In order to prove its personal condition the economic operator is obliged to submit the following documents:

— statement of the economic operator that in the past five years it was not rendered a final judgment for participation in criminal organization, corruption, fraud or money laundering,

— confirmation by a competent organ that a…

… bankruptcy procedure was not opened,

… liquidation procedure was not opened,

— confirmation for paid taxes, contributions and other public duties by a competent organ in the country where the economic operator was registered,

— certificate from the registry of penalties for crimes committed by legal persons that…

… minor penalty ban on participation in public tender procedures, awarding contracts and agreements for public-private partnership has not been imposed on him,

… a minor penalty for temporary or permanent prohibition of a specific activity has not been imposed over him,

— confirmation that a final judgment — prohibition of professional activity or duty, i.e. temporary prohibition for performing professional activity has not been imposed over him.

Capacity for performing professional activity of economic operator:

Document for registered activity:

In order to prove its capacity for performing professional activity, the economic operator should be registered as a natural or legal entity for performing the activity related to the subject of the public procurement contract or to be a member of a relevant professional association in accordance to the regulations of the country where it is registered. The economic operator shall prove the meeting of the stated minimum condition by submitting a document for registered activity issued by the Central Register of the Republic of Macedonia, as an evidence that it is registered as a natural or legal entity for performing the activity related to the subject of the public procurement contract or to be a member of a relevant professional association in accordance to the regulations of the country where it is registered. The Contracting organ shall require from the economic operators to provide an evidence issued by a competent organ for meeting the special conditions for performing the activity prescribed in accordance to the law, which are related to the subject of the contract. The economic operator shall prove the meeting of the given condition by submitting a valid Decision for wholesale of medical devices on the territory of the Republic of Macedonia issued by the Agency for Medicines and Medical Devices of the Republic of Macedonia.

Техничка и професионална способност:

Necessary documents to prove the technical or professional capacity of the economic operator:

1) List of main deliveries related to the same or similar equipment to the one defined in the technical documentation, realized in the last 3 years, by providing confirmations for the made deliveries issued by the beneficiaries, or if such confirmations may not be produced due to reasons out of control of the economic operator, only its statement for made deliveries;

2) Statement and enclosure of certificates for provided technical experts and educated personnel in charge of installing the equipment;

3) Statement and enclosure of certificates for provided technical experts and educated personnel in charge of maintaining the equipment with technical support;

4) Statement and enclosure of certificates for provided technical experts and educated personnel in charge of training the employees that would operate the equipment;

5) Statement by the economic operator that it is technically equipped and has available human resources for regular servicing of equipment in the warranty period;

6) Statement that it would provide equipment warranty for a period of two (2) years, in which period the economic operator is obliged to make free servicing and replacement of spare parts:

7.1) For registered medical devices — decision for putting into circulation on the market or temporary or permanent approval for parallel import, pursuant to Law on Medicines and Medical devices;

7.2) For unregistered medicines and medical devices — import license (approval for intervention import) pursuant to Law on Medicines and Medical devices.

Минимално ниво(а) на стандарди:

Minimum criteria for determining the technical or professional of the economic operator:

In order to qualify as capable of performing the subject public procurement contract from the aspect of its technical or professional capacity, the economic operator should meet the following minimum conditions:

1) Realized contracts for medical equipment procurement;

2) Technical experts and educated personnel in charge of installing the equipment;

3) Technical experts and educated personnel in charge of maintaining the equipment with technical support;

4) Technical experts and educated personnel in charge of training the employees that would operate the equipment;

5) Technical equipment and capacity of the economic operator for regular servicing of equipment in the warranty period;

6) Equipment warranty for a period of two (2) years, in which period the economic operator is obliged to make free servicing and replacement of spare parts;

7.1) For registered medicines and medical devices — the economic operator, for the offered goods should have provided approval for putting into circulation on the market or temporary or permanent approval for parallel import, pursuant to Law on Medicines and Medical devices;

7.2) For unregistered medicines and medical devices — the economic operator, for the offered goods should have provided a document allowing import (approval for intervention import) pursuant to Law on Medicines and Medical devices.
