Procurement of Services for Collocation of IT Equipment

Ministry of Information Society and Administration

Subject of this procurement are services for collocation of equipment located in the primary and secondary Data Center on the territory of the Republic of North Macedonia for a period of 60 months. One of the key projects of the Ministry is the project ‘Population Register’, which is established the Central Population Register of the Republic of North Macedonia through the establishment of a single. The Central Population Register is used by the institutions that implement administrative procedures for the population in accordance with the Law and the businesses that need to check the data of the citizens. For high availability of the system, an equipment is installed in two locations — primary and backup location, which services are part of this procurement. In addition to this project, in the ministry are being implemented several other projects that require collocation services and IT equipements.

2.2.1) The contracting party shall exclude any economic operator from the public procurement procedure if it determines that the economic operator, or the person who is a member of the executive or oversight body of said economic operator or who is authorised to represent or adopt decisions or to perform oversight over the economic operator, has been sentenced with an enforceable judgement in the last 5 years on committed crime that involves elements of the following crimes stipulated under the criminal code:

— participation in criminal organisation;

— corruption;

— tax and payroll tax evasion;

— terrorism or criminal acts related to terrorist activities;

— money laundering and financing terrorism; and

— child labor and human trafficking.

2.2.2) The contracting party shall exclude any economic operator from the public procurement procedure, if an economic operator:

— has unpaid taxes, payroll taxes or other public charges, except in cases when the economic operator has been permitted to pay taxes, payroll taxes or other public charges by means of deferred payment in compliance with special provisions and performs regular payment thereof;

— undergoes bankruptcy or liquidation proceeding;

— has been sentenced with secondary penalty — prohibition for participation in public call procedures, procedures for awarding public procurement contracts and public-private partnership contract;

— has been has been sentenced with secondary penalty – temporary or permanent prohibition to perform a particular activity;

— has been sentenced with misdemeanor sanction – prohibition to perform profession, activity or duty, or temporary prohibition to perform a particular activity; or

— issues false information/data or fails to submit information/data requested by the Contracting Party.

2.2.3) The contracting party shall exclude the economic operator from the public procurement procedure if the economic operator is listed under the list of issued negative references under Article 101 paragraph (3) of the Law on Public Procurements by the final deadline for delivery of bids or participation requests;

2.2.4) The contracting party shall exclude the economic operator from the public procurement procedure in cases when the exclusion condition is enlisted under the tender documentation:

(a) if the contracting party has valid reasons to determine that the economic operator has signed contracts with other economic operator with purpose or effect to distort competition. The determination of the contracting party stipulated under this item shall be considered valid if the Commission for Protection of Competition notifies the contracting party that it will initiate a misdemeanor procedure within a deadline of 15 days, based on notice lodged by the contracting party;

(b) if the economic operator has demonstrated significant or constant shortcomings in meeting key duties in previous public procurement contracts or previous concession and public-private partnership contracts signed with said contracting party, which, in turn, resulted in unilateral contract termination, damage claims or undertaking of other similar sanctions by the contracting party;

(c) if the economic operator exercises illegal influence over the contracting party’s decision or for acquisition of confidential information that would give said economic operator illegal advantage in the public procurement procedure.

2.2.5) To prove that there are no reasons to be excluded from the procedure, the economic operator shall submit the following documents:

— statement of the economic operator (of the person who is a member of the executive or oversight body of said economic operator or who is authorised to represent or to adopt decisions, or to perform oversight over said economic operator) that in the past 5 years there is no enforceable judgement against them for committed crimes that involve elements of the following criminal acts stipulated under the Criminal Code: corruptio

2.4)Technical or professional ability

I. In order to qualify as eligible to perform the contract for public procurement from the aspect of its technical or professional capacity, the economic operator must meet the following minimum requirements:

1) The bidder to have a reference list of at least 1 realised contract for rent of ICTD resources or attachments of the equipment in the Data Center of the bidder or the bidder has concluded an agreement with the owner of the Data Center who has at least 1 agreement for renting ICTD resources or attachments of equipment in the Data Center;

2) To have available or appropriate agreement for use of the Data Center in accordance with the requirements of the technical specification from the point 3.1;

3) To have an active insurance policy of the Data Center;

4) To Have employed or in full-time professional ICTD staff of at least 3 people with certificates suitable for the equipment it offers for rent, where at least one certificate is required for each type of equipment (firewall, switch, NLB);

5) Notification of the elements of the contract that the Bidder intends to assign to a subcontractor.

II. The economic operator proves the fulfillment of the minimum conditions by presenting:

1) Submitting a certificate for a quality contract to the specified Data Center and an appropriate agreement if the owner it is not of the Data Center;

2) Submitting a statement that a Data Center is available in accordance with the requirements of the technical specification from point 3.1;

3) Submitting a statement that there is an active Data Center security policy;

4) If the bidder has full-time professionals with the necessary certifications as proof of commitment, it is necessary to submit an M1/M2 form, but if he plans to hire professionals as proof, the bidder must submit statements from the bidder in which he will list the experts he intends to hire with their consent, statements from the experts with their written consent that they agree to be hired, while for the certification of expertise is presented an appropriate certificate valid in accordance with equipment provided and CV with short professional biography;

5) Statement on the notification of the elements of the contract that the Bidder intends to assign to a subcontractor.

Note:

* All listed documents, except recommendations, certificates and proofs of regular employment, have been prepared and signed electronically by the economic operator and they do not need to be certified by a competent authority* certificate means a document issued by the relevant manufacturer and/or an authorised certification center by the manufacturer confirming the knowledge obtained by the Certificate Holder. Documents for attended trainings will not be accepted as evidence of acquired knowledge/expertise.

* For the M1/M2 form to be submitted, the bidder must obscure the personal identification numbers of the persons, ie. They should not be visible in accordance with the Law on Personal Data Protection.

Note:

Standards for quality systems

I. To qualify as eligible to conduct the public procurement in question in terms of quality system standards, the economic operator must meet the following standards:

— ISO 9001 Quality management system (Систем за управување со квалитет);

— ISO 20000-1 IT Service Management System (Систем за управување со ИТ Услуги);

— ISO 22301 Business Continuity Management System (Систем за управување со деловен континуитет);

— ISO 27001 Information Security Management System (Систем за управување со безбедност на информации).

II. The economic operator proves the fulfillment of the standards by submitting the required certificates for the fulfillment of the ISO Standards

Извршување на договорот
Услови за извршување на договорот:

The contracting authority will make the payment for the use of the services every 3 months, in accordance with the calculation with monthly unit prices only for the services used with the price from the items in the Table (Total price), and based on the quarterly report submitted and term 30 days from the day of receiving the bill in the archive of the contracting authority.

The contracting authority will only pay for the services used. The signing of the report must be in accordance with the calculation period, deadlines and quantities specified in the technical specification, ie. Schedule time of activities. The method of payment is mandatory. Any bid containing a payment method other than that specified in this point will be considered unacceptable and as such will be rejected by the Public Procurement Commission.

4.7.2) Additional information on the use of digital certificates: The offer is signed electronically using a digital certificate issued by a registered certificate issuer at the Ministry of Finance of the Republic of Macedonia.

The digital certificate must be valid at least until the moment of public opening.

A foreign economic operator can sign the bid electronically using a qualified digital cert

Offer guarantee

As part of the bid, the economic operator must provide a bid guarantee (participation guarantee) in the amount of at least 3 % of the total value of the bid without VAT.

The guarantee is in the form of a bank guarantee. All banks are acceptable to the contracting authority. The guarantee must be submitted in the original form and in the procedures that are carried out electronically. Scanned/copies are not accepted/the guarantee can be submitted in paper form until the expiration of the deadline for submission of bids or at the public opening by the authorised representatives of the bidders. If the guarantee is available in original electronic form/electronic guarantee/it is attached through the ESPP together with the offer and the accompanying documentation. The guarantee must have a validity period of at least until the expiration date of the offer. Any bid that does not contain a bid guarantee, or contains a bid guarantee that is not in accordance with the conditions in the tender documentation, will be rejected by the contracting authority as unacceptable.

The bid guarantee of the unsuccessful economic operators is returned in accordance with the legal deadline stated in the Public Procurement Law.

The bid guarantee can be charged if the bidder withdraws its bid before the expiration of its validity period, does not accept the correction of the arithmetic errors by the commission, does not sign the public procurement contract in accordance with the terms of the tender documentation and does not provide a guarantee for quality execution of the contract for the publication of the negative reference the contracting authority

With decide for the decision of selection of the procedure, or the cancellation of the procedure, an the same it will be published within 3 (three) working days from the day of the final decision for selection or cancellation of the procedure.

The economic operator has the right to appeal in an appeal procedure in accordance with the PPL.
