The economic operator should submit the following documents for proving that there are no grounds for exclusion from the procedure:
— statement by the economic operator that final judgement for participation in criminal organization, corruption, evasion of taxes and contributions, terrorism or criminal acts connected to terrorist activities, money laundering and financing of terrorism and abuse of child labor, and trafficking in human beings has not been rendered in the past 5 years,

— a confirmation for paid taxes, contributions and other public duties by the competent authority of the country in which the economic operator is registered,
— confirmation that there is no open procedure for…
… bankruptcy by a competent authority,
… liquidation by a competent authority,
— confirmation from the registry of penalties for committed criminal offenses of legal persons, that a secondary penalty for…
… ban on participation in procedures for public call, awarding contracts for public procurement and agreements for public-private partnerships has not been issued,
… temporary or permanent prohibition for performing certain activity has not been imposed,
— confirmation that a final judgement — misdemeanour sanction-prohibition on performing a profession, activity or duty, or temporary prohibition for performing certain activities has not been pronounced,
— the list of the issued negative references shall be checked by the contracting authority, and it shall be generated at the electronic system for public procurements.
In order to prove the ability to perform the professional activity, the economic operator shall submit the following documents:
— a document for registered activity as a proof that it is registered as a natural person or legal entity for performing the activity related to the subject of the contract for public procurement, or proof that it belongs to appropriate professional association in accordance with the legislation of the country where it is registered.

The economic operator shall prove the fulfilment of the minimum requirements in sub-item 2.3.2.1, by submitting the following:
(a) a statement about the instruments, machines or technical equipment that the service provider or contractor of works has at his disposal for execution of the contract, or to submit a statement that it owns or has engaged at least 2 (two) machines, apparatuses for butt welding for HDPE pipes with dimensions of the pipe up to DN630, by attaching a confirmation (a certificate) issued by an authorized certification body);

(b) description of the technical personnel — presentation of a statement that it has employed or engaged at least 2 (two) qualified persons for handling of the machinery-welders for a butt welding of the HDPE pipes with dimensions of the pipe up to DN630. If the required persons are not currently employed by the economic operator, it is necessary for the economic operator to submit the documents referred to in Article 96 of the Law on Public Procurements, i.e. the documents listed in point 2.3.3 of the tender documents;

(c) stating of the part of the public procurement for which the economic operator has the intention to submit to the subcontractor; and
(d) in regard with the goods that should be procured:
Certificates and reports issued by competent authorities for quality control with recognized competence, which are testing the suitability of the goods that were clearly determined by addressing the specifications and quality standards.
2.3.2.3 The contracting authority reserves the right, in the process of evaluation, to additionally verify the authenticity of the submitted documents/evidence, by at site inspection or in another suitable manner.
2.3.2.4 The statements set forth in 2.3.2.2 shall be prepared and electronically signed personnaly by the economic operator and they do not need to be certified by the competent authority.
The necessary technical and professional ability for proper execution of the contract shall be determined by the contracting authority through the following minimum requirements:
— the economic operator should have a minimum of 2 (two) machines, apparatuses for butt welding of HDPE pipes with dimensions of the pipe up to DN630 (the machines have to be certified by an authorized certification body),
— the economic operator has employed or engaged at least 2 (two) operators-handlers with the machine for butt welding of HDPE pipes with dimensions of the pipe up to DN630,
— it is necessary that the products — HDPE pipes, air valves and the oval body gate valves, which are subject of the delivery — are in compliance with the requirements set forth in the technical specifications.
