The price of the subject of the contract, i.e. the lowest price offered in the acceptable bids submitted in the initial phase of the procedure. The initial price of the electronic auction will be expressed in denars which will be the currency for conducting the electronic auction. All bidders who submitted acceptable bids shall be invited to submit new prices or new values for the part of the bid which is the subject of an electronic auction. The electronic auction shall commence at the earliest two days from the date of sending the invitations for participation in electronic auction. Upon full evaluation of the initial bids, the ESPP will send automatic notification to the registered e-mail address of any economic operator not qualified to participate in the electronic auction, while economic operators who submitted acceptable bids in the first phase of the procedure will receive an invitation to participate in the electronic auction through the ESPP. In the process of negative bidding (e-auction), the allowed minimum difference in the offered prices shall be 0.1% to 1% of the initial price at the auction, and the maximum difference up to 10% of the initial price at the auction. The invitation to participate in the auction will be sent electronically to the mailbox of the ESPP user profile. The invitation to participate in the auction shall include: starting price at the auction, date and time of commencing the auction, manner of conducting the auction, minimum allowed differences in the process of negative bidding, time allowed after receiving the last bid before closing the e-auction, as well as all the necessary information on the connection to the electronic means used. At each stage of the auction all bidders shall have access to all information which will enable them to determine their rank at any time. Bidder's identity shall not be revealed at any stage of the bidding. If only one acceptable bid remains upon initial evaluation in the public procurement procedure, the e-auction shall not be conducted, pursuant to Article 59 of the Public Procurement Law (Official Gazette of the Republic of Macedonia No. 24/19 and Official Gazette of the Republic of North Macedonia No. 87/21).

A precondition for signing a contract with the most favorable economic operator shall be providing bank guarantee by the selected most favorable bidder for quality performance of the contract in the amount of 10% of the contract value. The guarantee shall be submitted in the form of a bank guarantee in writing. The guarantee shall be submitted in original form. Copies shall not be acceptable. The bank guarantee shall be valid until full contract performance. The Contracting Authority, upon selection of the best bid, shall additionally determine the expiry date of the guarantee. The bank guarantee shall be denominated in the currency of the contract. The guarantee shall be issued by a bank. A bank guarantee issued by all domestic banks shall be accepted, with the clause "no objection", "on first demand" or containing words having the same meaning. Foreign bank acceptable for issuing guarantee shall be any bank which according to the credit rating system of Moody's, Standard and Poor's and Fitch has been rated at least BBB- (according to the credit rating system of Standard and Poor's and Fitch ), or Baa3 (according to Moody's). The selected best bidder shall present bank guarantee within 10 working days from signing the contract. The bank guarantee shall be submitted within the set deadline by mail or personally to the contact person under item 1.2.2 of the bid documentation. The bank guarantee shall be activated if the Contractor fails to fulfill some of the obligations stipulated in the public procurement contract within the set deadline, on which the Contractor shall be notified in writing. For activation of the bank guarantee, the Contractor may initiate dispute before the competent court. If the contract is completely performed as previously agreed, the Contracting Authority shall return the bank guarantee to the Contractor within 14 days after the complete contract performance. The Contracting Authority shall return the bank guarantee to the Contractor by mail, in the head office of the economic operator or personally in the main office of the Contracting Authority.
