2.2 Reasons for exclusion from the procedure

2.2.1 The contracting authority shall exclude from the public procurement procedure the economic operator:

1) if it determines that the economic operator or the person who is a member of the management or the supervisory body of that economic operator or who has authorizations for representation or decision-making or supervision over him, in the last five years a final court judgment has been pronounced for a criminal offense that has elements of the following criminal offenses established in the Criminal Code:

- participation in a criminal association,

- corruption,

- tax evasion and contributions,

- terrorism or criminal offenses related to terrorist activities,

money laundering and terrorist financing and

- child labor abuse and human trafficking.

2) who has unpaid taxes, contributions or other public duties, unless he / she has been granted deferred payment of taxes, contributions or other public duties in accordance with the special regulations and pays them regularly;

3) who is in a bankruptcy procedure or in a liquidation procedure;

4) who has been sentenced to an ancillary ban on participation in public call procedures;

awarding public procurement contracts and public-private partnership contracts;

5) who has been sentenced to a secondary punishment, temporary or permanent prohibition to perform a certain activity;

6) to whom a misdemeanor sanction has been pronounced prohibition to perform a profession, activity or duty, ie temporary prohibition to perform a certain activity or

7) who gives false data or does not submit the data requested by the contracting authority.

2.3.1 Ability to perform professional activity

2.3.1.1 As a condition for determining the ability to perform professional activity, the contracting authority requires each economic operator to submit proof that it is registered as a natural or legal person to perform the activity related to the subject of procurement or proof that it belongs to an appropriate professional association in accordance with regulations of the country where it is registered - DRD form

2.3.1.2 When determining the ability to perform professional activity of the economic operators, the contracting authority shall request proof issued by a competent body for fulfillment of the special conditions for performing the activity prescribed in accordance with law that refer to the subject of public procurement.

2.3.1.3 The contracting authority reserves the right to further verify the authenticity of the submitted documents

2.3.1.4 In order to prove the ability to perform a professional activity, the economic operator should submit:

- Certificate for registered activity as proof that it is registered as a natural or legal person to perform the activity related to the subject of procurement or proof that it belongs to an appropriate professional association in accordance with the regulations of the country where it is registered - DRD form

2.3.2 Economic and financial situation

2.3.2.1 The necessary economic and financial capacity for execution of the contract of the economic operators, the contracting authority will determine through the following minimum conditions:

- positive financial result (balance sheet) in the last 3 years

- the economic operator to have achieved a minimum of 25,000,000.00 denars annual income in the last three years separately (in 2019, 2020 and 2021).

2.3.2.2 The economic operator proves the fulfillment of the minimum requirements from sub-item 2.3.2.1 by submitting:

- balance sheet report certified by a competent authority, ie audited balance sheet, or excerpts from the balance sheet report in cases when the publication of the balance sheet is prescribed by law in the country where the economic operator is registered;

- statement of the entire turnover of the enterprise (data from the income statement issued by a competent authority, ie audited income statement)

Техничка и професионална способност:

.3.3.1 The necessary technical and professional ability for quality execution of the contract, the contracting authority will determine through the following minimum conditions:

- Authorization for dealership and servicing of the offered vehicles by the manufacturer / authorized office of the manufacturer.

- Statement for possession of an authorized service for the offered vehicles on the territory of RSM stating the address of the same.

Минимално ниво(а) на стандарди:

2.3.3.2 The economic operator proves the fulfillment of the minimum requirements from sub-item 2.3.3.1 by submitting:

- Authorization for dealership and servicing of the offered vehicles by the manufacturer / authorized office of the manufacturer.

- Statement for possession of an authorized service for the offered vehicles on the territory of RSM stating the address of the same.
