Framework agreement award criterion
The award criterion for the contract for public procurement of bitumen shall be: the lowest price total lowest price = ‘ Other costs VAT excluded ex-works asphalt base, on day of opening (9 April 2020), subject of eAuction + Market price of bitumen (Fuel oli 1 %), VAT excluded, 24 working days before opening’, subject to offer on day of opening. The contractor shall be the economic operator offering: total lowest price or lowest price representing the sum of the offered final price during the electronic auction and the offered market price for bitumen (Fuel oli 1 %), VAT excluded, submitted at the opening, whose tender was previously assessed as acceptable. Having in mind that the specific procedure shall end with the implementation of the electronic auction, the tenders shall not be given any points and the tenderers shall be ranked according to the amount of the offered prices.

In order to prove the capability to perform professional activity, the contracting authority shall request each economic operator to submit proof for registration as a natural person or a legal entity to perform the activity related to the public procurement subject or proof of membership to an appropriate professional association in accordance with the regulations of the country of registration of the respective economic operator.

Економска и финансиска состојба:
The contracting authority shall exclude the economic operator from the public procurement procedure if it is established that against the economic operator or the person who is member of the management or of the supervisory board of such economic operator or who has an authorisation for representation or for decision-making or for supervision over it, has been pronounced a valid court verdict in the last 5 years for committed criminal act including elements of the following criminal acts defined in the Criminal Code:

— participation in criminal association,
— corruption,
— evasion of taxes and contributions,
— terrorism or offences related to terrorist activities,
— money laundering and terrorism financing, and
— child labor abuse and trafficking in humans.
Минимално ниво(а) на стандарди:
The contracting authority shall exclude from the public procurement procedure the economic operator:
(a) with unpaid taxes, contributions or other public dues, unless the one was granted deferred payment of taxes, contributions or other public dues in accordance with the special regulations and pays them regularly;
(b) undergoing a bankruptcy or liquidation procedure;
(c) with pronounced ancillary penalty for prohibition for participation in public call procedures, awarding of public procurement contracts and public private partnership contracts;
(d) with pronounced ancillary penalty for temporary or permanent prohibition to perform specific activity;
(e) with pronounced misdemeanor sanction involving prohibition to perform a profession, activity or duty or temporary prohibition to perform a specific activity; or
(f) who has provided false data or has failed to provide the data requested by the contracting authority.
Техничка и професионална способност:
Bitumen's technical characteristics:
1) bitumen 50/70 or equivalent;
2) the bitumen needs to meet the MKC EN 12591:2012 standard or equivalent;
3) bitumen's temperature on delivery: minimum 150 ºC.

— Provided orientational quantity for procurement: 700-1000 tons
— The listed orientational quantities are non-binding for the contracting authority and are designed based on personal interests and current market prices.
