In order to prove its personal status, the economic operator should submit the following documents:

— statement that in the last 5 years no effective court verdict has been issued for committing an act of crime pursuant to Article 88 Paragraph 1 of the Law on Public Procurement,

— confirmation stating that no bankruptcy procedure has been initiated by a competent body,

— confirmation stating that no liquidation procedure has been initiated by a competent body,

— certificate of paid taxes, benefits and other public duties issued by a competent body in the country where the economic operator is registered,

— confirmation from the register of penalties for committed criminal offenses of legal entities proving that no secondary penalty —…

… ban on participating in open call procedures, awarding public procurement contracts and contracts on public — private partnership has been pronounced,

… temporary or permanent ban on performing particular activity has been pronounced,

— confirmation stating that no misdemeanour sanction — ban on the performance of the profession, activity or duty, i.e. temporary ban on the performance of a particular activity has been pronounced with an effective verdict,

— document for registered activity: in order to prove its capability for performing a professional activity, the economic operator should submit the document for registered activity as proof that the bidder is registered as a natural person or legal entity for conducting the activity related with the subject of the public procurement contract, single document for proving the capability or proof that the bidder belongs to a relevant professional association in accordance with the regulations of the country where the bidder is registered.

Техничка и професионална способност:

— with a list of main deliveries of goods or performed services in the past 3 years, including values, dates, buyers (contracting authorities or economic operators), by providing a confirmation for completed deliveries or performed services: the bidder should have previous experience in the realization of deliveries and implementation in the Data centers of the operator for a minimum of 2 (two) contracts in the past 3 (three) years,

— with the educational and professional qualifications of the service provider or the contractor or their managerial staff, provided those are not evaluated as criteria for the selection of the most advantageous offer: the bidder should have at least:

—— 2 persons certified for virtual platforms as the platform (technology) of the offered solution,

—— 2 certified system administrators for the systems applied by the user, whereby 1 person certified for operative systems, minimum Windows Server 2012, and 1 person certified for minimum Linux (Ubuntu, RedHat, CentOS),

—— 1 person certified for the email system used by the user, i.e. minimum Exchange Server 2010,

—— 1 person certified for the databases used by the user, i.e. minimum Microsoft SQL Server 2012,

—— 2 persons certified for networks in the field (technology) of the offered solution,

—— 2 persons certified for security (Security Administrator) in the field (technology) of the offered solution,

—— 1 person certified for project management,

—— 1 person certified for process management,

—— 2 persons certified for Auditing information security systems management.

Note: 1 person may have several roles,

— certificates and reports issued by relevant bodies for quality control with recognized competence, which evaluate the products suitability which was clearly defined by the references to specifications and standards:

—— completed external control of the information system and information infrastructure and of the manual personal data processing in the past 3 (three) years by a company authorized for these purposes by the Directorate for Personal Data Protection,

—— the economic operator which performs the services should have implemented the requirements of the Law on Personal Data Protection (Official Gazette of the Republic of Macedonia No 7/05, 103/08, 124/10, 135/11 and 43/14) and to be in compliance with the Rulebook on the technical and organizational measures for providing secrecy and protection of personal data processing (Official Gazette of the Republic of Macedonia No 38/09 and 158/10),

—— right to provide licensed software for operative systems, databases and email systems as part of the hosting service,

—— positive opinion by the Directorate for Personal Data Protection on the prepared documentation for technical and organizational measures for providing secrecy and protection of personal data processing,

—— report of performed internal control of the information system and the information infrastructure — in line with article 25 of the Rulebook on the technical and organizational measures for providing secrecy and protection of personal data processing (Official Gazette of the Republic of Macedonia No 38/09 and 158/10) or minutes of performed inspection supervision by the Directorate for Personal Data Protection regarding the legitimacy of personal data processing.
