The contracting authority shall exclude from the public procurement procedure the economic operator:
(a) who has unpaid taxes, does not allow or other public duties, if he does not want to submit to tax payers, does not allow or other public duties in case of special regulations and pays them correctly;
(b) who is in a bankruptcy procedure or in a liquidation procedure;
(c) who has been sentenced to a secondary penalty prohibited from participating in the public call procedure, awarding public procurement contracts and private-private partnership contracts;
(d) who has been sentenced to a secondary punishment, temporary or permanent prohibition to perform a certain activity;
(e) to whom a misdemeanor sanction of prohibition to perform a profession, activity or duty has been imposed, as it should be preserved during the preservation of a certain activity, or
(f) who provides false information or does not provide the data required by the contracting authority.
As documents that there are no reasons for exclusion from Article 88 of the Public Procurement Law, the contracting authority accepts the following documents:
(a) in relation to Article 88 paragraph (1) of the Law on Public Procurement, a statement of the economic operator or a single document proving the ability;
(b) in connection with Article 88 paragraph (2) of the Law on Public Procurement, a certificate issued by a competent authority in the Republic of Northern Macedonia or by another country in which the economic operator is registered or a single document proving the ability;

(c) in relation to Article 88 paragraph (3) of the Law on Public Procurement, an excerpt from the list of negative references provided by the contracting authority from the ESPP.
Ability to perform professional activity.
In order to prove the ability to perform a professional activity, the economic operator must submit:
— document for registered activity — form DRD or certificate for registered activity; and
— decision issuing a license for performing the activity of production or wholesale of chemicals issued by the Ministry of Health of the Republic of Macedonia.

To qualify as eligible to perform the public procurement in question in terms of its technical or professional capacity, the economic operator must meet the following minimum requirements:
— The economic operator for the offered goods to have provided approval which gives a license to perform the activity of production or wholesale of chemicals issued by the Ministry of Health of RSM.
The economic operator proves the fulfillment of the minimum conditions by submitting:
— Decision issuing a license for performing the activity of production or wholesale of chemicals issued by the Ministry of Health of the Republic of Macedonia.

To qualify as eligible to perform the public procurement in question in terms of its technical or professional capacity, the economic operator must meet the following minimum requirements:
