To prove their personal situation, the economic operator shall submit the following documents:

— declaration by the economic operator that in the last 5 years there is no enforceable judgement against them due to participation in a criminal organisation, corruption, fraud or money laundering,

— confirmation that the economic operators are not a subject of…

… bankruptcy proceedings issued by competent authority,

… liquidation proceedings issued by competent authority,

— confirmation for paid taxes, contributions and other public duties issued by competent authority in the country where the economic operator is registered,

— confirmation from the Register of penalties for criminal acts committed by legal…

… entities stating that no minor penalty — ban on participation in public call procedures, awarding public procurement contracts and contracts on public-private partnership has been imposed,

… persons stating that no minor penalty — temporary or permanent ban on the performance of particular action has been imposed,

— confirmation that has not been imposed no misdemeanour sanction — ban on performance of profession, activity or responsibility, i.e. temporary ban for performance of specific activity.

The statement of line 1 shall be prepared in electronic form and electronically signed by the electronic operator and does not need to be certified by a competent authority.

Documents cannot be older than 6 (six) months considered from the deadline for submission of the bids.

If the country, where the economic operator is registered, does not issue the documents, or if it does not encompass all aforementioned case, the economic operator can submit statement verified at competent authority.

About Section 1 (IT Equipment Maintenance):

2.5.2 The economic operator proves fulfillment of minimum requirements specified under item 2.5.1 by lodging:

1) Attestation of performed services issued by service recipients. If such attestations cannot be provided due to reasons beyond the economic operator’s control, the bidder shall deliver a copy of the contract and a statement that the contract has been duly executed;

2) The bidder shall prove fulfilment of requirements unlisted under item 2.5.1 sub-item 2, related to professional qualifications by submitting proof of regular employment (M1/M2 form). If a professional is to be hired, the bidder shall submit a Statement specifying the person to be hired, and a written consent signed by the person to be hired. The adequate requested certificate shall also be submitted as proof of expertise;

3) Statement confirming that during the entire equipment maintenance period, the bidder will have employed or engaged persons that hold the abovementioned certificates;

4) Notification on elements of the contract that the economic operator intends to assign to a subcontractor;

5) Proof of established procedure whereby the client could report problems and malfunctions;

6) Statement confirming availability of maintenance and repair service for the hardware equipment that is part of the maintenance contract;

2.5.3 Apart from recommendations, certificates and proof of regular employment, the economic operator shall prepare and electronically sign all abovementioned documents and there is no need of verification thereof by competent authorities;

2.5.4 Technical and professional capacity of the economic operator may be supported by another entity, regardless of legal relations between the economic operator and the entity in question, apart from the reference list, previously signed contracts and licenses. Should the economic operator prove their technical and professional capacities by support from another entity, they must deliver valid evidence that the entity in question will provide the economic operator with all available technical and professional resources. The entity that would provide technical or professional support should have not been sentenced with enforceable judgement for participation in a criminal organisation, corruption, fraud or money laundering;

2.5.5 If economic operators place a bid as a group, technical and professional capacity thereof shall be proven by taking into account resources of each group member. If the group of economic operators has technical or professional support by a third entity/entities, the technical and professional capacity shall be proven in accordance with the aforementioned.

About Section 2 (Software Maintenance):

2.6.2 The economic operator proves fulfilment of minimum requirements specified under item 2.6.1 by lodging:

2) Notification on elements of the contract that the economic operator intends to assign to a subcontractor;

3) Proof of established procedure whereby the client could report problems and malfunctions;

2.6.3 Apart from recommendations, certificates and proof of regular employment, the economic operator shall prepare and electronically sign all abovementioned documents and there is no need of verification thereof by competent authorities;

2.6.4 Technical and professional capacity of the economic operator may be supported by another entity, regardless of legal relations between the economic operator and the entity in question, apart from the reference list, previously signed contracts and licenses.

About Section 1 (IT Equipment Maintenance):

2.5 Technical or Professional Capacity;

2.5.1 To qualify as capable to perform the relevant public procurement contract in terms of technical or professional capacity, the economic operator must meet the following minimum requirements:

1) Reference list of performed services related to IT equipment maintenance, as follows:

— minimum of 2 services on EMC (Storage, Data Domain, Networker),

— minimum of 2 services on SUN Servers,

— minimum of 2 services on HP Servers,

— minimum of 2 services on CISCO network equipment.

A single contract may include more services delivered by bidders or candidates in the past 3 years, with values, dates, buyers (contracting parties or economic operators), and with attestation issued by service recipients. If such attestations cannot be provided due to reasons beyond the economic operator’s control, the bidder shall deliver a copy of the contract and a statement that the contract has been duly executed;

2) Employed or engaged support specialists who hold the following certificates (one person may hold several certificates), valid during the entire period of the maintenance service, as follows:

— at least three (3) persons with certificates issued by the manufacturer…

… (HP) of the equipment subject to maintenance, i.e. HP ProLiant Servers,

… of SUN Servers equipment,

… of CISCO network equipment, as follows:

—— CCIE certificate (Cisco Certified Internetwork Expert),

— at least three (3) persons with certificates issued by the manufacturer of EMC Storage equipment (data storage device).

Only valid certificates shall be accepted. This implies certificates issued by the equipment manufacturer, and not only a fully attended certification course;

3) During the entire equipment maintenance period, the bidder must have employed or engaged persons that hold the abovementioned certificates;

4) Notification on elements of the contract that the economic operator intends to assign to a subcontractor;

5) Established procedure whereby the client could report problems and malfunctions;

6) Available maintenance and repair service for the specified hardware equipment that is part of the maintenance contract.

About Section 2 (Software Maintenance):

2.6 Technical or Professional Capacity;

2.6.1 To quality as capable to perform the relevant public procurement contract in terms of technical or professional capacity, the economic operator must meet the following minimum requirements:

1) Reference list of performed services related to software maintenance, as follows:

— minimum of 1 service on F5 LTM load balancer,

— minimum of 1 service on Oracle VM virtualization,

— minimum of 1 service on VMware virtualization,

— minimum of 2 maintenance services of Linux OS,

— minimum of 2 maintenance services of Sun Solaris OS.

A single contract may include more services delivered by bidders or candidates in the past three years, with values, dates, buyers (contracting parties or economic operators), and with attestation issued by service recipients. If such attestations cannot be provided due to reasons beyond the economic operator’s control, the bidder shall deliver a copy of the contract and a statement that the contract has been duly executed;

2) Notification on elements of the contract that the economic operator intends to assign to a subcontractor;

3) Established procedure whereby the client could report problems and malfunctions.
