The contracting authority shall use the electronic auction as the last phase in the open procedure. The subject of the electronic auction is: only one element of the price of bitumen (according to the enclosed specification), that is: The price of ‘Other costs exclusive of VAT franco asphalt mixing plant, on the date of opening (5 May 2021)’, including all the costs and discounts, exclusive of VAT.

3 (three) days at the following location: Asphalt mixing plant of JP Ulici i patishta – Skopje.

Note:

1) Any individual order shall relate to quantity not lower than 25 000 kgr bitumen;

2) Transport shall be made in tanks specialised for this purpose;

3) Attestation of quality of bitumen issued by an accredited institution shall be obligatorily submitted at any delivery, related to the delivered bitumen, and shall confirm the fulfilment of the standard: МКС EN 12591:2012 or equivalent.

. Manner, deadline and place of execution are compulsory. Any bid that contains the manner, deadline and place of the execution different from those determined in the Technical Specification shall be considered unacceptable and shall be rejected as such by the Public Procurement Commission.

Capability to perform professional activity of the economic operator

— document for registered activity: document for registered activity establishing that the operator is registered as a natural person or a legal entity to perform the activity related to the public procurement contract subject or proof of membership to an appropriate professional association in accordance with the regulations of the country of registration of the respective economic operator.

Економска и финансиска состојба:

Correction of prices for the subject of the contract for this public procurement shall be allowed, only if change in the market price of bitumen (Fuel oil 1 %) and in the exchange rate of the dollar change, as follows:

— only in the part of the total price, i.e. the element of the price: ‘Market price of bitumen (Fuel oil 1 %) exclusive of VAT, 24 business days before opening’, in line with the Technical Specification, increased/lowered for the change of the price of bitumen, that is only if change in the price of bitumen on the market (Fuel oil 1 %) occurs on the date of delivery in relation to the price of bitumen on the market (Fuel oil 1 %) offered on the date of the opening of bids 5 May 2021,

— if change in the exchange rate of the dollar on the date of delivery occurs,

— the part of the total price, i.e. the price element: ‘Other costs exclusive of VAT franco asphalt mixing plant, on the date of opening (5 May 2021)’, the e-auction concerned, in line with the Technical Specification, shall remain unchanged for the whole duration and execution of the contract,

— to prove the price of bitumen on the market (Fuel oil 1 %) on the date of opening of the bids (on 5 May 2021), relevant written evidence from the relevant market for the price of bitumen (Fuel oil 1 %) (24 business days before the opening) and an exchange rate list from the NBRM for the exchange rate of the dollar (24 business days before the opening) shall be taken to the opening,

— the economic operator shall be responsible under full moral, criminal and material responsibility for the validity of the written evidence from the relevant market for the price of bitumen (Fuel oil 1 %) as well as the exchange rate of the dollar according to the NBRM, upon a previously signed statement that is enclosed to the Tender Documentation,

— the obligation for submission of relevant written evidence from the relevant market (Fuel oil 1 %) shall remain for the whole duration and execution of the contract, with compulsory enclosure to any invoice of the following:

— relevant written evidence of the price of bitumen from the relevant market (Fuel oil 1 %) on the date of delivery, i.e., from that market (Fuel oil 1 %) from which the written evidence is submitted at the very opening, and shall be compulsorily submitted from the same market (Fuel oil 1 %) for the whole duration of the contract,

— written evidence of the exchange rate of the dollar according to the NBRM on the date of delivery of bitumen,

— total amount of bitumen (on the date of delivery) = Price of ‘Other costs exclusive of VAT, franco asphalt mixing plant on the date of opening’ + Price of ‘bitumen on the market (Fuel oil 1 %) exclusive of VAT, offered on the date of opening’ increased/lowered for the change in price of bitumen, and/or if the exchange rate of the dollar changes on the date of delivery.

Техничка и професионална способност:

To qualify as capable for the performance of the concerned public procurement contract in terms of its technical or professional capacity, an economic operator shall meet the following minimum requirements:

— certificates and reports issued by competent quality control bodies with recognised competence, which test suitability of products, which competence was clearly established by the reference to specifications and standards.

The economic operator shall prove its meeting the minimum requirements:- Certificate that proves meeting the МКС EN 12591:2012 or equivalent.

All statements that are enclosed and prepared by the economic operator to prove its technical capacity, shall be signed electronically by the economic operator itself, and those need not be certified by the competent authority.

Минимално ниво(а) на стандарди:

Technical properties of Bitumen:

1) Bitumen 50/70 (Fuel oil 1 %) or equivalent;

2) Bitumen shall meet the standard МКС EN 12591:2012 or equivalent;

3) Temperature of bitumen at delivery: min 150 ºC;

The e-auction concerned shall be ‘Other costs exclusive of VAT franco asphalt mixing plant, on the date of opening (5 May 2021)’.

Note:

— Projected approximate quantities for procurement: 700 t to 1,100 t,

— The stated approximate quantities are not binding for DO and are projected based on the own needs and the current market prices.

The subject of the contract cannot be divided. The tenderer shall include all composing lots in its tender. Otherwise, the tender shall be considered as non-acceptable. The tenderer shall not divide the composing elements of the individual lot. The framework agreement shall be concluded with one economic operator. Public procurement contracts resulting from this Framework Agreement shall be concluded as follows: with duration of 12 months or up to realization of their value, whichever is first met or expired.

The individual contract shall be with value limit defined in the framework agreement, and shall include an attached technical specification and financial offer according to the e-auction, where unit prices shall be stated.

The supplier shall be obliged to deliver the subject of the contract successively, depending on the needs of the contracting authority, having received a written order certified by an authorised person (by fax or email), within: 3 (three) days at the following location: Asphalt mixing plant of JP Ulici i patishta – Skopje.

Manner, deadline and place of execution are compulsory. Any bid that contains the manner, deadline and place of the execution different from those determined in the Technical Specification shall be considered unacceptable and shall be rejected as such by the Public Procurement Commission.
