Краток опис:

The contracting authority will use the cloud platform for systems and services placed on the currently leased cloud platform, new additional systems and services, but also for gradual migration of existing systems, for which it currently uses its own resources

The integrated cloud platform should fully satisfy the necessary functions of a virtual data center with the ability to create virtual servers and using additional cloud services.

The platform should enable dynamic allocation of resources and guaranteed physical resources equivalent to virtual ones. The platform should allow easy change of resources (disk space, processors, working memory, etc.).

The platform should provide 99.95% availability annually (maximum allowed unavailability of 4 hours and 22 minutes and 58 seconds per year). The maximum allowed unavailability is an integral part of the contract that will be concluded between the contracting authority and the selected bidder.

The procurement holder should have at least two data centers - primary and secondary (redundant) data center. The offer should clearly identify the data centers in which the data will be stored, and their location should be located on the territory of the Republic of North Macedonia. Additionally, MISA and the selected bidder will conclude a special agreement, in accordance with the provisions of the Law on Personal Data Protection and other bylaws.

2.2.1 The Contracting Party shall exclude any economic operator from the public procurement procedure if it determines that the economic operator, or the person who is a member of the executive or oversight body of said economic operator or who is authorized to represent or adopt decisions or to perform oversight over the economic operator, has been sentenced with an enforceable judgement in the last 5 years on committed crime that involves elements of the following crimes stipulated under the Criminal Code:

- participation in criminal organization,

- corruption,

-tax and payroll tax evasion,

-terrorism or criminal acts related to terrorist activities,

- money laundering and financing terrorism, and

- child labor and human trafficking.

2.2.2. The contracting party shall exclude any economic operator from the public procurement procedure, if an economic operator:

- has unpaid taxes, payroll taxes or other public charges, except in cases when the economic operator has been permitted to pay taxes, payroll taxes or other public charges by means of deferred payment in compliance with special provisions and performs regular payment thereof;

- undergoes bankruptcy or liquidation proceeding;

- has been sentenced with secondary penalty - prohibition for participation in public call procedures, procedures for awarding public procurement contracts and public-private partnership contract;

- has been has been sentenced with secondary penalty – temporary or permanent prohibition to perform a particular activity;

- has been sentenced with misdemeanor sanction – prohibition to perform profession, activity or duty, or temporary prohibition to perform a particular activity, or

- issues false information/data or fails to submit information/data requested by the Contracting Party.

2.2.3 The Contracting Party shall exclude the economic operator from the public procurement procedure if the economic operator is listed under the list of issued negative references under Article 101 paragraph (3) of the Law on Public Procurements by the final deadline for delivery of bids or participation requests.

Техничка и професионална способност:

I. In order to prove its capacity to implement the relevant public procurement contract, in terms of its technical or professional capability, the economic operator must meet the following minimum requirements:

1) The Bidder should have a referent list of at least 5 (five) successfully implemented contracts for Infrastructure rental as a Service (IaaS) in the data centers of the Bidders, located on the territory of the RN Macedonia, and minimum 1 (one) of them is a rental contract with value no less than 5.000.000 denars thereat.

2) To have data centers available at all time, that meet the requirements of the technical specification under Item 5 – Information Security and Data Protection.

3) To have full time/hired professional ICT staff, with at least 2 (two) persons certified for virtualization platform that the Bidder is offering for rental.

4) To have full time/hired professional staff in charge of information Security, certified for at least one internationally recognized Information Security Certificate: CISA, CISM or CRISC.

5) The bidder is obliged to have professional staff available at all time for the entire duration of the project, holding the above stated certificates.

6) The bidder is obliged to store the data associated with the cloud platform of the Contracting Authority on a location on the territory of the Republic of North Macedonia, at all time during the entire duration of the contract.

7) To have an active insurance policy for insurance of the data centers that are specified in the Offer.

8) Have an active Microsoft SPLA provider licensing agreement for Microsoft products for the entire duration of the Cloud Rental Contract.

9) Notification regarding the elements of the contract that the Bidder intends to subcontract to a subcontractor.

QUALITY SYSTEMS STANDARDS

I. In order to prove its capacity to meet the public procurement agreement in terms of quality systems standard, the economic operation must meet the following standards:

- ISO 9001 Quality management system

- ISO 20000-1 IT Service Management System

- ISO 22301 Business Continuity Management System

- ISO 27001 Information Security Management System

Минимално ниво(а) на стандарди:

II. The Economic operator must prove its capacity to meet the minimum requirements by submitting the following:

1) By submitting Certificates for quality implemented contracts, issued by the client service users, for the last 5 (five) years, stating the time of implementation and value of the concluded contract therein.

2) By submitting a Declaration for having data centers at disposal, pursuant to the requirements of the technical specification under Item 5 thereof.

3) Regarding the manner of engagement if the professional staff hold the required certificates are employed, the Bidder is required to submit proof of full time employment (M1 / M2 form), and if he plans to recruit a professional staff, it is necessary to submit the following: a Statement stating the person he intends to hire with their consent therein, with the additional written consent by the person he intends to hire, while in order to prove the professional experience of the experts, the Bidder must submit a valid Certificate pursuant to the offered virtualization platform and a CV with short professional biography.

4) Regarding the manner of engagement if the professional staff holds the required certificate are employed, the Bidder is required to submit proof of full time employment (M1 / M2 form), and if he plans to recruit a professional staff, it is necessary to submit the following: a Statement stating the person he intends to hire with their consent therein, with the additional written consent by the person he intends to hire, while in order to prove the professional experience of the experts, the Bidder must submit a valid Certificate pursuant to the offered virtualization platform and a CV with short professional biography.

5) Statement, that in case the Bidder is chosen as provider of the Procurement, the Bidder will have professional staff available for the entire duration of the project.

6) Statement that the stored data associated with the cloud platform of the Contracting Authority, will be located on the territory of the Republic of North Macedonia, during the entire duration of the project.

7) Deliver a Statement for having an active insurance policy for insurance of the data centers that are specified in the Offer

8) Deliver a copy of the concluded Microsoft SPLA agreement or a Declaration for having an active Microsoft SPLA agreement, as well as a Declaration that during the entire duration of the contract, the Bidder will have an appropriate active Microsoft SPLA contract.

9) Declaration for having data centers at disposal, pursuant to the requirements of the technical specification under Item 5 thereof.

II The Economic Operator will prove its capacity to meet the standards by submitting in scanned format the following:

- The Economic Operator will prove it capacity to meet the standards by delivering the required certificates for meeting the stated ISO standards.

- The Statements shall be prepared and electronically signed by the electronic operator, and it doesn’t need to be certified by a competent authority.

The technical and professional capability of the economic operator can be supported by another entity, regardless of the legal relations between the economic operator and that entity except in the part of the reference list, previously concluded contracts and licenses. If the economic operator proves its technical and professional capability by invoking the support of another entity, it is obliged to prove the support with valid proof that that entity will make available to the economic operator the appropriate technical and professional resources. The entity providing technical or professional support, should not be sentenced with an enforceable judgement on committed crime that involves participation in a criminal organization, corruption, fraud or money laundering.

Услови за извршување на договорот:

The contracting authority is obliged to pay the price of the items under Table (Decomposition of the total price) successively, based on the adopted minutes for performed or delivered items and in accordance with the stated unit prices and within 30 days from the day of receipt of the invoice in the registry office of the Contracting Authority.

The signing of the quarterly minutes should be in accordance with the accounting period, deadlines and quantities stated in the technical specification, ie the time plan of activities.

Any bid containing a method of payment other than the method specified in this Item will be considered unacceptable and as such will be rejected by the Public Procurement Commission.
