2.2.1 The contracting party shall exclude any economic operator from the public procurement procedure if it determines that the economic operator, or the person who is a member of the executive or oversight body of said economic operator or who is authorized to represent or adopt decisions or to perform oversight over the economic operator, has been sentenced with an enforceable judgement in the last 5 years on committed crime that involves elements of the following crimes stipulated under the Criminal Code:

— participation in criminal organization,

— corruption,

— tax and payroll tax evasion,

— terrorism or criminal acts related to terrorist activities,

— money laundering and financing terrorism, and

— child labor and human trafficking.

2.2.2 The contracting party shall exclude any economic operator from the public procurement procedure, if an economic operator:

— has unpaid taxes, payroll taxes or other public charges, except in cases when the economic operator has been permitted to pay taxes, payroll taxes or other public charges by means of deferred payment in compliance with special provisions and performs regular payment thereof,

— undergoes bankruptcy or liquidation proceeding,

— has been sentenced with secondary penalty — prohibition for participation in public call procedures, procedures for awarding public procurement contracts and public-private partnership contract,

— has been has been sentenced with secondary penalty – temporary or permanent prohibition to perform a particular activity,

— has been sentenced with misdemeanor sanction – prohibition to perform profession, activity or duty, or temporary prohibition to perform a particular activity, or

— issues false information/data or fails to submit information/data requested by the contracting party.

2.2.3 The contracting party shall exclude the economic operator from the public procurement procedure if the economic operator is listed under the list of issued negative references under Article 101 paragraph (3) of the Law on Public Procurements by the final deadline for delivery of bids or participation requests.

2.2.4 The contracting party shall exclude the economic operator from the public procurement procedure in cases when the exclusion condition is enlisted under the tender documentation:

(a) if the contracting party has valid reasons to determine that the economic operator has signed contracts with other economic operator with purpose or effect to distort competition. The determination of the contracting party stipulated under this item shall be considered valid if the commission for protection of competition notifies the contracting party that it will initiate a misdemeanor procedure within a deadline of 15 days, based on notice lodged by the contracting party;

(b) if the economic operator has demonstrated significant or constant shortcomings in meeting key duties in previous public procurement contracts or previous concession and public-private partnership contracts signed with said contracting party, which, in turn, resulted in unilateral contract termination, damage claims or undertaking of other similar sanctions by the contracting party;

(c) if the economic operator exercises illegal influence over the contracting party’s decision or for acquisition of confidential information that would give said economic operator illegal advantage in the public procurement procedure.

Техничка и професионална способност:

2.4.2 The economic operator shall prove meeting minimum criteria enlisted under sub-item 2.4.1 by lodging the following:

1) The bidder shall prove meeting criteria stipulated under Item 2.4.1, related to the reference list, by delivery of the following documentation: confirmation letter/reference on completed implementation service by service recipient. If such confirmation letter cannot be provided, the bidder shall deliver a copy of the signed contract and a statement that the contract has been dully executed.

2) The bidder shall prove meeting criteria stipulated under Item 2.4.2.1 sub-item 2, related to professional qualifications of expert staff, by delivery of proof of regular employment contract (M1/M2 form). If the Bidder intends to engage persons on a temporary basis, it should deliver a statement letter that would list the person to be engaged, as well as written consent of the person to be engaged. To prove expert capacity of employed/engaged person, the bidder shall deliver the relevant certificate. In terms of work experience, statement letters should be lodged from legal entities wherein the experts have acquired their relevant work experience. If such statement letter cannot be provided, the bidder shall provide a statement letter confirming that the persons in question have relevant work experience, by enlisting therein relevant project they have worked on and period of engagement thereof

3) Statement letter that, if chosen as Procurement Holder, for the entire duration of the contract the Bidder shall have employed or engaged persons that hold the enlisted professional qualifications and that said persons shall be engaged in the project team;

4) Letter of Notice on contract elements that the Bidder intends to assign to a subcontractor.

Note:

— all abovementioned documents, apart from recommendations, certificates and proof of regular employment contract, shall be prepared and electronically signed by the economic operator, and there is no need of verification thereof by competent authority;

— certificate is defined as document issued by the adequate manufacturer/or certification center authorized by the manufacturer that confirms the knowledge acquired by the Certificate Holder. Documents on attended trainings shall not be accepted as proof of acquired knowledge/expertise. If, for certain certificates, there is a need to access a website to view confirmation letter that the person is certificate holder, the procurement holder shall provide adequate access to said website;

— on M1/M2 forms that would be delivered, the bidder should hide single identification numbers of the persons in question, given that those numbers should not be visible pursuant to the law on personal data protection.

Минимално ниво(а) на стандарди:

2.4.1 To qualify as capable to perform the relevant public procurement contract in terms of technical or professional capacity, the economic operator should meet the following minimum criteria:

1) Experience in delivery, implementation and maintenance of systems of this type, as follows:

— at least three (3) sucessfully implemented or maintained Microsoft BizTalk-based systems in the past three years

— at least three (3) sucessfully implemented VMware virtualization platforms in the past 3 years

— at least three (3) sucessful deliveries of backup systems in the past 3 years equipment

— at least three (3) successful implementations of Security Information Event Management (SIEM) in the past 3 years.

2) To have employed/engaged expert staff that would have the following professional qualifications for the entire duration of the contract:

(a) at least three (3) holders of certificate:

— MCSE: Data Management and Analytics.

(b) at least two (2) holders of certificate:

— MCSA: SQL Server 2016 Database Development or more advanced version

(c) at least three (3) persons certified to work on system administration, holders of some of the certificates listed below. However, both certificate types should be covered:

— MCSA certification for Windows Server 2016 or for more advanced version,

— MCSE certification for Windows Server 2016 – Cloud Platform and Infrastructure or more advanced version

(d) at least three (3) persons certified to work with Microsoft Visual Studio with at least 3 years relevant work experience, whereby each should be holder of one of the following certificates:

— MCSA: Web Applications,

— MCSD: App Builder.

(e) at least three (3) holders of certificate VMware Certified Professional for virtual platform.

(f) at least one (1) holder of certificate – internationally recognized project management certificate – who shall be main point of contact and will be responsible for managing all obligations assumed by the procurement holder.

3) For the entire duration of the contract, the bidder is obliged to have employed or engaged persons that hold the aforementioned professional qualifications and that would be engaged in the project team.

4) Letter of notice on contract elements that the bidder intends to assign to a subcontractor.
