Extension of support for Licenses Used for ICT Projects

By carrying out this procurement, it is necessary to extend and upgrade the Enterprise type agreement with Microsoft for Software Assurance for an additional 36 months (starting from 1 January 2020) and to provide software license support services to obtain fullfillments and possibility for upgrades to the latest versions of the software in the period at least until 31 December 2022. The list of software licenses is given in Appendix 1. The economic operator must also submit additional licenses in accordance with the list in Annex 2, for which support with newer versions, patches must be active at least until the expiration of the license agreement in Appendix 1.

The Ministry of Information Society and Administration (MISA) in 2016 implemented an IPA project through which client and server software licenses were provided by Microsoft. According to the Enterprise Agreement with details Enrollment ID: 65455595, Parent Program: E2189473 and MBSA: U1824537 the validity of the support for software licenses (known as Microsoft SA) lasts until 31 December 2019. During the conduction of the project, software licenses were installed in the following institutions:

• Ministry of Information Society and Administration, Employment Agency, Health Insurance Fund, Ministry of Foreign Affairs, Ministry of Justice;

• Registry Office, State Election Commission, First instance Court 1, First instance Court 2 and Macedonian Academic Research Network - MARNET.

In the past period, through this agreement, MISA procured additional licenses for other national ICT projects.

2.2.1) The contracting party shall exclude any economic operator from the public procurement procedure if it determines that the economic operator, or the person who is a member of the executive or oversight body of said economic operator or who is authorised to represent or adopt decisions or to perform oversight over the economic operator, has been sentenced with an enforceable judgement in the last 5 years on committed crime that involves elements of the following crimes stipulated under the Criminal Code:

— participation in criminal organisation;

— corruption;

— tax and payroll tax evasion;

— terrorism or criminal acts related to terrorist activities;

— money laundering and financing terrorism; and

— child labor and human trafficking.

2.2.2) The contracting party shall exclude any economic operator from the public procurement procedure, if an economic operator:

— has unpaid taxes, payroll taxes or other public charges, except in cases when the economic operator has been permitted to pay taxes, payroll taxes or other public charges by means of deferred payment in compliance with special provisions and performs regular payment thereof;

— undergoes bankruptcy or liquidation proceeding;

— has been sentenced with secondary penalty — prohibition for participation in public call procedures, procedures for awarding public procurement contracts and public-private partnership contract;

— has been has been sentenced with secondary penalty – temporary or permanent prohibition to perform a particular activity;

— has been sentenced with misdemeanor sanction – prohibition to perform profession, activity or duty, or temporary prohibition to perform a particular activity; or

— issues false information/data or fails to submit information/data requested by the contracting party.

2.2.3) The contracting party shall exclude the economic operator from the public procurement procedure if the economic operator is listed under the list of issued negative references under Article 101 paragraph (3) of the Law on Public Procurements by the final deadline for delivery of bids or participation requests.

2.2.4) The contracting party shall exclude the economic operator from the public procurement procedure in cases when the exclusion condition is enlisted under the tender documentation:

(a) if the contracting party has valid reasons to determine that the economic operator has signed contracts with other economic operator with purpose or effect to distort competition. The determination of the contracting party stipulated under this item shall be considered valid if the Commission for Protection of Competition notifies the contracting party that it will initiate a misdemeanor procedure within a deadline of 15 days, based on notice lodged by the contracting party;

(b) if the economic operator has demonstrated significant or constant shortcomings in meeting key duties in previous public procurement contracts or previous concession and public-private partnership contracts signed with said contracting party, which, in turn, resulted in unilateral contract termination, damage claims or undertaking of other similar sanctions by the contracting party;

(c) if the economic operator exercises illegal influence over the contracting party’s decision or for acquisition of confidential information that would give said economic operator illegal advantage in the public procurement procedure.

2.2.5) To prove that there are no reasons to be excluded from the procedure, the economic operator shall submit the following documents:

— statement of the economic operator (of the person who is a member of the executive or oversight body of said economic operator or who is authorised to represent or to adopt decisions, or to perform oversight over said economic operator) that in the past 5 years there is no enforceable judgement against them for committed crimes that involve elements of the following criminal acts stipulated under the Criminal Code: corruption.

I. In order to qualify as eligible to perform the contract for public procurement from the aspect of its technical or professional capacity, the economic operator must meet the following minimum requirements:

1) The bidder needs to have an authorisation for sale on the territory of the Republic of North Macedonia, also known as Microsoft Authorised LSP.

The contracting authority will pay the total price of the bid based on the records approved for the qualitative execution of the procurement subject, for each quarter a separate report. Within 30 days from the day of receipt of the bill at the registration office of the contracting authority, the payment procedure will begin.

The contracting authority for this tender procurement provided MKD 43 800 000.00 without VAT, financial resources from the budget which are distributed for payment with the following dynamics without VAT:

— MKD 5 300 000.00 in 2021;

— MKD 13 500 000.00 in 2022;

— MKD 25 000 000.00 in 2023.

The contracting authority has not requested a loan from Microsoft, so the selected bidder will have to take into account this payment dynamics by the contracting authority for this tender procurement.

Bidders can follow the public opening through the e-nabvki.gov.mk system or in person at the MISA headquarters. All participants must register in the system e-nabavki.gov.mk and bids are submitted exclusively through the same system.

4.7.2) Additional information on the use of digital certificates: the offer is signed electronically using a digital certificate issued by a registered certificate.

Offer guarantee

As part of the offer, the economic operator must provide an offer guarantee (participation guarantee) in the amount of at least 3 % of the total value of the offer without VAT.

The guarantee is in the form of a bank guarantee. All banks are acceptable to the contracting authority. The guarantee must be submitted in the original form and in the procedures that are carried out electronically. Scanned/copies are not accepted/the guarantee can be submitted in paper form until the expiration of the deadline for submission of bids or at the public opening by the authorised representatives of the bidders. If the guarantee is available in original electronic form/electronic guarantee/it is attached through the ESPP together with the offer and the accompanying documentation. The guarantee must have a validity period of at least until the expiration date of the offer. Any bid that does not contain a bid guarantee, or contains a bid guarantee that is not in accordance with the conditions in the tender documentation, will be rejected by the contracting authority as unacceptable.

The bid guarantee of the unsuccessful economic operators is returned in accordance with the legal deadline stated in the Public Procurement Law.

The bid guarantee can be charged if the bidder withdraws its bid before the expiration of its validity period, does not accept the correction of the arithmetic errors by the commission, does not sign the public procurement contract in accordance with the terms of the tender documentation and does not provide a guarantee for quality execution of the contract

For the publication of the negative reference the contracting authority

With decide for the decision of selection of the procedure, or the cancellation of the procedure, an the same it will be published within 3 (three) working days from the day of the final decision for selection or cancellation of the procedure.

The economic operator has the right to appeal in an appeal procedure in accordance with the PPL.
