets the required conditions for qualitative selection and whether there are any reasons for his exclusion.
Request for price explanation shall obligatory be requested from the tenderer whose tender value is by more than 50 % lower than the average price of the acceptable tenders, and is by more than 20 % lower than the subsequent ranked tender, in case there are at least 3 (three) acceptable tenders.

Минимално ниво(а) на стандарди:
To qualify as capable for performing the public procurement contract in subject, in terms of its technical or professional capability, the economic operator shall comply with the following minimal requirements:
— Experience in successfully realized contracts related with the procurement subject in the last three years,
— Technical possibility for usage of the cashless payment system, and
— Disposal with, or securing of minimum 5 (five) gas stations on the territory of the City of Skopje,
— List of successfully realized contracts related to the procurement subject in the last three years, with contract values, dates of conclusion, buyers (contracting authorities or economic operators), with securing of a certificate for performed deliveries issued by the recipients or, if such certificates cannot be secured due to reasons that cannot be controlled by the economic operator, only with his statement for performed deliveries,

— Statement for usage of the cashless payment system, and
— Statement for disposal with, or securing of, minimum 5 (five) gas stations on the territory of the City of Skopje.
All statements submitted and prepared by the economic operator to prove the technical capability are electronically signed by the economic operator, and the same do not have to be verified by a competent authority.
The technical and professional capability of the economic operator can be supported by another entity regardless of the legal relations between the economic operator and that entity, except for the part relating to the reference list and the previously concluded contracts.

If the economic operator shall prove their technical and professional capability by referring to the support of another entity, it shall be obliged to prove the support with valid evidence - Contract for business-technical cooperation indicating that the entity shall make available for the economic operator the relevant technical and professional resources.
