Краток опис:
It will include:
• development of unified design of the new look of GRNM and ministries’ designated websites,
• development of websites of GRNM and of all ministries,
• delivery of CMS platform for managing and editing content available on the websites of GRNM and all ministries,
• filling developed websites with content,
• migration from ministries’ existing websites to new websites,
• publication of the websites,
• integration of developed websites with at least 5 government systems, among which: EPPS, Services Portal (uslugi.gov.mk), and other systems what would be defined under the analysis phase.
The websites, needed operational systems and/or database thereof, as well as other resources needed for the offered solution, should be installed on cloud infrastructure in the Ministry of Information Society and Administration (MISA), whereby the bidders should list under their bids exact scope of all needed software licenses (for the solution itself or any other software licenses for databases and operational systems) needed to ensure smooth operation of the solution and securing 99.7 % availability of the solution for the entire duration of the Contract, and these should also be covered under the scope of financial bids.

2.2.1 The Contracting Party shall exclude any economic operator from the public procurement procedure if it determines that the economic operator, or the person who is a member of the executive or oversight body of said economic operator or who is authorized to represent or adopt decisions or to perform oversight over the economic operator, has been sentenced with an enforceable judgement in the last 5 years on committed crime that involves elements of the following crimes stipulated under the Criminal Code:

— participation in criminal organization,
— corruption,
— tax and payroll tax evasion,
— terrorism or criminal acts related to terrorist activities,
— money laundering and financing terrorism, and
— child labor and human trafficking.
2.2.2. The contracting party shall exclude any economic operator from the public procurement procedure, if an economic operator:
— has unpaid taxes, payroll taxes or other public charges, except in cases when the economic operator has been permitted to pay taxes, payroll taxes or other public charges by means of deferred payment in compliance with special provisions and performs regular payment thereof,

— undergoes bankruptcy or liquidation proceeding,
— has been sentenced with secondary penalty — prohibition for participation in public call procedures, procedures for awarding public procurement contracts and public-private partnership contract,
— has been has been sentenced with secondary penalty – temporary or permanent prohibition to perform a particular activity,
— has been sentenced with misdemeanor sanction – prohibition to perform profession, activity or duty, or temporary prohibition to perform a particular activity, or
— issues false information/data or fails to submit information/data requested by the Contracting Party.
2.2.3 The contracting party shall exclude the economic operator from the public procurement procedure if the economic operator is listed under the list of issued negative references under Article 101 paragraph (3) of the Law on Public Procurements by the final deadline for delivery of bids or participation requests.

2.2.4 The contracting party shall exclude the economic operator from the public procurement procedure in cases when the exclusion condition is enlisted under the tender documentation:
(a) if the contracting party has valid reasons to determine that the economic operator has signed contracts with other economic operator with purpose or effect to distort competition. The determination of the contracting party stipulated under this item shall be considered valid if the Commission for Protection of Competition notifies the contracting party that it will initiate a misdemeanor procedure within a deadline of 15 days, based on notice lodged by the contracting party;

(b) if the economic operator has demonstrated significant or constant shortcomings in meeting key duties in previous public procurement contracts or previous concession and public-private partnership contracts signed with said contracting party, which, in turn, resulted in unilateral contract termination, damage claims or undertaking of other similar sanctions by the contracting party;

(c) if the economic operator exercises illegal influence over the contracting party’s decision or for acquisition of confidential information that would give said economic operator illegal advantage in the public procurement procedure.
2.4. Technical or professional capacity
2.4.1 To qualify as capable to perform the relevant public procurement contract in terms of technical or professional capacity, the economic operator should meet the following minimum criteria:
1) Reference list including the following minimum defined criteria:
• At least five (5) completed projects for implementation and/or maintenance of CMS (Content Management System) proposed.
• At least five (5) developed and displayed or consumed web services on the National Interoperability Platform.
• At least one (1) project for implementation, upgrade and/or maintenance of proposed CMS (Content Management System) solution, whereby it should allow access and login of at least 25 000 registered users (anticipated minimum number registered users registered in the solution requested by the subject procedure), whereby the services should have been delivered in the past 5 years(to secure larger competition) with a total Contract value being at least MKD 7 000 000.00;

2) To have regularly employed/engaged expert staff that would have the following professional qualifications for the entire duration of the contract:
(a) at least 1 (one) project manager with relevant and globally recognized valid Project Manager certification, or at least diploma on completed formal education in the second study cycle, specialized in/studied in department project management and at least 10 years of work experience as project manager in delivery of similar web-based softwate solutions;

(b) At least 10 (ten) persons certified for technology using CMS CMS (Content Management System) solution, each person with at least 5 years relevant experine in implementation thereof;
(c) At least two (2) persons with at least 5 years relevant experience in graphic and web design, of which at least one person shall hold a UX/UI design certificate.
3) For the entire duration of the contract, the bidder is obliged to have employed or engaged persons that hold the aforementioned professional qualifications.
4) Letter of Notice on contract elements that the Bidder intends to assign to a sub-contractor.
2.4.2 The economic operator shall prove meeting minimum requirements stipulated under Item 2.4.1 by lodging the following:
1) The economic operator shall prove meeting requirements under item 2.4.1 related to the Reference List, by lodging:
(a) confirmation letters/references on quality implementation of contract issued by service recipients. The confirmation letter shall list that projects have been implemented/maintained with the CMS solution offered.
(b) confirmation letters/references on delivered services, issued by service recipients. The confirmation letter shall list which web services were developed or consumed via the National Interoperability Platform.
(c) confirmation letters/references on delivered services, issued by service recipients. The confirmation letter shall list the number of user profile, and the Contract amount.
2) The bidder shall prove meeting criteria stipulated under Item 2.4.2 sub-item b) related to professional qualifications of expert staff, by delivery of the following documentation: In terms of method of engagement, if the person is employed, the Bidder should deliver proof of regular employment contract (M1/M2 form). If the Bidder intends to engage persons on a temporary basis, it should deliver a Statement Letter that would list the person to be engaged. To prove expert capacity of employed/engaged person, the bidder shall deliver Statement Letters from expert persons confirming that they meet the minimum criteria required in terms of years of relevant experience, and enlisting relevant projects pursuant to relevant requirement. As proof of possession of valid certificate, a copy of the certificate in question should be lodged.

3) Statement Letter that, if chosen as procurement holder, for the entire duration of the contract the bidder shall have employed or engaged persons that hold the listed professional
2.5 Quality Standards
2.5.1 To qualify as capable to perform the relevant public procurement contract in terms of system quality standards, the economic operator should meet the following minimum criteria:
• to have implemented quality management system, pursuant to requirements under international ISO 9001:2015 standard or equivalent,
• to have implemented service management system, pursuant to requirements under international ISO 20000-1:2011 standard or equivalent,
• to have implemented data security management system, pursuant to requirements under international ISO 27001-1: 2013 standard or equivalent,
• to have implemented business continuity management system pursuant to requirements under international ISO 22301:2012 standard or equivalent.
2.5.2 The economic operator shall prove meeting standards listed under the aforementioned sub-item by lodging scanned documents, as follows:
• valid certificate on compliance with international ISO…
… 9001:2015 standard, i.e. proof of implemented Quality Management System pursuant to requirements under international ISO 9001:2015 standard or equivalent.
… 20000-1:2011 standard, i.e. proof of implemented Service Management System pursuant to requirements under international ISO 20000-1:2011 standard or equivalent.
… 27001:2013 standard, i.e. proof of implemented Data Security Management System pursuant to requirements under international ISO 27001-1: 2013 standard or equivalent.
… 22301:2012 standard, i.e. proof of implemented Business Continuity Management System pursuant to requirements under international ISO 22301:2012 standard or equivalent.
Услови за извршување на договорот:
Main financing conditions and payment arrangements and/or reference to the relevant provisions governing them:
— 80 % of the bid amount shall be paid to the Procurement Holder based on adopted minutes on solution implementation and within 30 days following delivery of invoice in the Contracting Party’s archive,
— 20 % of the bid amount shall be paid to the Procurement Holder upon completion of the contract based on adopted minutes of quality contract completion and within 30 days following delivery of invoice in the Contracting Party’s archive.
Each bid that anticipates method of payment different than the one anticipated under this item shall be deemed unacceptable and, as such, shall be denied by the Public Procurement Commission.
