List and brief description of conditions:

In order to prove its personal condition, the economic operator shall submit the following documents:

— a declaration by the economic operator that he was not rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering in the last 5 years,

— confirmation that there are no bankruptcy proceedings undertaken by the competent authority,

— confirmation that there is no liquidation procedure undertaken by the competent authority,

— receipt for paid taxes, contributions and other public duties by the competent authority of the country where the economic operator is established,

— certificate from the Registry of penalties for crimes committed by legal persons that minor penalty…

… — ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership — has not been imposed,

… for temporary or permanent prohibition of a specific activity has not been imposed,

— confirmation that the final sentence has not been imposed as a crime sanction that prohibits performing professional activity or duty, i.e. temporary prohibition for performing specific activity

Ability to perform professional activity:

2.3.1) In order to prove the ability for performing professional activity, the economic operator should submit a document for registered activity as a proof that it is registered as a physical or legal entity for performing the activity related to the subject of the contract for public procurement, or a proof that it belongs to an appropriate professional association in accordance with the regulations of the country in which it is registered.

According to article 148 paragraph 2 of the Law on Public Procurements, upon determining the ability for performing professional activity of economic operators, the Contracting Authority requires a proof issued by the competent authority, for fulfilment of specific conditions for performing the activity prescribed pursuant to the law that refers to the subject of the contract, as well as License A for designing structures of first category, in accordance with the Law on construction.

2.3.2) In order to prove the ability to perform professional activity, the economic operator shall submit the following documents:

— document for registered activity as a proof that it is registered as a physical or legal entity for performing the activity related to the subject of the contract for public procurement or proof that it belongs to appropriate professional association in accordance with the regulations of the country where it is registered, as well as License A for designing structures of first category.

Економска и финансиска состојба:

2.4) Economic and financial situation:

2.4.1) In order to qualify as capable for execution of the subjected contract for public procurement from the aspect of its economic and financial situation, the economic operator should meet the following minimum requirements:

— to have a minimum annual income of 20 (twenty) million in each of the last 3 years, and positive balance of the success in the last 3 years.

2.4.2) If the economic operator performs the activity in a period of less than 3 years, the minimum requirement for determining the economic and financial situation is that the economic operator should achieve the requirement of sub-item 2.4.1 in the years for which it has data.

2.4.3) The economic operator shall prove the fulfilment of the minimum requirement of sub-item 2.4.1 or 2.4.2 by delivering the following:

— a report of its balance sheet notarized by a competent authority, i.e. revised balance sheet, or excerpts of its report for the balance sheet, in cases when publishing of the balance sheet is stipulated by law in the country in which the economic operator is registered,

— extract from the overall turnover of the enterprise (data from the income statement issued by a competent authority, i.e. revised income statement), and, where appropriate, of the turnover in the area covered by the agreement for public procurement, mostly for the last 3 financial years for which such information are available, depending from the date on which the enterprise was established or when it started with its operation, and depending on the availability of such information.

2.4.3) The Economic operator shall prove the fulfilment of the minimum requirement of sub-item 2.4.1 or 2.4.2 by delivering the following:

2.5.1) In order to qualify as capable for execution of the contract for public procurement from the aspect of its technical or professional ability, the economic operator should meet the following minimum requirements:

— the economic operator should have carried out a minimum of 3 (three) contracts of similar scope (basic project for supply of drinking water; or a basic project for a filter station) in the last 3 (three) years,

— to have available (in permanent employment and/or engaged) at least 40 graduate engineers, of which:

— at least 4 graduate construction engineers, department for hydro technical constructions, with the authorization A for preparation of project documents for construction, with a minimum of 5 (five) years of experience in designing,

— at least 2 graduated civil engineers, department for…

… roads and railways, with authorization A for preparation of project documents for construction, with a minimum of 5 (five) years of experience in designing,

… constructions, with authorization A for preparation of project documents for construction, with a minimum of 5 (five) years of experience in designing,

— at least 2 graduated mechanical engineers with authorization A for preparation of project documents for mechanic engineering, with a minimum of 5 (five) years of experience in designing,

— at least 1 graduated electrical engineer with authorisation A for preparation of project documents in electrical engineering, with a minimum of 5 (five) years of experience in designing,

— at least 2 engineers with authority A for preparation of project documents for geo-technics, with a minimum of 5 (five) years of experience in designing,

— at least 2 graduated engineers architects with authorization for drafting of urban plans, i.e. planner, a signatory of planning documents, with at least 5 (five) years of working experience as a planner,

— to have permanently employed or engaged 1…

… geodetic engineer with authorization for geodesy, with at least 5 (five) of years working experience in the field of construction,

… expert for assessment of the impact of projects on the environment, with a Degree in the field of engineering of environment protection (EPP), ecology, energy, architecture, engineering, technical – technological sciences or an appropriate bachelor degree from natural sciences, with at least 5 (five) years of experience in the field of protection and promotion of the environment and nature,

— the economic operator should have a certified and accredited laboratory for testing of geo-mechanics and concrete, accredited according to ISO 17025 – 2006.2.6 Standard for the quality system

2.6.1) In order to qualify as capable for execution of the contract for public procurement, the economic operator should meet the following standard:

— standard for quality system: ISO 9001:2015 or equivalent.

2.7) Standard for environmental management

2.7.1) In order to qualify as capable for execution of the contract for public procurement, the economic operator should meet the following standard:

— standard for environmental management: ISO 14001:2015 or equivalent.

Минимално ниво(а) на стандарди:

2.5.2) The Economic operator shall prove the fulfilment of the minimum requirements set forth in sub-item 2.5.1, by submitting the following:

— a list of the main services of bidders or candidates, carried out in the last 3 years, with values, dates, orderers (Contracting Authorities or economic operators), by providing a certificate on performed services issued by the recipients,

— educational and professional qualifications of the economic operator or of its expert staff and especially the persons who are responsible for provision of the specific service (with addition of the persons with name and surname and the post that they will execute according to the above-mentioned condition), with presentation of the diplomas for completed education and appropriate authorizations/certificates for the gained status,

— statement for the engaged technical staff, regardless of the fact whether they directly belong to the economic operator, by submission of M1/M2 forms or a List of the Agency for employment or contracts for engagement of the requested persons,

— a statement that it is equipped with certified and accredited laboratory for testing of geo-mechanics and concrete, by submitting of a Copy of the Certificate ISO 17025 – 2006/ accreditation for the laboratory.2.6.2 The Economic operator shall prove the fulfilment of the standard of subsection 2.6.1 with the submission of:

— a copy of the Certificate for standard system of quality ISO 9001:2015 or equivalent

2.7.2) The Economic operator shall prove the fulfilment of the standard of subsection 2.7.1 with the submission of:

— a copy of the Certificate for the standard for environmental management ISO 14001:2015 or equivalent.
