To prove the personal condition, the economic operator should submit the following documents:
— statement that in the last 5 years no final court verdict has been pronounced for a crime committed by Article 88 paragraph 1 of the PPL,
— confirmation that no bankruptcy procedure has been opened by a competent authority,
— confirmation that no liquidation procedure has been opened by a competent authority,
— certificate of paid taxes, contributions and other public duties from a competent authority of the country where the economic operator is registered,
— confirmation from the Registry of Penalties for committed criminal acts of the legal entities that no secondary…
… penalty of prohibition to participate in public call procedures, award of public procurement contracts and contracts for public private partnership,
… punishment temporary or permanent prohibition to perform a certain activity,
— certificate that no misdemeanor sanction has been pronounced with a final judgment — prohibition to perform profession, activity or duty, i.e. temporary prohibition to perform a certain activity document for registered activity:
— to prove the ability to perform the professional activity, the bidder should submit with its bid a document for registered activity as proof that he is registered as a natural or legal person for performing the activity related to the subject of public procurement contract or proof that it belongs to an appropriate professional association in accordance with regulations of the country where it is registered.

— when determining the ability to perform professional activity of the economic operators, the contracting authority also requires proof issued by a competent authority body for fulfilling the special conditions for performing the activity prescribed in accordance with law which are refer to the subject of public procurement. In order to prove the above economic operator submits evidence issued by a competent authority to meet the special conditions for performing the activity prescribed in accordance with the law that refer to the subject of the contract, i.e.: Decision for issuing a license for establishment and operation of the financial leasing issuer issued by a competent institution (Ministry of Finance)

— with a list of major deliveries of goods or services performed with values, dates, buyers (contractual authorities or economic operators), by providing confirmation of deliveries or services performed: for to qualify as capable of executing the subject public procurement contract in terms of his technical or professional ability, the economic operator should meet the following minimum conditions:

— the economic operator in the last 3 (three) years to have delivered minimum 3 construction machines according to the part for which it participates (for Part 1, Part 2 and Part 3) and minimum 10 (ten) dump trucks (for Part 4).
— satisfaction of the technical characteristics accordingly the type offered in the section. The economic operator proves the fulfillment of the minimum requirements by submitting:
— list of main deliveries of goods in the last three years, with values.
Dates, number of delivered machines/trucks, buyers (contracting authorities or economic operators), by providing confirmation of completed deliveries.
— for each offered position in the section, economic operator submits appropriate technical documentation (catalog, technical documentation, technical manufacturer's book, brochures, etc.) to prove the declared technical characteristics and the reliability of which the Economic Operator is obliged to confirm if it required by the contracting authority.
