A statement that no final court judgment has been pronounced in the last 5 years for a criminal offense under Article 88 paragraph 1 of the PPL:

— confirmation that no bankruptcy procedure has been initiated by a competent authority;

— confirmation that no liquidation procedure has been initiated by a competent authority;

— confirmation of paid taxes, contributions and other public duties by a competent authority of the country where the economic operator is registered;

— confirmation from the register of penalties for…

… crimes committed by legal entities that no secondary penalty has been pronounced forbidding them to participate in public procurement procedures, awarding public procurement contracts and public-private partnership contracts;

… the criminal offenses of the legal entities that no temporary or permanent prohibition on performing certain activity has been imposed;

— certificate that no final sanction has been pronounced for him/her — a ban on performing a profession, activity or duty, or a temporary ban on performing a particular activity.

Document of registered activity as evidence that it is registered as a natural or legal person for carrying out the activity related to the subject of the public procurement contract or proof that it belongs to an appropriate professional association in accordance with the regulations of the country where the license is registered. ‘B’ for construction of second category buildings, in accordance with the law on construction, issued by the Ministry of Transport and Communications of the Republic of Northern Macedonia and in case of a foreign bidder, claims to be able to perform second category buildings issued by an appropriate body of the state administration responsible for the performance of the works on landscaping of the Republic of Macedonia, in accordance with Article 42 of the Law on Construction, as evidence of meeting the special conditions for performing the activity prescribed in accordance with by law relating to the subject of public procurement

Економска и финансиска состојба:

Balance sheet report issued by a competent authority, that is, revised balance sheet, or extracts from the balance sheet report, where disclosure of the balance sheet is prescribed by law in country where the economic operator is registered: Balance sheet report issued by a competent authority, i.e. revised balance sheet or excerpts from the balance sheet report in cases where the balance sheet publication is pro written by law in the country where the economic operator is registered. Statement of the total income of the enterprise (income statement issued by a competent authority, i.e. audited income statement) and, where required, a statement of income in the area which is covered by the public procurement contract for the last 3 financial years for which such information is available depending on the date on which the company is established or started operating and subject to the availability of such information: the operator has achieved a minimum annual income of at least MKD 20 000 000.00, each year individually, in the last 3 years (2017, 2018 and 2019)

Техничка и професионална способност:

— with a list of main deliveries of goods or services rendered with values, dates, buyers (contracting authorities or economic operators), providing confirmation of deliveries or services rendered: the economic operator must have (at least) performed 3 (three) contracts for construction and/or reconstruction of civil engineering structures with a total value of not less than MKD 20 000 000.00 excluding VAT per contract for the last 5 (five) years;

— a description of the technical staff and technical authorities involved in the execution of the contract public procurement, especially those responsible for quality control and in the case of public procurement, those who will be involved in the performance of the works, whether or not employed by the economic operator:

(a) the economic operator needs to: has at least 12 (twelve) full time employees in the last 6 (six) months of which:

(i) minimum 2 (two) civil engineer B certificates for construction issued by the Chamber of Certified Engineers and Architects of the Republic of Northern Macedonia;

(ii) minimum 1 (one) building a technician with 10 years of experience in the field of civil engineering;

— a minimum of 1 (one) occupational safety professional with a passed professional examination — a description of the technical conditions and measures used by the economic operator to ensure quality as well as describing its development and research capacities:

(a) the economic operator for the entire duration of the contract is required to have the following technical equipment:

(i) minimum 4 (four) bulldozers;

(ii) minimum 2 (two) excavators

(iii) minimum 8 (eight) three-lorry trucks with a minimum payload of 15 m

(iv) minimum 1 (one) backhoe;

(v) container for accommodation of the economic operator's employees;

(vi) mobile fuel delivery tanks for construction machinery;

— with the educational and professional qualifications of the service provider or contractor or his management staff, provided that they are not evaluated as the criterion for selecting the most favorable bid:

(a) minimum 2 (two) civil engineers with B authorization for construction issued by the Chamber of Certified Engineers and Architects of the Republic of Northern Macedonia;

(b) minimum 1 (one) civil engineer with 10 years of experience in the field of civil engineering, at least 1 (one) occupational safety practitioner with a passed professional exam certificate;

— with a statement of the average annual number of employees of the service provider or contractor and of the number of its management staff in the last three years:

— statement that the economic operator has at its disposal technical staff, with M1/M2 forms and diplomas, certificates and/or the civil engineer licenses required to deliver the service subject to this procurement;

— with a statement of the instruments, plants or technical equipment available to the service provider or contractor disturbance of the contract:

— a statement that the economic operator has the technical equipment needed to deliver the service which is the subject of this public procurement by submission of proof of ownership of technical equipment;

— with a list of things, attaching a certificate of satisfactory execution of the most important things. In order to ensure an appropriate level of competition, the contracting authority may, if necessary, consider the evidence of works performed more than five years ago, which it states in the tender documentation: List of services delivered in the last 5 (five)) years, by submitting at least 3 (three) invoices for timely and quality services delivered subject to this procurement.
