Краток опис:

The contracting authority will use the cloud platform for systems and services placed on the currently leased cloud platform, new additional systems and services, but also for gradual migration of existing systems, for which it currently uses its own resources

The integrated cloud platform should fully satisfy the necessary functions of a virtual data center with the ability to create virtual servers and using additional cloud services.

The platform should enable dynamic allocation of resources and guaranteed physical resources equivalent to virtual ones. The platform should allow easy change of resources (disk space, processors, working memory, etc.).

The platform should provide 99.95% availability annually (maximum allowed unavailability of 4 hours and 22 minutes and 58 seconds per year). The maximum allowed unavailability is an integral part of the contract that will be concluded between the contracting authority and the selected bidder.

The procurement holder should have at least two data centers - primary and secondary (redundant) data center. The offer should clearly identify the data centers in which the data will be stored, and their location should be located on the territory of the Republic of North Macedonia. Additionally, MISA and the selected bidder will conclude a special agreement, in accordance with the provisions of the Law on Personal Data Protection and other bylaws.

2.2.1 The Contracting Party shall exclude any economic operator from the public procurement procedure if it determines that the economic operator, or the person who is a member of the executive or oversight body of said economic operator or who is authorized to represent or adopt decisions or to perform oversight over the economic operator, has been sentenced with an enforceable judgement in the last 5 years on committed crime that involves elements of the following crimes stipulated under the Criminal Code:

- participation in criminal organization,

- corruption,

-tax and payroll tax evasion,

-terrorism or criminal acts related to terrorist activities,

- money laundering and financing terrorism, and

- child labor and human trafficking.

2.2.2. The contracting party shall exclude any economic operator from the public procurement procedure, if an economic operator:

- has unpaid taxes, payroll taxes or other public charges, except in cases when the economic operator has been permitted to pay taxes, payroll taxes or other public charges by means of deferred payment in compliance with special provisions and performs regular payment thereof;

- undergoes bankruptcy or liquidation proceeding;

- has been sentenced with secondary penalty - prohibition for participation in public call procedures, procedures for awarding public procurement contracts and public-private partnership contract;

- has been has been sentenced with secondary penalty – temporary or permanent prohibition to perform a particular activity;

- has been sentenced with misdemeanor sanction – prohibition to perform profession, activity or duty, or temporary prohibition to perform a particular activity, or

- issues false information/data or fails to submit information/data requested by the Contracting Party.

2.2.3 The Contracting Party shall exclude the economic operator from the public procurement procedure if the economic operator is listed under the list of issued negative references under Article 101 paragraph (3) of the Law on Public Procurements by the final deadline for delivery of bids or participation requests.

2.2.4 The Contracting Party shall exclude the economic operator from the public procurement procedure in cases when the exclusion condition is enlisted under the tender documentation:

a) if the contracting party has valid reasons to determine that the economic operator has signed contracts with other economic operator with purpose or effect to distort competition. The determination of the contracting party stipulated under this item shall be considered valid if the Commission for Protection of Competition notifies the contracting party that it will initiate a misdemeanor procedure within a deadline of 15 days, based on notice lodged by the contracting party;

b) if the economic operator has demonstrated significant or constant shortcomings in meeting key duties in previous public procurement contracts or previous concession and public-private partnership contracts signed with said contracting party, which, in turn, resulted in unilateral contract termination, damage claims or undertaking of other similar sanctions by the contracting party;

c) if the economic operator exercises illegal influence over the contracting party’s decision or for acquisition of confidential information that would give said economic operator illegal advantage in the public procurement procedure.

2.4.Technical or professional ability

I. To qualify as eligible to perform the contract in the public procurement in terms of its technical or professional ability, the economic operator must meet the following minimum conditions:

1) The Bidder has a Reference list of at least 5 (five) current or realized contracts for renting Infrastructure as a Service (IaaS) service in the data centers of the Bidder located on the territory of the Republic of North Macedonia, of which at least 1 (one) lease contract with a value of not less than 5,000,000 denars, and if the reference list includes current agreements, they should be executed for a period of minimum one yearTo have data centers available that meet the requirements of the technical specification from item 5 - Information security and data protection.

2) To have employed or hired professional ICT staff of at least 2 (two) persons with appropriate certificates for the virtualization platform which it offers for rent.

3) To have employed or hired at least one person in charge of information security with at least one internationally recognized certificate for information security: CISA, CISM or CRISC.

4) For the entire duration of the contract, the bidder is obliged to have at his disposal professionals who will possess the stated professional qualifications.

5) For the entire duration of the contract, the bidder is obliged to store the data associated with the cloud platform of the Contracting Authority and locally to save them in the territory of the Republic of Macedonia.

6) To have an active insurance policy for insurance of the data centers that are specified in the Offer.

7) Have an active Microsoft SPLA provider licensing agreement for Microsoft products for the entire duration of the Cloud Lease Contract.

8) Notification of the elements of the contract that the Bidder intends to transfer to a subcontractor.

2.5. Standards for quality systems

I. To qualify as eligible to perform the contract in subject contract for public procurement in terms of quality system standards, the economic operator must meet the following standards:

- ISO 9001 Quality management system (Систем за управување со квалитет)

- ISO 20000-1 IT Service Management System (Систем за управување со ИТ Услуги)

- ISO 22301 Business Continuity Management System (Систем за управување со деловен континуитет)

- ISO 27001 Information Security Management System (Систем за управување со безбедност на информации).

Минимално ниво(а) на стандарди:

II. The economic operator proves the fulfillment of the minimum conditions by submitting:

1) Delivery of certificates for quality executed contracts, which should indicate the time of execution and the value of the concluded contract, or if such confirmation can not be provided, the Bidder proves it by submitting a copy of concluded contracts and his statement that the same are executed.

2) In case the Bidder has employed experts with the necessary certificates as evidence, it is necessary to submit an M1 / M2 form, but if it plans to hire experts as evidence, the bidder should submit: Statements from the Bidder stating the experts who have in consider to hire them with their consent, Statements from the experts with their written consent that they agree to be hired, while to prove the expertise, an appropriate valid certificate is submitted in accordance with the offered virtualization platform and CV with a short professional biography.

3) In case the Bidder has employed an expert with the required certificate as evidence, it is necessary to submit an M1 / M2 form, but if he plans to hire a person as evidence, the bidder should submit: Statements from the Bidder stating the expert who has in mind to hire him with his consent, Statement from the person with his written consent that he agrees to be hired, while for proving the expertise is submitted an appropriate valid certificate and CV with a short professional biography.

4) Statement that for the entire duration of the contract, the Bidder, if selected as the Procurement Holder, will have at its disposal professionals with the stated professional qualifications.

5) Statement that the stored data associated with the cloud platform of the Contracting Authority will be located on the territory of the Republic of Macedonia for the entire period of the contract.

6) Submitting a statement that there is an active insurance policy for the insurance of the data centers that are specified in the Offer.

7) Submitting a copy of the concluded contract Microsoft SPLA or Statement that there is an active Microsoft SPLA contract, as well as Statement that for the entire duration of the contract will take care to have an appropriate active Microsoft contract

8) Statement of notification for the elements of the contract that the Bidder intends to leave to a subcontractor.

Note:

* All listed documents, except the recommendations, certificates and proof of regular working relationship, are prepared and electronically signed by the economic operator and they do not have to be certified by a competent authority.

* Certificate means a document issued by the relevant manufacturer and / or an authorized certification center by the manufacturer confirming the acquired knowledge of the Certificate Holder. Documents for attended trainings will not be accepted as proof of acquired knowledge / expertise.

* For M1 / M2 form that will be submitted, the bidder needs to shade the personal identification numbers of the persons, ie they should not be visible in accordance with the Law on Personal Data Protection.

2.5. Standards for quality systems

I. To qualify as eligible to perform the contract in subject contract for public procurement in terms of quality system standards, the economic operator must meet the following standards:

- ISO 9001 Quality management system (Систем за управување со квалитет)

- ISO 20000-1 IT Service Management System (Систем за управување со ИТ Услуги)

- ISO 22301 Business Continuity Management System (Систем за управување со деловен континуитет)

- ISO 27001 Information Security Management System (Систем за управување со безбедност на информации).

Offer guarantee

As part of the bid, the economic operator must provide a bid guarantee (participation guarantee) in the amount of at least 3% of the total value of the bid without VAT.

* The bank guarantee of the bid should be 3% of the estimated value of the contract, ie the maximum value of the contract, because the minimum quantities cannot be determined.

The guarantee is in the form of a bank guarantee. All banks are acceptable to the contracting authority. The guarantee must be submitted in the original form and in the procedures that are carried out electronically. Scanned / Copies are not accepted / The guarantee can be submitted in paper form until the expiration of the deadline for submission of bids or at the public opening by the authorized representatives of the bidders. If the guarantee is available in original electronic form / electronic guarantee / it is attached through the ESPP together with the offer and the accompanying documentation. The guarantee must have a validity period of at least until the expiration date of the offer. Any bid that does not contain a bid guarantee, or contains a bid guarantee that is not in accordance with the conditions in the tender documentation, will be rejected by the contracting authority as unacceptable.

The bid guarantee of the unsuccessful economic operators is returned in accordance with the legal deadline stated in the Public Procurement Law.

The bid guarantee can be charged if the bidder withdraws its bid before the expiration of its validity period, does not accept the correction of the arithmetic errors by the commission, does not sign the public procurement contract in accordance with the terms of the tender documentation and does not provide a guarantee for quality execution of the contract

For the publication of the negative reference the contracting authority

with decide for the decision of selection of the procedure, or the cancellation of the procedure, an the same it will be published within 3 (three) working days from the day of the final decision for selection or cancellation of the procedure
