2) Determining the capacity of the economic operator

2.1 Conditions for determining the capacity of the economic operators (Article 87 of the Law on Public Procurement).

2.1.1 When determining the capacity of the economic operators, the contracting authority verifies whether:

There are grounds to exclude the economic operator from the procedure,

The criteria for quality selection pursuant to Articles 89, 90, 91, and 92 of the Law on Public Procurement are met.

2.2 Grounds on which an economic operator shall be excluded from the procedure

2.2.1 The contracting authority shall exclude from the procedure any economic operator, or their executive or supervisory bodies, or any person authorised to represent the economic operator and act on their behalf in the decision-making and supervision process, who has effective court decision passed against them in the course of the last five years for some of the following crimes as established by the Criminal Code:

— participating in criminal organization,

— corruption,

— tax and contributions evasion,

— terrorism or terrorist-related activities,

— money laundering, financing terrorism, and

— child labour and human trafficking.

2.2.2 The contracting authority shall exclude from the procedure any economic operator that:

• has back taxes, back contributions and other public charges, unless deferred payment of taxes, contributions and other public charges has been approved in accordance with the corresponding regulations, and the economic operator regularly defrays those charges;

• has bankruptcy proceedings or liquidation procedure underway;

• has had a secondary penalty of prohibition to participate in public call procedures, be awarded public procurement contracts and public private partnership contracts, passed against them;

• has had a secondary penalty of temporary or permanent prohibition to perform individual activity passed against them;

• has a misdemeanour sanction passed against them – prohibition to perform professional activity or other duty, or temporary prohibition to perform certain activity, and

• has given false data or has not submitted the data requested by the contracting authority.

2.2.3 The contracting authority shall exclude any economic operator from the public procurement procedure should they, prior to the submission deadline, find themselves on the negative references list.

2.3. Verifying the capacity of the economic operator

2.3.1 The economic operators are to provide a single document, and/or certificates or statements pursuant to Article 95 of the Law on Public Procurement in order to verify that:

— there are no grounds – established in sub-item 2.2 in this tender documentation, pursuant to Article 88 of the Law on Public Procurement, to exclude the economic operator from the procedure.

2.3.2 In order to verify that there no grounds – established in sub-item 2.2 in this tender documentation, pursuant to Article 88 of the Law on Public Procurement, to exclude the economic operator from the procedure, the contracting authority shall accept the following documents:

Regarding sub-item 2.2.1 (Article 88, paragraph 1 of the Law on Public Procurement) – a statement given by the economic operator, or a single document verifying their capacity;

Regarding sub-item 2.2.2 (Article 88, paragraph 2 of the Law on Public Procurement) – a certificate issued by a competent authority in the Republic of North Macedonia or another country where the economic operator is registered in, or a single document verifying their capacity;

Regarding sub-item 2.2.3 (Article 88, paragraph 3 of the Law on Public Procurement) – an extract from the list of negative references the contracting authority obtains from the EPPS.

2.3.3 If the country where the economic operator is registered does not issue the documents required in sub-item 2.3.2 in this tender documentation (Article 95, paragraph (4) of the Law on Public Procurement), or if they do not encompass all instances of Article 88 of the L.

Економска и финансиска состојба:

A bank statement of the overall turnover of the company (data from the income statement issued by a competent authority, that is, audited income statement) for the last 3 (three) financial years for which such data is available, depending on the date the company was established on or started working, and depending on the availability of such data.

Минимално ниво(а) на стандарди:

Lot 1 — to have generated an annual income of no less than MKD 12 000 000.00 in the past 3 years (2018, 2019, and 2020)

Lot 2 — to have generated an annual income of no less than MKD 5 000 000.00 in the past 3 years (2018, 2019, and 2020)

Техничка и професионална способност:

A list of successfully realised contracts in the last 5 years, by providing documents that verify their quality completion.

Минимално ниво(а) на стандарди:

Lot 1 - to have concluded at least 1 (one) contract in the past 3 (three) years of the same or similar subject as the one of the public procurement contract in the amount of no less than MKD 8 000 000.00 MKD with VAT.

Lot 2 - to have concluded at least 1 (one) contract in the past 3 (three) years of the same or similar subject as the one of the public procurement contract in the amount of no less than MKD 3 000 000.00 MKD with VAT.
