2.3.1) In order to verify their capacity to perform professional activity, the economic operator has to submit a document for registered activity, as verification that they are registered as a natural or legal person that performs the activity related to the subject of the public procurement contract, or evidence that they belong to a corresponding professional association in accordance with the regulations of the country where the economic operator is registered.

2.3.2) Evidence issued by a competent authority which proves that the economic operator meets the required conditions prescribed by law for performing the activity related to the subject of the contract.

— pursuant to Article 148, Paragraph 2, in order to verify the professional capacity of the economic operators, the contracting authority requests evidence issued by a competent authority to verify that the economic operators meet the required conditions prescribed by law for performing the activity related to the subject of the contract: “B” Licence for category II design construction works.

Економска и финансиска состојба:

2.4) Economic and financial capacity:

2.4.1) In order to qualify as competent for carrying out the said public procurement contract in terms of its economic and financial capacity, the economic operator must meet the following minimum condition:

— to have generated a total income of no less than 9 000 000,00 MKD in the past 3 years (2015, 2016, 2017).

2.4.1) Should the economic operator be carrying out their activity in less than 3 years, the minimum condition for determining the economic and financial capacity of the economic operator shall be to meet the condition in Sub-item 2.4.1 in the years for which such data is available.

Минимално ниво(а) на стандарди:

2.4.3) The economic operator provides evidence for meeting the minimum condition in Sub-items 2.4.1 and 2.4.2 by submitting:

— balance sheet statement certified by a competent authority, i.e. audited balance sheet, or extracts from the balance sheet in case when the publishing of the balance sheet is prescribed by law in the country where the economic operator is registered,

— a bank statement of the overall turnover of the company (data from the income statement issued by a competent authority, that is, audited income statement) and if applicable, a bank statement of the turnover in the activity covered by the public procurement contract, with focus on the last 3 financial years for which such data is available, depending on the date the company was established on or started working, and depending on the availability of such data.

2.4.4) Have the balance sheet statement and the income statement undergone commercial audit, the economic operator may submit them as evidence that they meet the minimum condition for determining the economic and financial capacity without having them certified by a competent authority.

2.4.5) In case the balance sheet statement and the income statement have not undergone commercial audit, the economic operator submits them certified, that is, issued by a competent authority as evidence that they meet the minimum condition for determining the economic and financial capacity. The competent authority for issuing these statements is the Central Register of the Republic of Macedonia.

2.4.6) The economic and financial capacity of the economic operator may be supported by another entity, regardless of the legal relations between the economic operator and that entity, except when it comes to the data of the bank statement. Should the economic operator verify their economic and financial capacity by referring to the support of another entity, they must verify the support with valid evidence that the entity shall provide the economic operator with the finances needed. The entity that provides financial support must not have an effective court decision for participating in a criminal organisation, corruption, fraud, or money-laundering, passed against them.

2.4.7) Should the economic operators submit a bid as a group of economic operators, the economic and financial capacity is verified by taking into account the resources of all group members. Should the group of economic operators come forth with a financial support by another entity, the economic and financial capacity is determined as elaborated above.

Техничка и професионална способност:

2.5) Technical and professional capacity:

2.5.1) In order to qualify as competent for carrying out the said public procurement contract in terms of its technical and professional capacity, the economic operator must meet the following minimum conditions:

— to have successfully realised at least 3 (three) contracts in the last 3 (three) years, related to the subject matter of the procurement — preparing project documentation, and to provide certificates for quality completion,

— the economic operator has to have employed or hired technical staff responsible for rendering services related to the subject matter of the procurement, that is:

—— at least 5 engineers with a “B” authorisation, out of which at least 1 (one) with a “B” authorisation to carry out the hydrotechnical design phase, 1 (one) electrical engineer, and 1 (one) mechanical engineer.

2.5.2) The economic operator verifies meeting the minimum conditions of Sub-item 2.5.1 by submitting:

— a list of successfully realised contracts in the last 3 years, related to the subject matter of the procurement, with contracts values, dates of conclusion, buyers (Contracting Authorities or economic operators), and a certificate verifying performed deliveries issued by the recipients, or if such certificates cannot be provided for reasons beyond the control of the economic operator, only their statement for performed deliveries shall suffice,

— academic and professional qualifications of the economic operator or their expert staff, especially the ones in charge of providing the respective services,

— a statement verifying that technical staff and technical bodies have been hired regardless whether they are directly employed by the economic operator or not.

2.5.4) The technical and professional capacity of the economic operator may be supported by another entity, regardless of the legal relations between the economic operator and that entity. Should the economic operator verify their technical and professional capacity by referring to the support of another entity, they must verify the support with valid evidence that the entity shall provide the economic operator with the appropriate technical and professional resources. The entity that provides technical and professional support must not have an effective court decision for participating in a criminal organisation, corruption, fraud, or money-laundering, passed against them.

2.5.5) Should the economic operators submit a bid as a group of economic operators, the technical and professional capacity is verified by taking into account the resources of all group members. Should the group of economic operators come forth with a technical or professional support by another entity or entities, the technical and professional capacity is determined as elaborated above.
