2.2.1. The contracting party shall exclude any economic operator from the public procurement procedure if it determines that the economic operator, or the person who is a member of the executive or oversight body of said economic operator or who is authorized to represent or adopt decisions or to perform oversight over the economic operator, has been sentenced with an enforceable judgement in the last 5 years on committed crime that involves elements of the following crimes stipulated under the criminal code:

— participation in criminal organization,

— corruption,

— tax and payroll tax evasion,

— terrorism or criminal acts related to terrorist activities,

— money laundering and financing terrorism, and

— child labor and human trafficking.

2.2.2. The contracting party shall exclude any economic operator from the public procurement procedure, if an economic operator:

— has unpaid taxes, payroll taxes or other public charges, except in cases when the economic operator has been permitted to pay taxes, payroll taxes or other public charges by means of deferred payment in compliance with special provisions and performs regular payment thereof,

— undergoes bankruptcy or liquidation proceeding,

— has been sentenced with secondary penalty, prohibition for participation in public call procedures, procedures for awarding public procurement contracts and public-private partnership contract,

— has been has been sentenced with secondary penalty, temporary or permanent prohibition to perform a particular activity,

— has been sentenced with misdemeanor sanction, prohibition to perform profession, activity or duty, or temporary prohibition to perform a particular activity, or

— issues false information/data or fails to submit information/data requested by the contracting party.

2.2.3. The contracting party shall exclude the economic operator from the public procurement procedure if the economic operator is listed under the list of issued negative references under Article 101, Paragraph (3) of the Law on Public Procurements by the final deadline for delivery of bids or participation requests.

2.2.4. The contracting party shall exclude the economic operator from the public procurement procedure in cases when the exclusion condition is enlisted under the tender documentation:

a) If the contracting party has valid reasons to determine that the economic operator has signed contracts with other economic operator with purpose or effect to distort competition. The determination of the contracting party stipulated under this item shall be considered valid if the Commission for Protection of Competition notifies the contracting party that it will initiate a misdemeanor procedure within a deadline of 15 days, based on notice lodged by the contracting party;

b) If the economic operator has demonstrated significant or constant shortcomings in meeting key duties in previous public procurement contracts or previous concession and public-private partnership contracts signed with said contracting party, which, in turn, resulted in unilateral contract termination, damage claims or undertaking of other similar sanctions by the contracting party;

c) If the economic operator exercises illegal influence over the contracting party’s decision or for acquisition of confidential information that would give said economic operator illegal advantage in the public procurement procedure.

Техничка и професионална способност:

2.4. Technical or professional capacity.

2.4.1. To qualify as capable to perform the relevant public procurement contract in terms of technical or professional capacity, the economic operator should meet the following minimum criteria:

1) Reference list for development or maintenance of systems based on the following technologies:

— development or maintenance of at least two (2) systems based on NET Core and ESB Microsoft BizTalk Server technology,

— at least two (2) contracts for sucessful deliverable or maintenance for each of the following hardware equipment type:

— IBM Tape Library,

— Fujitsu Server,

— EMC Data Storage,

— Cisco networking hardware.

One contract may include several equipment types and will be considered reference for all enlisted equipment types.

c) Development of at least one (1) system that also covers e-services for end users, citizens or businesses, in the last 5 years.

“System that also covers e-service” implies a system that provides digitalized service process for end users: user identification and authentication; lodging request by filling an electronic form; processing of lodged request; payment of service fees and taxes, and notifying the user about completed service process or issuance of electronic document. The electronic document resulting from the e-service should be compliant with positive legislation in effect during the time of development thereof.

2) To have regularly employed/engaged expert staff that would have the following professional qualifications for the entire duration of the contract:

a) At least three (3) programmers certified to work with Microsoft Visual Studio with at least 5 years work experience each, holders of at least two of the following (in addition to other) certificates:

— MCSD: app builder,

— MCSD: web applications,

— MS: programing in HTML with JavaScript and CSS3.

b) At least two (2) certified technical specialists with at least 5 years relevant work experience each, concerning work on backup, storage management and server protection systems, i.e. for products specified below. In that, certificates should cover at least two of the following products:

— Veritas Backup Exec,

— Veritas Info Scale (Veritas/Symantec Storage Fondation),

— Symantec Data Center Security,

c) At least one (1) person certified to work on databases with at least 5 years relevant work experience, holder of certificate:

— MCSA certification for MS SQL Server 2012 or for more advanced MS SQL Server version.

d) At least one (1) person with at least 5 years relevant work experience in installation and configuration in complex virtual/Cloud environments; holder of one of the following certificates:

— MCSE: Cloud Platform and Infrastructure,

— MCSE: Server Infrastructure,

— MCITP: Database Administrator.

e) At least one (1) person certified to work on CISCO network equipment with at least 5 years relevant work experience; holder of certificate:

CCIE certificate (Cisco Certified Internetwork Expert).

f) At least one (1) person certified to work on EMC Storage (data storage device), with at least 5 years relevant work experience; holder of certificate issued by EMC Storage manufacturer.

g) At least one (1) person certified to work on log and security incidents management system with at least 5 years relevant work experience; holder of certificate for the following product:

IBM Qradar.

3) For the entire duration of the contract, the bidder is obliged to have employed or engaged persons that hold the aforementioned professional qualifications.

4) Letter of notice on contract elements that the bidder intends to assign to a subcontractor.

Минимално ниво(а) на стандарди:

2.4. The economic operator shall prove meeting minimum requirements stipulated under item 2.4.2.1. со by lodging the following:

1) The bidder shall prove meeting criteria stipulated under Item 2.4.1. sub-item 1 related to reference lists covered under: a) and b) above, by delivery of the following documentation:

Confirmation letters/references on quality implementation of contract issued by service recipients. If such confirmation letters cannot be provided, the bidder shall deliver a copy of the signed contract and a statement that the contract has been dully executed;

2) The bidder shall prove meeting criteria с) stipulated under Item 2.4.1. sub-item 1, related to reference list for development of at least one (1) system that also includes e-services to end users, by delivery of the following documentation:

In terms of method of engagement, if the person is employed, the bidder should deliver proof of regular employment contract (M1/M2 form). If the bidder intends to engage persons on a temporary basis, it should deliver a statement letter that would list the person to be engaged. To prove expert capacity of employed/engaged person, the bidder shall deliver statement letters from expert persons confirming that they meet the minimum criteria required in terms of years of relevant experience, and enlisting relevant projects pursuant to relevant requirement, firm the persons have signed employment contracts with during their engagement, whereby years of relevant work experience shall be calculated from the year of first relevant project;

1) Statement letter that, if chosen as procurement holder, for the entire duration of the contract the bidder shall have employed or engaged persons that hold the enlisted professional qualifications and that said persons shall be engaged in the project team;

2) Letter of notice on contract elements that the bidder intends to assign to a subcontractor;

Note: all abovementioned documents, apart from recommendations, certificates and proof of regular employment contract, shall be prepared and electronically signed by the economic operator, and there is no need of verification thereof by competent authority.

Certificate is defined as document issued by the adequate manufacturer/or certification center authorized by the manufacturer that confirms the knowledge acquired by the certificate holder. Documents on attended trainings shall not be accepted as proof of acquired knowledge/expertise.

Note: on M1/M2 forms that would be delivered, the bidder should hide single identification numbers of the persons in question, given that those numbers should not be visible pursuant to the Law on Personal Data Protection.

1.9.4. Evaluation and scoring of criterion quality:

A maximum of 30 points may be awarded for the criterion quality, according to the following scoring methodology.

Scoring will be made by using the formula below, and based on the number of developed e-Services.

Number of points = number of developed e-services from each bidder X maximum number of points.

Highest number of developed e-Services after comparing number of all bidders.

Confirmation letters should be issued by service recipients. If such confirmation letters cannot be provided, the bidder shall deliver a copy of signed contracts and a statement that said contracts have been dully executed.

In addition, all bidders should also fill the table on developed services they deliver for scoring purposes. The table in question is provided as attachment to the tender documentation.
