Reasons for exclusion from the procedure

The contracting authority shall exclude from the public procurement procedure the economic operator:

1) If it determines that the economic operator or the person who is a member of the management or supervisory body of that economic operator or has the power to represent or supervise or supervise it, a final court judgment has been pronounced for the last 5 years; a crime that has elements of the following crimes set forth in the criminal code:

— participation in criminal association,

— corruption,

— tax evasion and contributions,

— terrorism or offenses related to terrorist activities,

— money laundering and financing of terrorism, and

— abuse of child labor and human trafficking.

2) Who has unpaid taxes, contributions or other public duties, unless he is authorized to defer payment of taxes, contributions or other public duties in accordance with special regulations and regularly pays them.

3) Is in bankruptcy or liquidation procedure.

4) He/she has been pronounced a secondary penalty — prohibition to participate in public call procedures; awarding public procurement and public-private partnership contracts.

5) Has been pronounced a minor penalty — temporary or permanent prohibition to perform a particular activity.

6) Has been pronounced a misdemeanor sanction with a ban on performing a profession, activity or duty, or a temporary ban on performing a particular activity.

7) Who provides false data or fails to submit the data requested by the contracting authority.

The contracting authority shall exclude the economic operator from the public procurement procedure if it is on the list of negative references issued by the deadline for submission of tenders or requests to participate.

In order to prove that there are no conditions for exclusion from the procedure, the economic operator shall submit the following documents:

— A statement by the economic operator that for the last 5 years the economic operator or the person who is a member of the managing or supervisory body of that economic operator or who has powers to represent or make decisions or supervise it has not in the last five years pronounced final court verdict for a felony which has elements of the criminal offenses of participation in criminal association, corruption, tax evasion and contributions, terrorism or criminal offenses related to terrorist activities, money laundering and fines for terrorism and child labor and human trafficking set out in the criminal code.

— Confirmation of paid taxes, contributions and other public duties by a competent authority of the country where the economic operator is registered.

— Confirmation that no bankruptcy procedure has been initiated by a competent authority.

— Confirmation that no liquidation procedure has been initiated by a competent authority.

— Confirmation from the register of penalties for the criminal offenses of…

… legal entities that no secondary penalty has been imposed for prohibition of participation in public procurement procedures, awarding public procurement contracts and public-private partnership contracts.

Техничка и професионална способност:

To qualify as capable of executing the public procurement contract in question in terms of its technical or professional ability, the economic operator must meet the following minimum requirements:

— Prоof of successful deliveries similar to the subject of procurement for at least two different operators in the past 3 years.

— Proof of at least one authorized technical person authorized by manufacturer in the territory of the Republic of Northern Macedonia.

— Proof from the manufacturer of authorized service on the territory of the Republic of Northern Macedonia.

Минимално ниво(а) на стандарди:

The economic operator shall prove the fulfillment of the minimum requirements of sub-item 2.3.2.1 by submitting:

— List of main deliveries of bidders or candidates made in the last 3 years, with values, dates, buyers (contracting authorities or economic operators), providing confirmation of deliveries issued by the recipients or, if such confirmations cannot be provided by reasons beyond the control of the economic operator, only with his statement of deliveries.

— Statement of engaged technical personnel (authorized technical person by the manufacturera) whether or not they directly belong to the economic operator.

— Contract or statement by the manufacturer for authorized service in the territory of the Republic of Northern Macedonia.

— Authorization or statement by the manufacturer for the bidder the procedure in question.

The contractor shall be obliged to carry out the goods subject to the contract within the time period stipulated in the contract. The contractor shall be obliged to submit the procurement subject upon request by the contracting authority, within a maximum of 90 days from the date of receipt of the request/order. Place of delivery of Directorate for Protection and Rescue, Vasko Karnagelski Str. 1000 Skopje (Goce Delchev Barracks).

1) publication of the contract notice regarding the content of the contract notice or the tender documentation;

2) publication of the notice of changes and additional information as to the content of the changes and additional information;

3) opening of bids, in relation to the failure of the contracting authority to adequately respond to timely questions or requests for clarification or modification of the tender documentation; or

4) adoption of the decision on the selection of the most favorable bid or on the cancellation, in relation to the evaluation procedure and the selection of the most favorable bid, or on the reasons for the cancellation of the procedure State Commission for Appeals for Public Procurement.
