- statement of the economic operator that no effective verdict has been issued against the economic operator within the past 5 years for a committed crime pursuant to Article 88 paragraph 1 of the LPP;

- confirmation stating that no bankruptcy procedure has been initiated by a competent body;

- confirmation stating that no liquidation procedure has been initiated by a competent body;

- certificate of paid taxes, benefits and other public duties issued by a competent body in the country where the economic operator is registered;

- confirmation from the Register of penalties for committed criminal offenses of legal entities proving that no secondary penalty -…

… ban on participating in open call procedures, awarding public procurement contracts and contracts on public - private partnership has been pronounced;

… temporary or permanent ban on performing particular activity has been pronounced;

- confirmation stating that no misdemeanour sanction - ban on the performance of the profession, activity or duty, i.e. temporary ban on the performance of a particular activity has been pronounced with an effective verdict.

- Document for registered activity: Documentfor registered activity (DRA form) as aproof that the bidder is registered as a natural person or a legal entity for conducting the activity related with the subject of the public procurement contract or proof that the bidder belongs to the relevant professional association in accordance with the regulations of the country where the bidder is registered.

Техничка и професионална способност:

- with a list of major deliveries of goods or services with values, dates, buyers (contracting authorities or economic operators), whilst providing confirmation of deliveries or services performed: • Statement of the Economic Operator that during its operation it has installed a minimum of 100 VPN points through packet switched networks based on labels • Certificate issued by the Contracting Authority for at least 1 performed service for SDWAN solution implemented in the last 3 years.

- with a description of the technical staff and technical bodies that will participate in the implementation of the public procurement, especially those who are responsible for quality control, and in case of public procurement of works, those who will be involved in the performance of works, regardless of whether they are employed in the economic operator or not: • Statement of the economic operator that it has the persons employed with the Economic Operator, with review of applications/deregistration in the compulsory social insurance for a business entity issued by the Employment Agency of the Republic of North Macedonia, with a list of certified employees, or appropriate contracts for engaged technical persons for the entire duration of the contract, by attaching a list of hired persons and attaching appropriate certificates for: o Certificate for minimum 2 (two) certified employees or engaged in the field of network technologies, CCIE expert level or equivalent o Certificate of minimum 3 (three) certified network security personnel or employees, professional level CCNP Security or equivalent o Certificate for minimum 3 (three) certified employees or engaged persons in the field of network technologies, professional level CCNP Enterprise or equivalent o Certificate for minimum 1 (one) certified employee or engaged person in the field of project management PMP, Prince or equivalent o Certificate minimum 1 (one) employee or hired person for IT services management with ITIL in IT service Management certificate or equivalent.

- with a description of the technical conditions and measures that the economic operator uses to ensure quality as well as with a description of its development and research capacities: • The economic operator should submit a technical solution for the offered VPN service in which the topology of the core network of the operator together with all presentation points that perform packet switching based on labels, as well as a description of the optical infrastructure and the manner of realization of network redundancy • Statement of the Economic Operator that it will provide the opportunity to change the initial network setup (addition of new lines and cancellation of existing lines) according to the needs and requirements of the Contracting Authority • Statement of the Economic Operator that will provide free maintenance of data connection services • Statement of the economic operator that will provide customer support 24 hours x 7 days a week on a telephone number free of charge • Statement of the Economic Operator that it will provide the Contracting Authority with administrative access to the network connection equipment physically located at the Contracting Authority. • Statement of the Economic Operator that it will provide the Contracting Authority with access to an Application Solution that will enable real-time traffic monitoring through the link, on daily, weekly, monthly and annual level, measuring the performance of the links and diagnosing the problems of the terminal equipment • Statement that the Economic Operator will meet the service level – SLA (Service Level Agreement) – Agreement on the level/quality of service for data connection where the following will be mandatory: o Defined service and performances of the data network, o Manner of reporting interruptions in service o Response time and troubleshooting.

Минимално ниво(а) на стандарди:

- with a statement on the instruments, plants or technical equipment available to the service provider or contractor for the performance of the contract: • Statement of the economic operator that the Availability of the VPN service implemented through the packet switched network based on labels, should be at least 99.5% on annual level. • Statement of the economic operator that it has a system for fault recording and monitoring through which the level of availability of the service is automatically calculated on an annual basis.

- Certificates and reports issued by competent quality control authorities with recognized competence, which test the suitability of the products which was clearly determined by the references to the specifications and standards: • Copy of the registration certificate issued by the Agency for Electronic Communications (AEC), that the Economic Operator is registered in AEC as a public telecommunication networks operator.

- Quality system standards: • ISO 9001: 2015 quality management standard or equivalent issued by an accredited body, with the number, date of issue and current validity of the certificate • ISO 27001: 2013 standard for protection of user information or equivalent issued by an accredited body, with the number, date of issue and current validity of the certificate • ISO 20000-1: 2011 standard for IT services management or equivalent issued by an accredited body, with the number, date of issue and current validity of the certificate • ISO 22301: 2012 standard for continuity management in business or equivalent issued by an accredited body, with the number, date of issue and current validity of the certificate.
