The economic operators shall submit a single document proving the capability and/or confirmations, statements and other documents as evidence that there are no reasons for exclusion from the procedure.
As documents that there are no reasons for exclusion from item 2.2 (from the tender documentation), the contracting authority accepts the following documents:
— referring to Item 2.2.1 (from the tender documentation) a statement of the economic operator or a single document proving the capability,
— referring to Item 2.2.2 (from the tender documentation)a certificate issued by a competent authority in the Republic of North Macedonia or from another country in which the economic operator is registered, or a single document proving the ability,
— referring to Item 2.2.3 (from the tender documentation), an extract from the list of negative references provided by the contracting authority from the ESPP.
If the country where the economic operator is registered does not issue the documents referred to in Item 2.3.2 of this TD or if they do not cover all cases referred to in Article 88 of the PPL, the contracting authority shall accept a statement that the economic operator verifies with the competent authority (notary or similar), in which it will clarify which documents are not issued, which documents are issued as a replacement for the requested ones, and they will submit them.

The documents referred to in Items 2.2.1 and 2.2.2 (from the tender documentation) should not be older than six months from the deadline for submission of tenders or requests to participate.
In the case of a group of economic operators, all members of the group should individually prove their ability for non-exclusion from the procedure.
If the economic operator or group of economic operators uses a subcontractor during the execution of the public procurement contract, it submit documentation for establishing the non-exclusion capability for each of the proposed subcontractors.
The contracting authority keeps the right to further verify the authenticity of the submitted documents:
— a certificate of registered activity (form DRA) as proof that it is registered as a natural or legal person for performing the activity related to the subject of the public procurement contract or evidence that it belongs to a relevant professional association in accordance with the regulations of the country where it is registered. In the Republic of Northern Macedonia, the competent authority for issuing this document is the Central Registry of the Republic of North Macedonia,

— decision/approval for performing wholesale trade of medicinal products on the territory of RNM issued by the Ministry of Health in accordance with the law on medicines and medical devices.

— should possess an approval for placing the drug on the market in the territory of Republic of North Macedonia, or temporary approval, respectively a final approval for parallel import or for a temporal approval for parallel import, issued by the Ministry of Health/Agency for drugs and medical devices.

The statements referred to in Item 2.4.2.2 shall be prepared and electronically signed by the economic operator itself and they don’t have to be certified by a competent authority.
The technical and professional capability of the economic operator may be supported by another entity, regardless of the legal relations between the economic operator and that entity.
If the economic operator uses the ability of another entity in terms of conditions relating to technical and professional capability, the supporting entity is committed to undertake a solidarity responsibility for the performance of the contract, for the value of the part for which the support is provided.

If the economic operator proves its technical and professional capability, referring to the support of another entity, it is obliged to prove the support with valid evidence that that entity will make the appropriate resources available to the economic operator.

The entity whose ability is used by the economic operator should meet the necessary conditions for qualitative selection and the reasons for its (non) exclusion.
— for unregistered medicines to have provided a document allowing interventional import, in accordance with the law on medicines and medical devices,
— the conditions for the safe storage, accommodation, transport and handling of vaccines should be in accordance with the Rulebook on the content of the request and the more detailed conditions regarding the space, equipment and personnel for obtaining a wholesale drug license (‘Official Gazette of the Republic of Macedonia’ RM No 151/08).
