Any economic operator who is registered as a natural or legal person for performing the activity related to the subject of procurement or belongs to an appropriate professional association in accordance with the regulations of the country of registration shall have the right to participate in the subject procedure.

The contracting authority shall exclude the economic operator from the public procurement procedure if it determines that the economic operator or the person who is a member of the management or supervisory body of that economic operator or has powers to represent or make decisions or supervise it in the last 5 years has been sentenced for years by a final court verdict for a criminal offence which has elements of the following criminal offences established in the criminal code:

— participation in criminal association,
— corruption,
— tax evasion and contributions,
— terrorism or offences related to terrorist activities,
— money laundering and financing of terrorism, and
— abuse of child labour and human trafficking.
The contracting authority shall exclude from the procedure for public procurement contract awarding every economic operator:
a) who has unpaid taxes, contributions or other public duties, unless he has been authorised to defer payment of taxes, contributions or other public duties in accordance with special regulations and regularly pays them;
b) is in bankruptcy or liquidation procedure;
c) against which secondary penalty prohibition to participate in public calls, contracts for public procurement and contracts for public private partnership awarding has been passed;
d) against which secondary penalty of temporary or permanent prohibition to perform certain activity has been passed;
e) against whom misdemeanour sanction — prohibition to perform profession, activity or duty or temporary prohibition to perform activity has been passed;
f) who has given false data or failed to deliver the data requested by the contracting authority.
The right to participate in the procedure shall have every economic operator that fulfils the special conditions for performing the activity prescribed by law, which refer to the subject of procurement as follows:
— every economic operator that holds a license for performing energy activity, trade, or supply of electricity, issued by the Energy Regulatory Commission of the Republic of North Macedonia,
— every economic operator that possesses EIC code issued by AD MEPSO — Skopje, as a supplier of electricity and/or as a trader of electricity,
— every economic operator that possesses decision for participation on the electricity market in accordance with the rules on the electricity market,
— every economic operator that has a valid agreement for participation on the electricity market.

As part of the tender, the economic operator shall provide guarantee of the tender (guarantee for participation) at an amount of at least 3 % of the total value of the tender without VAT included.
More information on the requested bank guarantee is available in the tender documentation.
The signing of the contract with the selected most favourable tenderer shall be conditioned by the provision of guarantee by the selected most favourable tenderer for high quality execution of the contract to the level of 5 %of the contract value.
