The economic operator shall submit the following documents:

- Document for registered activity: Condition for determining the ability to perform a professional activity, the contracting authority requires each economic operator to submit proof that it is registered as natural or a legal entity performing the activity related to the subject of the procurement or proof that it belongs to appropriate professional association in accordance with the regulations of the country where the License A for designing first category buildings is registered in accordance with the current Law on Construction (Official Gazette of the Republic of Macedonia No. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27 / 14, 28/14, 42/14, 115/14, 149/14, 187/14, 44/15, 129/15, 217/15, 226/15, 30/16, 31/16, 39/16, 71/16, 132 / 16 and 35/18) or for Foreign economic eperators Certificate issued by the body responsible for performing works regarding the spatial planning in accordance with Article 42 of the Law on Construction.

In order to prove its personal condition, the economic operator shall submit the following documents:

—a statement that in the last 5 years it was not rendered a court verdict for a crime committed by Article 88 paragraph 1 of the Law on public procurement,

— confirmation that there are no bankruptcy proceedings undertaken by the competent authority;

— confirmation that there is no liquidation procedure undertaken by the competent authority;

— receipt for paid taxes, contributions and other public duties by the competent authority of the country where the economic operator is established;

— certificate from the Registry of penalties for crimes committed by legal persons that minor penalty…

… — ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership — has not been imposed;

… for temporary or permanent prohibition of a specific activity has not been imposed;

— confirmation that the final sentence has not been imposed as a crime sanction that prohibits performing professional activity or duty, i.e. temporary prohibition for performing specific activity.

Економска и финансиска состојба:

Economic and financial standing of the economic operator:

- Balance sheet report issued by a competent authority, i.e. audited balance sheet, or excerpts from the balance sheet report, in cases where the publication of the balance sheet is prescribed by law in the country where the economic operator is registered: To qualify as capable of executing the subject public procurement contract from the aspect of its economic and

financial standing, the economic operator should have achieved a total income of not less than MKD 20,000,000.00 in the last 3 (three) financial years (2018, 2019 and 2020) for each year individually. The method of proving is stated in the tender documentation

- Statement of the total income of the company (data from the income statement issued by a competent authority, i.e. revised income statement) and, where required, a statement of income in the area covered with the public procurement contract, mostly for the last three financial years for which such information is available depending on the date on which the company was established or commenced operations and depending on the availability of such information: To qualify as capable of performing the subject public procurement contract from the aspect of its economic and financial standing, the economic operator should have achieved a total income of not less than MKD 20,000,000.00 in the last 3 (three) financial years (2018, 2019, and 2020) for each year separately. The way of proving is stated in the tender documentation.

Technical or professional ability of the economic operator:

- description of the technical staff and the technical bodies that will participate in the execution of the public procurement, especially of those responsible for quality control, and in the case of public procurement of works, those who will be involved in carrying out the work, regardless of whether they are employed at the economic operator or not: The economic operator should have employed or hired the following staff: - min. 1 B.Sc. engineer-architect with authorization to prepare urban plans i.e. planner, signatory of planning documentation; - min. 1 B.Sc. civil engineer with authorization A for design; - min. 1 B.Sc. mechanical engineer, with authorization A for design; - min. 1 B.Sc. electrical engineer with authorization A for design; - min. 1 B.Sc. civil engineer with authorization A for preparation of project documentation of geotechnics; - min. 1 B.Sc. geodetic engineer with Authorization A for preparation of project documentation of geodesy; - min. 1 Environmental Impact Assessment (EIA) Expert with Certificate for passed professional examination i.e. an expert for environmental impact assessment of projects. The method of proving is stated in the tender documentation.
