For the needs of firefighters in the Republic of Northern Macedonia (Republic Forces) the commission for purchase of equipment for firefighters made a decision to purchase a rescue system for stabilisation and lifting in natural disasters (earthquakes) and complex accidents (buses, heavy goods vehicles, etc.). This procurement would complete a complete process in terms of equipping the territorial firefighting units with rescue equipment, which in the future would be very necessary in terms of protection and rescue from ruins.

List and brief description of conditions:

Reasons for exclusion from the procedure

The contracting authority shall exclude from the public procurement procedure the economic operator:

1) If it determines that the economic operator or the person who is a member of the management or supervisory body of that economic operator or has the power to represent or supervise or supervise it, a final court judgment has been pronounced for the last 5 years; a crime that has elements of the following crimes set forth in the criminal code:

— participation in criminal association;

— corruption;

— tax evasion and contributions;

— terrorism or offenses related to terrorist activities;

— money laundering and financing of terrorism; and

— abuse of child labor and human trafficking.

2) Who has unpaid taxes, contributions or other public duties, unless he is authorised to defer payment of taxes, contributions or other public duties in accordance with special regulations and regularly pays them;

3) Is in bankruptcy or liquidation procedure;

4) He/she has been pronounced a secondary penalty — prohibition to participate in public call procedures; awarding public procurement and public-private partnership contracts;

5) Has been pronounced a minor penalty — temporary or permanent prohibition to perform a particular activity;

6) Has been pronounced a misdemeanor sanction with a ban on performing a profession, activity or duty, or a temporary ban on performing a particular activity;

7) Who provides false data or fails to submit the data requested by the contracting authority.

The contracting authority shall exclude the economic operator from the public procurement procedure if it is on the list of negative references issued by the deadline for submission of tenders or requests to participate.

In order to prove that there are no conditions for exclusion from the procedure, the economic operator shall submit the following documents:

— a statement by the economic operator that for the last 5 years the economic operator or the person who is a member of the managing or supervisory body of that economic operator or who has powers to represent or make decisions or supervise it has not in the last 5 years pronounced final court verdict for a felony which has elements of the criminal offenses of participation in criminal association, corruption, tax evasion and contributions, terrorism or criminal offenses related to terrorist activities, money laundering and fines for terrorism and child labor and human trafficking set out in the criminal code;

— confirmation of paid taxes, contributions and other public duties by a competent authority of the country where the economic operator is registered;

— confirmation that no bankruptcy procedure has been initiated by a competent authority;

— confirmation that no liquidation procedure has been initiated by a competent authority;

— confirmation from the Register of penalties for the criminal offenses of…

… legal entities that no secondary. Penalty has been imposed for prohibition of participation in public procurement procedures, awarding public procurement contracts and public-private partnership contracts;

… the legal entities that they have not been pronounced a secondary sentence — temporary ban on performing certain activity;

… the legal entities that he/she has not been pronounced a secondary penalty — permanent ban on performing certain activity;

— confirmation that he/she has not been sentenced with…

… a misdemeanor sanction — prohibition to perform a profession, activity or duty;

… misdemeanor sanction by a final judgment;

1) Publication of the contract notice regarding the content of the contract notice or the tender documentation;

2) Publication of the notice of changes and additional information as to the content of the changes and additional information;

3) Opening of bids, in relation to the failure of the contracting authority to adequately respond to timely questions or requests for clarification or modification of the tender documentation; or

4) Adoption of the decision on the selection of the most favorable bid or on the cancellation, in relation to the evaluation procedure and the selection of the most.
