Subject of this procurement are services for upgrade and maintenance of an IT system. This IT system, i.e. the Second Service Bus of the interoperability platform (hereinafter referred to as MIM2), consists of hardware infrastructure, system and application software.

The procurement should include upgrade of the platform by implementing a communication client node, as well as preventive, reactive and adaptive maintenance of MIM2:

• Upgrade of MIM2 by implementing a communication client node. According to the current architecture of MIM2, each communication client represents at most one institution/company on the interoperability platform. This means that only one institution/company user of the platform can be identified behind one communication client. This architecture has proven to be limiting and it is necessary to upgrade MIM2 by introducing a communication client node by providing possibility for identification of multiple institutions/companies simultaneously. Namely, the goal to be achieved with the upgrade and the introduction of this new type of communication client is to change the topology of MIM2 from star to snowflake.

• Preventive

Proactive solving of technical and systemic challenges by continuously diagnosing the current situation, i.e. recognizing all possible technical and system problems and solving the same;

Functional maintenance which includes a series of actions of measuring, recording and analysis of relevant parameters and timely undertaking of appropriate measures, in order to ensure optimal and reliable operation of MIM2 and minimize the possibility of failure that would result in unexpected downtime.

Installation and configuration of system patches, testing and upgrade of software versions of the products used in MIM2 as well as necessary configurations of network equipment in order to ensure smooth and safe operation of the platform.

• Reactive maintenance of MIM2, ie problem solving based on reported incidents, by determining the cause of the problem and solving the same in the shortest possible time. This particularly covers, but is not limited to, technical defects, network outages, hardware failure, software problems, bugs, communication difficulties, malfunction of MIM2 or its components thereof.

• Adaptive maintenance

Adaptive maintenance includes 4500 working hours for new requests related to the overall MIM2 infrastructure and software.

Support activities for the contracting authority related to the promotion and advancement of the interoperability platform usage.

2.2.1 The Contracting Party shall exclude any economic operator from the public procurement procedure if it determines that the economic operator, or the person who is a member of the executive or oversight body of said economic operator or who is authorized to represent or adopt decisions or to perform oversight over the economic operator, has been sentenced with an enforceable judgement in the last 5 years on committed crime that involves elements of the following crimes stipulated under the Criminal Code:

- participation in criminal organization,

- corruption,

-tax and payroll tax evasion,

-terrorism or criminal acts related to terrorist activities,

- money laundering and financing terrorism, and

- child labor and human trafficking.

2.2.2. The contracting party shall exclude any economic operator from the public procurement procedure, if an economic operator:

- has unpaid taxes, payroll taxes or other public charges, except in cases when the economic operator has been permitted to pay taxes, payroll taxes or other public charges by means of deferred payment in compliance with special provisions and performs regular payment thereof;

- undergoes bankruptcy or liquidation proceeding;

- has been sentenced with secondary penalty - prohibition for participation in public call procedures, procedures for awarding public procurement contracts and public-private partnership contract;

- has been has been sentenced with secondary penalty – temporary or permanent prohibition to perform a particular activity;

- has been sentenced with misdemeanor sanction – prohibition to perform profession, activity or duty, or temporary prohibition to perform a particular activity, or

- issues false information/data or fails to submit information/data requested by the Contracting Party.

2.2.3 The Contracting Party shall exclude the economic operator from the public procurement procedure if the economic operator is listed under the list of issued negative references under Article 101 paragraph (3) of the Law on Public Procurements by the final deadline for delivery of bids or participation requests.

2.2.4 The Contracting Party shall exclude the economic operator from the public procurement procedure in cases when the exclusion condition is enlisted under the tender documentation:

a) if the contracting party has valid reasons to determine that the economic operator has signed contracts with other economic operator with purpose or effect to distort competition. The determination of the contracting party stipulated under this item shall be considered valid if the Commission for Protection of Competition notifies the contracting party that it will initiate a misdemeanor procedure within a deadline of 15 days, based on notice lodged by the contracting party;

b) if the economic operator has demonstrated significant or constant shortcomings in meeting key duties in previous public procurement contracts or previous concession and public-private partnership contracts signed with said contracting party, which, in turn, resulted in unilateral contract termination, damage claims or undertaking of other similar sanctions by the contracting party;

c) if the economic operator exercises illegal influence over the contracting party’s decision or for acquisition of confidential information that would give said economic operator illegal advantage in the public procurement procedure.

Техничка и професионална способност:

I. In order to prove its capacity to implement the relevant public procurement contract in terms of its technical or professional capability, the economic operator must meet the following minimum requirements:

1) To have full time/hired professional staff available at all time for the entire duration of the contract, holding the following professional qualifications:

a) At least one (1) project manager with at least 5 (five) years of working experience, who is required to have an appropriate university education and/or hold an appropriate and globally recognized valid Certification for Project Manager. The project manager must be fluent in spoken and written Macedonian language. For foreign citizens, the knowledge of the Macedonian language is proved by submitting an appropriate certificate.

b) At least 2 (two) persons with a minimum of 3 (three) years of work experience as a business analyst, engaged in at least three (3) projects.

c) At least 5 (five) people certified for Microsoft Visual Studio with at least 3 (three) years of work experience, engaged in at least three (3) projects, each of which must be a holder of at least one of the listed certificates:

o MCSA: Web Applications

o MCSD: App Builder

o MS: Universal Windows Platform

d) At least 2 (two) persons certified for databases with at least 3 (three) years of relevant work experience, engaged in minimum of three (3) projects, and each of them to be holder of MCSA certification for MS SQL Server 2012 or for a more advanced version of MS SQL Server

e) At least two (2) persons with confirmed at least 3 (three) years of work experience, engaged in at least 2 (two) projects for configuration and implementation of Microsoft BizTalk solution;

f) At least 2 (two) persons certified for systems administration with at least 3 (three) years of relevant work experience, of which:

At least one (1) person to be Holder of at least one of the listed certificates:

o MCSE: Cloud Platform and Infrastructure;

o MCSE: Server Infrastructure

o Microsoft Specialist: Server Virtualization with Windows Server Hyper V and System Center

At least one (1) person to hold:

o MCSA certification for Windows Server 2016 or more advanced version of Windows Server.

g) At least 3 (three) persons with proven experience as a quality engineer, with at least 3 (three) years of work experience and engagement in at least three (3) projects, at least one of them must have a certificate:

o Certified Penetration Testing Engineer - SPTE

h) At least 1 (one) person with confirmed experience for security check of information systems with at least 3 (three) years of work experience, holding a certificate:

o Certified Security Analyst – ECSA

i) At least 1 (one) person, with a minimum of 3 (three) years of work experience, certified for HP Servers, holding a Certificate

o HP Accredited Solutions Expert, Server Solutions Architect.

Note: A valid certificate is accepted for a certificate, but not only a certificate for taken certification course. One person may be a holder of multiple certificates.

1) The Bidder must have full-time staff at all time during the entire duration of the Contract, holding the listed professional qualifications.

2) Statement concerning the elements of the Contract that the Bidder intends to subcontract to a subcontractor.

Минимално ниво(а) на стандарди:

II. The Economic operator must prove its capacity to meet the minimum requirements by submitting the following:

1) To prove its capacity under item 1 referring to professional qualifications of the expert staff, the Bidder shall prove this by submitting the following documentation:

o A list of expert staff comprised of minimum 20 proposed and hired persons as a team for project implementation, pursuant to the stipulated minimum requirements laid down above

o Regarding the manner of engagement if the person is employed, the Bidder is required to submit proof of full time employment (M1 / M2 form), and if he plans to recruit a professional staff, it is necessary to submit a Statement stating the person he intends to hire with their consent therein, with the additional written consent by the person he intends to hire

o In order to prove the relevant required education of the expert staff, the Bidder must submit the relevant required Diploma and/or Certificate for completed formal education.

o In order to prove the professional experience and certification of the experts, the Bidder must submit a valid required Certificate

o In order to prove the appropriately required experience of the experts, the Bidder shall submit his CV and a statement provided by the experts that they have the minimum required relevant experience in accordance with the requirement under the term by listing the relevant projects in accordance with the relevant requirement, whereby the years of relevant experience will be counted from the year of the first relevant project.

2) To prove its capacity of the terms and conditions under item 2 stated above, the Bidder shall prove this by lodging a Statement, that in case the Bidder is chosen as provider of the Procurement, the Bidder will have professional staff holding the required professional qualifications available for the entire duration of the project, and the same will be engaged in the project team thereof.

3) Statement concerning the elements of the Contract that the Bidder intends to subcontract to a subcontractor (in case such exist).

Note:

QUALITY SYSTEMS STANDARDS

In order to prove its capacity to meet the public procurement agreement in terms of quality systems standard, the economic operation must meet the following standards:

• To have an established Information Security Management System, in accordance with the requirements of the international standard ISO 27001-1: 2013 or equivalent.

• To have an established Business Continuity Management System, in accordance with the requirements of the international standard ISO 22301: 2019, or a newer version or equivalent

The Economic Operator will prove its capacity to meet the standards by submitting in scanned format the following:

• Valid Certificate of compliance with the international standard ISO…

… 27001: 2013, ie proof that it has established an Information Security Management System, in accordance with the requirements of the international standard ISO 27001-1: 2013 or equivalent.

… 22301: 2019, ie proof that it has established a Business Continuity Management System, in accordance with the requirements of the international standard ISO 22301: 2019 or equivalent
