To prove that there are no conditions for exclusion from the procedure, the economic operator submits the following documents:

- statement of the economic operator that in the last 5 years the economic operator or the person who is a member of the management or supervisory body of that economic operator or who has the authority to represent or make decisions or supervise him, in the last five years has not a final court verdict for a crime that has elements of the criminal offenses of participation in criminal association, corruption, tax evasion and contributions, terrorism or criminal offenses related to terrorist activities, money laundering and terrorist financing and child labor and human trafficking, set out in the Criminal Code;

- Certificate for paid taxes, contributions and other public duties from a competent authority of the country where the economic operator is registered;

- confirmation that no bankruptcy procedure has been opened by a competent authority or a single document proving the ability;

- confirmation that no liquidation procedure has been opened by a competent body or a single document to prove the ability;

- Confirmation from the Registry of Penalties for committed criminal offenses of legal entities that he has not been sentenced to a secondary penalty ban on participation in public call procedures, awarding public procurement contracts and public-private partnership contracts or a single document proving the ability;

- a certificate from the Registry of Penalties for committed criminal acts of the legal entities that he / she has not been sentenced to a temporary penalty of temporary prohibition to perform a certain activity or a single document to prove the ability;

- Confirmation from the Registry of Penalties for committed criminal acts of the legal entities that he / she has not been sentenced to a secondary punishment, permanent ban on performing a certain activity or a single document for proving the ability;

- confirmation that no misdemeanor sanction has been pronounced with a final judgment - prohibition to perform a profession, activity or duty or a single document to prove the ability, and

- confirmation that he / she has not been pronounced a misdemeanor sanction with a final judgment - temporary prohibition to perform a certain activity or a single document to prove the ability.

In order to prove the ability to perform professional activity, the economic operator should submit:

- Certificate of registered activity as proof that it is registered as a natural or legal person to perform the activity related to the subject of procurement or proof that it belongs to an appropriate professional association in accordance with the regulations of the country where it is registered.

- Decision by which the bidder is given approval for performing activity of wholesale trade with drugs in accordance with the Law on Drugs and Medical Devices (for Part 1, 2 and 3)
