Извршување на договорот
Услови за извршување на договорот:
— the following method of payment is provided: by bank transfer within 30 days after the submitted invoice for the performed service,
— the holder of the procurement is obliged to perform the service in accordance with the needs of the end users and at the request of the contracting authority SOU Gymnasium ‘Mirce Acev’ — Prilep until 30 June 2021,
— no price correction is foreseen, i.e. the prices expressed in the bid of the most favorable bidder will be fixed for the entire duration of the public procurement contract,
— no advance payment is allowed for the execution of the public procurement contract,
— a condition for signing the contract with the selected most favorable bidder is the provision of a guarantee by the selected most favorable bidder for quality performance of the contract in the amount of 10 % of the contract value,
— the guarantee is submitted in the form of a bank guarantee in writing. The guarantee must be submitted in original form. Copies are not accepted.

Any bidder who has a legal interest in obtaining the public procurement contract and who has suffered or could suffer damage from possible violation of the provisions of this Law, may seek legal protection against decisions, actions and omissions to take action by the contracting authority. in the procedure for awarding a public procurement contract, in accordance with the conditions and the procedure provided by the Law on Public Procurement. The right to appeal in a procedure that ends with an electronic auction regarding the determination of the ability of the bidders and the full evaluation of the initial bids is exercised after the decision for selection of the most favorable bidder or annulment of the procedure.

6.3.2 The appeal should contain the following elements:
— data on the complainant (name, surname, name of the economic operator, address of residence and registered office),
— information about the representative or proxy,
— name and seat of the contracting authority,
— number and date of the procedure for awarding a public procurement contract and data on the announcement for awarding a public procurement contract,
— number and date of the decision for selection of the most favorable bid, annulment of the procedure or other decisions of the contracting authority,
— data on the actions or omissions for taking actions by the contracting authority,
— description of the factual situation,
— description of the irregularities and explanation of the same,
— proposal of evidence,
— a claim and/or claim for reimbursement of the costs of the proceedings, and
— signature of an authorized person.
6.3.3 The appellant is obliged to enclose proof of payment of a fee for conducting the procedure.
6.3.4 The complainant who is not registered in the territory of the Republic of Northern Macedonia is obliged to appoint a proxy for receiving the writ.
6.3.5 The appeal is submitted to the State Commission. The appeal is submitted in person or by registered mail at the same time to the contracting authority and to the State Commission. The day of filing the appeal by registered mail is considered the day of filing. In case of personal submission of the appeal, the contracting authority is obliged to issue a certificate to the applicant for the time of receipt.

6.3.6 In the procedure before the State Commission, the complainant, in addition to the administrative fee, pays a fee for conducting the procedure depending on the amount of the bid, as follows:
— up to EUR 10 000 in denar counter value, fee of EUR 50 in denar counter value,
— from EUR 10 000 to 70 000 in denar counter value, compensation of EUR 100 in denar counter value,
— from EUR 70 000 to 130 000 in denar counter value, compensation of EUR 150 in denar counter value, or
— over EUR 130 000 in denar counter value, compensation of 200 euros in denar counter value.
6.3.9 In case of no bid, the amount of the fee for conducting the procedure is calculated based on the estimated value of the public procurement contract, whereby the State Commission informs the complainant about the amount of the fee and the deadline within which it should submit proof of his payment.
